DECREE NO. 4,106, OF January 28, 2002.

Disposes on the execution of the Thirtieth Eighth Protocol Additional to the Economic Supplementation Agreement no 18, between the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, of October 12, 2001.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, inciso IV, of the Constitution,

Considering that the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), signed by Brazil on August 12, 1980 and approved by the National Congress, by Legislative Decree no 66, of November 16, 1981, provides for the modality of Economic Supplementation Agreement;

Whereas, based on the Treaty of Montevideo of 1980, the Complementation Agreement Economic no 18 was firmed by the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, in Montevideo on November 29, 1991 and incorporated into the legal Brazilian through the Decree No. 550 of May 27, 1992;

Whereas it was signed, on November 20, 2000, in Montevideo, the Twenty-Fourth Additional Protocol to the Economic Supplementation Agreement no 18, incorporated into the Brazilian legal planning by means of the Decree No. 3,757 of February 21, 2001, which adapts certain aspects of the ACE-18 origin regime;

Whereas on April 24, 2001 the Mercosur Trade Commission adopted, in Asuncion, Guideline 4/01, which extends until June 30, 2001 the time frame provided for in Article 9o of the cited Twenty-Fourth Additional Protocol to the Economic Supplementation Agreement no 18, relating to the acceptance of models of certificates of origin;

Whereas the Plenipotentiaries of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay affirmed, on May 17, 2001, in Montevideo, the Thirtieth Second Additional Protocol to the Economic Supplementation Agreement no 18, of conformity with the 1980 Treaty of Montevideo, which aims to implement Guideline 4/01 of the Mercosur Trade Commission;

Considering that the Plenipotentiaries of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay struck, on July 20, 2001, in Montevideo, the Thirtieth Third Protocol to the Economic Supplementation Agreement no 18, of compliance with the 1980 Treaty of Montevideo, which aims to extend until September 30, 2001 the deadline for mandatory use of the certificate of origin model instituted by the Twenty-Fourth Additional Protocol to the ACE-18 (MERCOSUL-Decision CMC no 3/00);

Whereas the Plenipotentiaries of the Federative Republic of Brazil, of the Argentine Republic, of the Republic of Paraguay and the Eastern Republic of Uruguay struck, on October 12, 2001, in Montevideo, the Thirtieth Eighth Protocol Additional to the Economic Supplementation Agreement no 18, of conformity with the Treaty of Montevideo of 1980, which aims to extend from 1o from October to December 31, 2001 the deadline for mandatory use of the certificate of origin certificate instituted by the Twenty-Fourth Additional Protocol to the ACE-18 (MERCOSUL-Decision CMC 3/00);

DECRETA:

Art. 1o It gets promulgated, for all the effects, the Thirtieth Eighth Protocol Additional to the Economic Supplementation Agreement no 18, among the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, of October 12, 2001, apensed by copy to the present Decree.

Art. 2o This Decree takes effect on the date of its publication.

ECONOMIC COMPLEMENTATION AGREEMENT NO. 18,

CELEBRATED BETWEEN ARGENTINA, BRAZIL, PARAGUAY AND URUGUAY

Trigth Eighth Additional Protocol

The Plenipotentiaries of the Argentine Republic, of the Federative Republic of Brazil, of the Republic of Paraguay and of the Eastern Republic of Uruguay, accredited by their respective Governments second powers that were bestowed in good and due form, deposited opportunely at the General Secretariat of the Latin American Integration Association (ALADI).

CONSIDERING that the Trade Commission of MERCOSUR, in its LII Meeting concluded on 4 and October 5, 2001 agreed to extend the deadline for the requirement of the new MERCOSUR Certificate of Origin approved by Decision 3/00 of the Common Market Council, which is stated in the Twenty-fourth Additional Protocol to ACE 18,

DECK IN:

Single Article.-Extend from 1 ° October to December 31, 2001 the deadline provided for in Article 9º of the Twenty-Fourth Additional Protocol to the ACE 18 for the mandatory of the use of MERCOSUR Origin Certificate model, which results from the said Additional Protocol.

Until that date will be indistinctly accepted the Certificate of Origin issued in the previous form template or in the new model, provided that they have been issued from the date of issuance of the commercial invoice corresponding or on the 60 consecutive days.

The General Secretariat of ALADI shall be a depositary of this Protocol, of which it will send duly certified copies to the signatory Governments.

IN FÉ DO THAT, the respective Plenipotentiaries sign the present Protocol in the city of Montevideo, at the twelve days of the month of October two thousand and one, in an original in the Portuguese and Spanish languages, being both texts being equally valid.
