DECREE NO. 3,928, OF September 19, 2001

Disposes on the execution of the Quadragth Fifth Additional Protocol to the Economic Supplementation Agreement No. 2 (automotive vehicles), between the Governments of the Federative Republic of Brazil and of the Eastern Republic of Uruguay, of May 31, 2001.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, inciso IV, of the Constitution,

Considering that the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), signed by Brazil on August 12, 1980 and approved by the National Congress, by the Legislative Decree No. 66 of November 16, 1981, provides for the modality of Economic Supplementation Agreement;

Whereas the Plenipotentiaries of the Federative Republic of Brazil and the Eastern Republic of the Uruguay, on the basis of the Treaty of Montevideo of 1980, signed, on December 20, 1982, in Montevideo, the Economic Supplementation Agreement No. 2, between the Governments of the Federative Republic of Brazil and the Eastern Republic of Uruguay, which was incorporated into the Brazilian legal planning by means of the Decree No. 88,419 of June 20, 1983;

Whereas the Plenipotentiaries of the Federative Republic of Brazil and the Eastern Republic of Uruguay, on the basis of the Treaty of Montevideo of 1980, signed on May 31, 2001, in Montevideo, the Quadragth Fifth Additional Protocol to the Economic Supplementation Agreement No. 2 (Automotive vehicles), between the Governments of the Federative Republic of Brazil and of the Eastern Republic of Uruguay;

DECRETA:

Art. 1º It gets promulgated, for all the effects, the Quadragth Fifth Additional Protocol to the Economic Supplementation Agreement No. 2 (Automotive vehicles), between the Governments of the Federative Republic of Brazil and the Eastern Republic of Uruguay, apensed by copy to the present Decree.

Art. 2º This Decree takes effect on the date of its publication.

Economic Supplementation Agreement No. 2 concluded between the Federative Republic of Brazil and the Eastern Republic of Uruguay

Quadrageth Fifth Additional Protocol

The Plenipotentiaries of the Federative Republic of Brazil and the Eastern Republic of Uruguay, accredited by their respective Governments second powers that were bestowed in good and due form, deposited opportunely at the General Secretariat of the Latin American Association of Integration (ALADI),

Concome in

Article 1º The Federative Republic of Brazil outorts to the Eastern Republic of Uruguay, for the period 1º from June 2001 to 30 of June 2001, a quota of one thousand and eighty four units of automotive vehicles, ranked in the NALADI/SH 87.02, 87.03 and 87.04 positions, for any category.

Article 2º The Eastern Republic of Uruguay outward to the Federative Republic of Brazil, for the period 1º from June 2001 to June 30, 2001, a quota of three hundred and thirty-four units of automotive vehicles, ranked in the NALADI/SH 87.03 and 87.04 positions, for units up to 4,000 kg of total gross weight.

Article 3º The units of automotive vehicles, constants of the quotas bestowed by the Federative Republic of Brazil and the Eastern Republic of Uruguay on the Twenty-Seventh, Twentieth Nono, Twenty-Nono Thirtieth, Thirtieth First, Thirtieth Second, Thirtieth Third, Thirtieth Fifth, Thirtieth Seventh, Thirtieth Ninth, Quadragtieth First and Quadragtieth Third Additional Protocols, which were not used in the period of 1º January 2000 by May 31, 2001, they may be availed in the period from 1º to June 2001 to June 30, 2001, without prejudice to the quotas set out in Articles 1º and 2º of this Protocol.

Article 4º Fixed as a standard of origin 60/40% for the models in production and 55/45% for the new models.

Article 5º The percentage of regional source parts applicable to the models in production, under Article 4º of the Seventeenth Additional Protocol to ACE No. 2, will of 25%.

Article 6º The present Protocol shall be in force since 1º from June 2001 to June 30, 2001.

The General Secretariat of ALADI shall be depositary of this Protocol, of which it shall send copies duly authenticated to the signatory Governments.

In faith of what, the respective Plenipotentiaries sign the present Protocol in the city of Montevideo, at the thirty one days of the month of May two thousand and one, in an original in the languages Portuguese and Spanish, being both texts being equally valid.
