Declara of social interest, for purposes of misappropriation, the real estate covered by?Territory Quilombola Lagoa do Fish?, situated in the Municipality of Bom Jesus da Lapa, State of Bahia.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that give him the arts. 84, inciso IV, and 216, § 1st, of the Constitution, and with a view to the provisions of the art. 68 of the Act of the Transitional Constitutional Provisions and in the Law no 4,132 of September 10, 1962 combined with art. 6th of the Decree-Law no 3,365, of June 21, 1941,

DECRETA:

The coordinates described here, were obtained with GPS of ETREX type Navigation and digitization in the SD23XDI Charter (Scale 1/100000-Source SEI-IBGE). The perimeter coordinates are found represented in the UTM System, referred to the Central Meridian 45 ° WGr., having as DATUM the SAD-69 (Process INCRA/SR-05/no 54160.003687 /2004-63).

Art. 2nd This Decree, regardless of discrimination or fundraising, no outorts particular indemnifying effects, in relation to areas of public domain, constituted by law or public record, and to areas whose private domain is harvested by nullity, prescription, comfy or rendered ineffective by other grounds, excepted good-faith benefactions by authoritative law, excluding still from its effects the semovents, machines and agricultural implements.

Art. 3rd The National Institute of Colonization and Agrarian Reform-INCRA, attested to the dominial legitimacy of the planimetry area of immovable situated in the polygon described in the art. 1st of this Decree, is hereby authorized to promote and carry out the dispropriation, in the manner provided for in the Act no 4,132, of September 10, 1962, and in the Decree-Law no 3,365, of June 21, 1941.

§ 1st The INCRA, regardless of prior judicial statement, is expected to administratively ascertaining the occurrences referred to in art. 2nd, and will invoke them in judgement, for purposes of exclusion from indemnification.

§ 2nd The Advocate-General of the Union, through its legal unit of implementation together with the INCRA, may, for the purpose of immission of possession, claim the urgency to which the art is concerned. 15 of the Decree-Law no 3,365, from 1941.

Art. 4th This Decree comes into effect on the date of your publication.
