DECREE N °-7,948, OF March 12, 2013

Disposes about the Graduate Student Program-PEC-G.

THE CHAIRWOMAN OF THE REPUBLIC, in the use of the assignments that gives him the art. 84, caput, inciso VI, paragraph (a) of the Constitution,

D E C R E T A:

CHAPTER I

OF THE GENERAL PROVISIONS

Art. 1º The Graduate Student Program-PEC-G is intended for the formation and qualification of foreign students by offering free vacancies in undergraduate courses in Brazilian Higher Education Institutions-IES.

Single paragraph. PEC-G constitutes a set of activities and procedures of international educational cooperation, preferably with developing countries, based on current bilateral agreements and is characterized by the training of the foreign student in Graduate course in Brazil and your return to the country of origin at the end of the course.

Art. 2º PEC-G will be implemented jointly by the Ministry of Foreign Affairs and the Ministry of Education, pursuant to this Decree.

§ 1º Compete to the Foreign Ministry coordinate the procedures concerning the implementation of PEC-G with foreign governments through the diplomatic missions and Brazilian consular repartitions.

§ 2º Compete to the Ministry of Education coordinate the procedures regarding the accession of the IES to PEC-G, offer of the vacancies, selection and registration of the candidates and monitoring of the programme.

§ 3º The Ministries of Foreign Affairs and Education will not interfere in matters of academic nature, of exclusive attribution of the IES members of the program.

CHAPTER II

DAS VACANCIES

Art. 3º The IES interested will participate in PEC-G by means of specific adherence term to be firmed up with the Ministry of Education.

Art. 4º The Ministry of Education shall, annually, establish the total vacancies per course offered under the PEC-G following indication of the availability of the IES participants.

§ 1º The Ministry of Education will be able to request the IES to provision of additional vacancies to cater for applicants applicants to PECG and the express in international cooperation agreements.

§ 2º Within the framework of PEC-G, only vacancies in courses offered in daytime period or integral.

CHAPTER III

DAS INSCRIPTIONS

Art. 5º PEC-G's selective timing and process will be annually regulated by edital expedited by the Ministry of Education, with the Ministry of Foreign Affairs ' annuence.

Art. 6º Will be able to enroll in PEC-G foreign students:

I-residents abroad and who are not permanent visa holders or any other type of temporary visa for Brazil;

II- greater than 18 and preferentially up to 23 years;

III-which firms Term of Financial Responsibility, in which they ensure to have means to cost transport and livelihood in Brazil during the course of Graduation;

IV-which firms Term of Commitment, where they commit to comply with the rules of PEC-G; and

V-who submit certificate of completion of the high school and Certificate of Proficiency in Portuguese Language for Foreign-Celpe-Bras.

§ 1º Exceptionally, the candidate who has not completed high school on the date of enrolment will be able to submit the certificate of completion of the high school in the act of the matriculation in the IES.

§ 2º The candidate originating in a country where there is no application of the Celpe-Bras will be able to perform it in Brazil, a single time, after completion of the Portuguese course for preparatory foreigners for the Celpe-Bras exam, in IES accredited.

§ 3º The candidate flunked at the Celpe-Bras applied in Brazil, in the form of § 2º, will not be able to join PEC-G, vetoed to extend his registration and the term of stay in Brazil, as laid out in Law No. 6,815, of August 19, 1980 and in Decree n ° 86,715, of December 10, 1981.

§ 4º It is vetted new enrollment in PEC-G to the selected candidate who cede from effecting his initial matriculation at IES without justification.

Art. 7º Following disclosure of the outcome of the selection, the diplomatic missions and Brazilian consular repartitions will grant selected candidates the temporary student visa in the form of the applicable legislation.

§ 1º A regular migratory condition in Brazil, which comprises the obtaining of the visa and the updating of the registration from abroad, is the responsibility of the student-convenium, and is indispensable for effectuation of the matriculation and subsequently for enrollment in disciplines every start of a school period.

§ 2º IES IES will ensure by the fulfilment of the obligations provided for in § 1º, providing the necessary documents for the registration of the foreigner, vetted enrollment in disciplines of student-convenent in irregular migration situation.

CHAPTER IV

OF MATRICULATION, DEADLINES AND COMPLIANCE

OF THE PROGRAM

ART. 8º The presentation of the student-conven for matriculation should comply with the IES school calendar for the one selected. Single paragraph. It is incumbent upon IES to check the documentation and regularity of the migrant situation of the student-convent for effectuation and registration of matriculation.

Art. 9º The student-convenium will be able to request change of course or Institution, met the criteria and the regimental standards of the IES participants of PEC-G.

§ 1º The course change could occur a single time and exclusively to the end of the first year of studies, met the criteria and the regimental standards of IES.

§ 2º The student should obey the regulatory deadline for curriculum integralisation.

§ 3º The matriculation for obtaining new habilitation, linked to the same course, will only be permitted if the statutory deadline of completion of the initial course is complied with.

§ 4º In case of student-convent scholarship recipient or financial aid, the change of course will be conditional on the favourable manifestation of the granting institution, governmental or private.

§ 5º IES should communicate, immediately, the change of course to the Ministry of Education and the Ministry of Foreign Affairs.

Art. 10. The transfer of the student-convent must observe the requirements of the IES recipient, and the criteria set forth by the art. 49 of Law No. 9,394 of December 20, 1996, ressaved the sealings provided for in the incisos VI and VII of the caput of the art. 12.

§ 1º The transfer to continue studies in the same course is to be done between IES participants of PEC-G a single time, exclusively at the end of the first year of studies.

§ 2º A IES, ao accept the transfer, should immediately arrange for the dispatch of the documents regarding the transfer to the Federal Police, for updating the record, pursuant to Law No. 6,815, 1980.

§ 3º Compete à IES Recipient communicate the fact to the Ministry of Education and the Ministry of Foreign Affairs.

Art. 11. It is vetted the participation of PEC-G students in academic mobility programs that entails displacement of the student, with alteration of the registration conditions, with temporary change of head office or country.

Art. 12. It will be turned off from the Program the student-convent that:

I-do not enroll in the IES regulatory deadline;

II-lock up matriculation unjustifiably or abandon the course;

III-no obtains the minimum frequency required by IES in each discipline;

IV-is flouted by three times in the same discipline;

V-is flouted in more than two disciplines, or equivalent credits number, in the same semester, from the 2º year or the 3º semester of the course;

VI-get transfer to IES not participant of PECG, or that does not meet the provisions of the art. 10;

VII-get new admission in IES through selective process other than that of PEC-G;

VIII-obtains, during the course, seen different from that nominee in the art. 7º or diverse migration condition; or

IX-present improper conduct, found by disciplinary proceedings, within the scope of IES.

§ 1º Understand conduct itself as improper conduct that attests against the standards disciplars of IES and Brazilian legislation, and ostensible manifestations of transgression of social coexistence norms.

§ 2º The general trancement of matriculation will not be permitted, except for the reason of health, own or related to first degree, including by affinity, proven together to IES.

§ 3º Extend to the student-convent the standards applicable to the student body members of each IES compatible with this Decree, included the that deal with the jubilation and too many hypotheses of taking off the course.

§ 4º Compete to IES communicate the shutdown of the studantech to the Federal Police, the Ministry of Education and the Ministry of Foreign Affairs.

CHAPTER V

FINAL PROVISIONS

Art. 13. It is vetoed to the student-convent the exercise of paid activity that sets up employment bonding or characterize pay or salary payment for services rendered.

Single paragraph. Participation of the student-in-curricular-in-stage, research, extension and monitory stage activities is allowed, obeyed legislation referring to temporary resident foreigners.

Art. 14. It is guaranteed to the student-convent medical, dental and pharmaceutical assistance by the Single Health System-SUS, in the terms of convenium firmed between the Ministry of Foreign Affairs and the Ministry of Health without prejudice to the student's adherence to a supplementary health plan.

Single paragraph. In the event of a death, serious or incurable disease preventing further studies, the Foreign Ministry will be able to shoulder the costs pertaining to the back of the student-convenium for the country of origin, if there is financial impediment of the student's student and availability of budgetary resources from the Ministry.

Art. 15. The participating institutions of the PEC-G will, under the law, be able to grant financial aid intended for the student's degree, by limited time and during the course, to the title of housing, transportation or feeding, in any case conditioned to good academic harnessing.

Art. 16. The bond of the student-convenium with PEC-G cesses with the completion of the course and grade collation.

§ 1º Compete à IES inform the relationship of the student-convenent graduates to the Federal Police, the Ministry of Education and the Ministry of Foreign Affairs, immediately after the grade collation.

§ 2º It is vetted the extension of the student-convent stay in Brazil beyond the legal deadline indicated in the Statute of the Foreigner.

Art. 17. The student-convent will receive, mandatory, personal and free of charge, his diploma, amendment and school history, legalized, in the Brazilian diplomatic mission where he applied to PEC-G.

Art. 18. The IES that offer vacancies in the Portuguese course for Foreigners preparatory for the Celpe-Bras exam to the students-convenium should do so upon signature of specific Term, to be firmed up with the Ministry of Education, ensuring the conditions and the fulfillment of the Program.

Art. 19. The student-convent students contemplated in this Decree are exempt from referral to the National Student Performance Examination-ENADE, an integral part of the National Higher Education Assessment System-SINAES, established by Law No. 10,861, 14 of april 2004.

Art. 20. The Ministry of Education and the Ministry of Foreign Affairs will keep updated the respective electronic pages on PEC-G, where they will outline additional information and too much subjects of interest.

Single paragraph. It is the responsibility of the student-conven to keep informed about obligations and commitments arising from participation in PEC-G through regular consultation to the electronic portals of the Ministry of Foreign Affairs, Ministry of Education and of the IES.

Art. 21. Joint act of the State Ministers of Education and the Ministry of Foreign Affairs will have on the operationalization of PEC-G

Art. 22. This decree comes into force on the date of its publication.

Art. 23. It is hereby revoked the Decree No. 55,613 of January 20, 1965.
