DECREE NO. 4,974, OF January 30, 2004.

Disposes on the execution of the Thirtieth Eighth Protocol Additional to the Economic Supplementation Agreement No. 35, between the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, in the condition of States Parties to MERCOSUR, and the Republic of Chile, of July 9, 2003.

THE VICE PRESIDENT OF THE REPUBLIC, in the exercise of the post of President of the Republic, using the assignment that gives him the art. 84, inciso IV, of the Constitution,

Whereas the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), signed by Brazil on August 12, 1980 and approved by the Congress National, by means of the Legislative Decree No. 66 of November 16, 1981, provides for the modality of Economic Supplementation Agreement;

Whereas the Plenipotentiaries of the Federative Republic of Brazil, of the Republic Argentina, the Republic of Paraguay and the Eastern Republic of Uruguay, in the condition of States Parties to MERCOSUR, and the Republic of Chile, on the basis of the Treaty of Montevideo of 1980, signed, in Montevideo, on June 25, 1996, the Agreement of Economic Complementation No. 35, between the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, in the condition of States Parties to MERCOSUR, and the Republic of Chile, incorporated into the the Brazilian domestic law by the Decree No. 96 of September 12, 1996;

Whereas the Plenipotentiaries of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Republic Eastern Uruguay, in the condition of States Parties to MERCOSUR, and the Republic of Chile, based on the Treaty of Montevideo of 1980, signed, in Montevideo, on July 9, 2003, the Thirtieth Eighth Protocol Additional to the Complementation Agreement Economic No. 35, between the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, in the condition of States Parties to MERCOSUR, and the Republic of Chile;

DECRETA:

Art. 1º The Thirty-eighth Additional Protocol to the Economic Supplementation Agreement No. 35, between the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, in the condition of States Parties to MERCOSUR, and the Republic of Chile, apensed by copy to the present Decree, will be executed and fulfilled as entirely as it contains.

Art. 2º This Decree takes effect on the date of its publication.

ECONOMIC SUPPLEMENTATION AGREEMENT N ° 35 CONCLUDED BETWEEN THE GOVERNMENTS OF THE STATES PARTIES OF MERCOSUR AND THE GOVERNMENT OF THE REPUBLIC OF THE CHILE

Thirty-eighth Additional Protocol

The Plenipotentiaries of the Argentine Republic, the Federative Republic of Brazil, the Republic of Paraguay and the Eastern Republic of Uruguay, in their condition of states Parts of the Southern Common Market (MERCOSUR), on the one hand, and of the Republic of Chile, on the other, accredited by their respective Governments second powers that were bestowed in good and due form, deposited opportunely at the General Secretariat of the Latin American Integration Association (ALADI),

HAVING IN VIEW the MCS-CH Resolution No. 02/2003,

DECK IN:

Article 1º Amend the terms in which it is expressed the quota of the preference outored by Brazil to Chile, in Annex II of the Thirtieth Additional Protocol to ACE 35, for the item NALADI/SH 2008.70.10 "peaches in water with added sugar or other sweetener, or in syrup", replacing the expression " annual quota for boxes of 24 lattices of 850 grams "by the following:

" Annual quota equivalent to boxes of 24 cans of 850 grams in any container format "

Article 2º-This Protocol will enter into force bilaterally on the date in which the Federative Republic of Brazil and the Republic of Chile have incorporated it into their domestic law, pursuant to their respective legislations.

The signatory parties shall communicate to the General Secretariat of the ALADI the fulfillment of the corresponding trames.

The General Secretariat of the Association shall be a depositary of this Protocol, of which it shall send copies duly authenticated to the signatory Governments.

IN FÉ THAN, THE RESPECTIVE PLENIPOTENTIARIES SIGN the present Protocol in the city of Montevideo, at the nine days of the month of July two thousand and three, in an original in the languages Spanish and Portuguese, being both texts being equally valid.
