THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, inciso IV, of the Constitution,
Considering that the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), signed by Brazil on August 12, 1980 and approved by the National Congress, by Legislative Decree no 66, of November 16, 1981, provides for the modality of Economic Supplementation Agreement;
Whereas, based on the Treaty of Montevideo of 1980, the Complementation Agreement Economic no 39 was firmed by the Plenipotentiaries of the Federative Republic of Brazil and the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community), in Montevideo on August 11, 1999 and incorporated into the Brazilian legal planning by means of the Decree No. 3,138 of August 16, 1999;
Whereas the Plenipotentiaries of the Federative Republic of Brazil and of the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community), based on the Treaty of Montevideo of 1980, signed on November 15, 2000, in Montevideo, the First Additional Protocol to the Economic Supplementation Agreement no 39, incorporated into the Brazilian legal planning by means of the Decree No. 3,744, of February 5, 2001;
Whereas the Plenipotentiaries of the Federative Republic of Brazil and the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community), based on the Treaty of Montevideo of 1980, signed on April 11 of 2001, in Montevideo, the Second Additional Protocol to the Economic Supplementation Agreement no 39, incorporated into the Brazilian legal planning by means of the Decree No. 3,854, of June 29, 2001;
Considering that the Plenipotentiaries of the Federative Republic of Brazil and the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community), on the basis of the Treaty of Montevideo of 1980, signed on August 8, 200l, in Montevideo, the Third Additional Protocol to the Economic Supplementation Agreement no 39, which extends the ACE-39 until December 31, 2001, having been the subject of the Declaratory Act of the Coordinating General-General Taxation System no 34, of August 20, 2001, authorising, upon formalisation of liability term, waived bail, collateral or deposit, for the guarantee of suspended tributes, the customs disembarkation of the goods imported under the conditions set out in the Economic Complentation Agreement no 39, until the promulgation of the Third Additional Protocol;
Whereas the Plenipotentiaries of the Federative Republic of Brazil and of the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community), based on the Treaty of Montevideo of 1980, signed on September 26, 2001, in Montevideo, the Fourth Additional Protocol to the Economic Supplementation Agreement no 39;
DECRETA:
Art. 1o The Fourth Additional Protocol to the Economic Supplementation Agreement no 39, among the Governments of the Federative Republic of Brazil and of the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community) of September 26, 2001, apensed by copy to the present Decree, will be executed and fulfilled as entirely as it contains.
Art. 2o This Decree comes into effect on the date of its publication.

Economic Supplementation Agreement No. 39 signed between the Republics of Colombia, Ecuador, Peru and Venezuela, Paises-Members of the Andean Community, and the Federative Republic of Brazil
Fourth Additional Protocol
The Plenipotentiaries of the Republics of Colombia, Ecuador, Peru and Venezuela, member states of the Andean Community, and of the Federative Republic of Brazil, duly authorized by their respective Governments second powers presented in good and due form, deposited opportunely in the General Secretariat of the Latin American Integration Association (ALADI),
Considering the provisions of the Administrative Commission of the Economic Supplementation Agreement No. 39, upon resolution 004/2001 passed on June 29, 2001,
Concome in:
Article 1º-Amend the Economic Supplementation Agreement No. 39 by incorporating new products and the deepening of outwarded preferences, under the conditions stated in the annex.
Article 2º-The this Protocol shall enter into force bilaterally, on the date on which each of the Signatary Parties, members of the Andean Community, together with the Federative Republic of Brazil have incorporated the same to their domestic law, in the terms of their respective legislation.
The General Secretariat of ALADI will be depositary of this Protocol, of which it will send duly certified copies to the Signatary Parties.
In faith of what, the respective Plenipotentiaries sign the present Protocol in the city of Montevideo, at the twenty-six days of the month of September two thousand and one, in an original in the Portuguese and Spanish languages, being both texts being equally valid.
