DECREE OF April 22, 2014

Declara of public utility, for the purposes of misappropriation, in favor of the Autopista Ferno Dias S.A. dealership the real estate it mentions, located in the Municipality of Joyous Landing, State of Minas Gerais.

The CHAIRPERSON OF THE REPUBLIC, in the use of the attribution that confers it on art. 84, caput, inciso IV, of the Constitution, with a view to the provisions of the art. 3º, art. 5º, caput, points ("h" and "i", and art. 6º of the Decree-Law No. 3,365 of June 21, 1941 in the art. 29, caput, inciso VIII, and art. 31, caput, inciso VI, of Law No. 8,987, of February 13, 1995, and in accordance with that appearing in the ANTT Process No. 50500.167518 /2013-92,

DECRETA:

Art. 1º Become declared of public utility, for the purposes of dispropriation, in whole or in part, in favor of the Autopilist Ferno Dias S.A., the real estate bounded by the topographical coordinates described below, excluded the domain goods public, situated on the banks of the Highway Ferno Dias, 381/MG, located in the Municipality of Joyous Landing, State of Minas Gerais, necessary for the execution of the side street implantation works on the stretch between km 866 + 070m and km 869 + 127m, in the Pista North:

I-area 1-starts the perimeter in point 1, of N=7524935.917 coordinates and E=402922.153, being comprised of the related elements: segment 1-2, in straight line with azimuth of 36º23 '12' 'and distance of 20 ,94m; segment 2-3, in straight line with azimuth of 36º49' 36 '' and distance of 34 ,86m; segment 3-4, in straight line with azimuth of 39º33 '53' 'and distance of 58 ,49m, confronting from point 1 to 4 with Highway Ferno Days, 381/MG; segment 4-5, in straight line with azimuth of 132º33' 54 '' and distance of 8.25m, confronting from point 4 to 5 with the property of Wladimir Landiva; segment 5-6, in a straight line with azimuth of 220º02 '55' 'and distance of 66 ,79m; segment 6-7, in straight line with azimuth of 220º59' 26 '' and distance of 46 ,64m, confronting from point 5 to 7 with the property of Alaor Pereira and others; segment 7-1, in a straight line with azimuth from 303º49 '23' ' and distance of 3.70m, confronting from point 7 to 1 with the property of Laerte Alves de Oliveira and another; with area of 789 ,41m², which is to be highlighted from the registration No. 5,004 of the Carthorium of Register of Joyous Landing Real Estate, State of Minas Gerais

II-area 2-starts the perimeter at point 1, of coordinates N=7525510.345 and E=403404.700, being constituted by the related elements: segment 1-2, in a straight line with azimuth of 29º26 '34' ' and distance of 10 ,67m, confronting from point 1 to 2 with the Highway Ferno Days, 381/MG; segment 2-3, in straight line with azimuth of 135º55 '27' '' and distance of 4.21m, confronting from point 2 to 3 with the property of José Rodolfo Pereira and others; segment 3-4, in straight line with azimut of 220º41'41 '' and distance of 11 ,35m, confronting from point 3 to 4 with the property of Expedite Silveria Pereira and others; segment 4-1, in a straight line with azimuth of 341º37 '05' ' and distance of 2.46m, confronting from point 4 to 1 with the property of Expedite Silveria Pereira and others; with area of 33 ,55m², which is to be highlighted from the tuition No. 58,433 of the Joyous Landing Estate Register, State of Minas Gerais; and

III-area 3-starts the perimeter at point 1, of coordinates N=7525519.637 and E=403409.946, being constituted by the related elements: segment 1-2, in a straight line with azimute from 40º56 '57' 'and distance of 10 ,45m; segment 2-3, in straight line with azimuth of 38 ° 38' 57 '' and distance of 6,31m; segment 3-4, in straight line with azimuth of 40 ° 16 '53' ' and distance of 11 ,84m; segment 4-5, in straight line with azimuth of 40 ° 02 '13' 'and distance of 21 ,79m, confronting from point 1 to 5 with the Highway Ferno Days, BR-381 /MG; segment 5-6, in straight line with azimuth of 86 ° 11'26' 'and distance of 3,34m; segment 6-7, in straight line with azimuth of 122º49' 08 '' and distance from 1,14m; confronting from point 5 to 8 coma property of José Rodolfo Pereira and others; segment 7-8, in a straight line with azimuth of 219º24 '29' 'and distance of 53 ,28m; segment 8-1, in straight line with azimuth of 315 ° 55' 27 '' and distance of 4.21m, confronting from point 8 to 1 with the property of Expedite Silveria Pereira and others; with total area of 200 ,00m², which is to be highlighted from the Registration No. 17,028 of the Joyous Landing Estate of Register, State of Minas Gerais.

Art. 2º Stay the Autopist Ferno Dias S.A. dealership authorized to promote, with own resources, the disappropriation of the areas of land and benfeits of which it treats art. 1º.

Single paragraph. The expropriating shall be allowed to invoke the character of urgency in the process of dispropriation, for purposes of impropriation in the possession, pursuant to art. 15 of the Decree-Law No. 3,365 of June 21, 1941.

Art. 3º The declaration of public utility does not exonerate the dealership of the prior obtaining of the licensing and fulfilment of the obligations attached to the environmental and other public administration bodies, necessary to the effectivation of the works and activities referred to in art. 1º.

Art. 4º This Decree comes into effect on the date of its publication.
