DECREE OF February 13, 2006.

Creates the New River National Park, located in the Municipalities of Itaituba and Novo Progresso, in the State of Pará, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, inciso IV, of the Constitution, in accordance with the provisions of the art. 11 of the Act No 9,985 of July 18, 2000 and in the Decree no 4,340 of August 22, 2002 and taking into view what is stated in the Process in the 02001.001348 /2005-52,

DECRETA:

Art. 1º It is created the New River National Park, located in the Municipalities of Itaituba and Novo Progresso, in the State of Pará, with the aim of preserving natural ecosystems of great ecological relevance and scenic beauty, enabling the realization of scientific research and the development of activities of environmental education and interpretation, of recreation in contact with nature and ecological tourism.

Art. 2º The New River National Park has the limits described from the topographical letters, in scale 1:100.000, MI 1169, 1170, 1171, 1248, 1249, 1250, 1251, 1328, 1329, 1329 and 1330, edited by the Directorate of Geodesia and Cartography of the Brazilian Institute of Geography and Statistic-IBGE, with the following descriptive memorial: starts at point 1, of approximate geographical coordinates (c.g.a.) 08 ° 16 '34 " S and 55 ° 50' 8" Wgr., located in an affluent without denomination of the right bank of the Mutuacá River, corresponding to the boundary of the Armed Forces Proof of the Armed Forces Brigadier Velloso, second constant descriptive memorial in the Decree of August 19, 1997; of this point, follows downstream by the left margin of the said affluent to the point 2, of c.g.a. 07 ° 58 '0 "S and 55 ° 44' 35" Wgr., located at the confluence of the said affluent with the Mutuacá River; Single paragraph. The subsoil of the area described in the caput of this article integrates the boundaries of the New River National Park.

Art. 3º Ficam declared of public utility, for purposes of misappropriation, by the Institute Brazilian of the Environment and Renewable Natural Resources-IBAMA, the rural real estate of legitimate private domain and its benefits that come to be identified in the limits described in the art. 2nd of this Decree, in the terms of art. 5th, paragraph "k", and 6th of the Decree-Law no 3,365, of June 21, 1941.

Para. single. The Advocate General of the Union, through its legal unit of implementation with the IBAMA, shall be authorized to promote the relevant administrative and judicial measures, aiming at the declaration of nullity of any property titles and respective real estate records considered irregular, incidents in the conservation unit of which it treats this Decree.

Art. 4º The lands contained in the boundaries of the National Park of Rio Novo, of which it treats art. 2nd, belonging to the Union, will be ceded to the IBAMA by the Union Heritage Secretariat of the Ministry of Planning, Budget and Management, in the form of the law.

Art. 5º The national defense activities carried out in the Velloso Brigadier's Field of Provas will not suffer restrictions depending on the creation of the New River National Park.

Art. 6º This Decree goes into effect on the date of its publication.
