DECREE NO. 4,354, OF September 2, 2002

Promulgate the Agreement between the Government of the Federative Republic of the Brazil and the Government of the Republic of Hungary on Technical Cooperation and Sanitary Procedures in the Veterinary and Public Health Areas, celebrated in Brasilia, on November 10, 1999.

THE PRESIDENT OF THE FEDERAL SUPREME COURT, in the exercise of the post of PRESIDENT OF THE REPUBLIC, using the assignment that confers him the art. 84, inciso VIII, of the Constitution,

Considering that the Government of the Federative Republic of the Brazil and the Government of the Republic of Hungary concluded, in Brasilia, on November 10, 1999, an Agreement on Technical Cooperation and Sanitary Procedures in the Veterinary and Public Health Areas Of Animal;

Whereas the National Congress passed this Agreement through the Legislative Decree No. 123, June 14 of 2002;

Considering that the Agreement entered into force on August 22, 2002;

D E C R E T A:

Art. 1º The Agreement between the Government of the Federative Republic of Brazil and the Government of the Republic of Hungary on Technical Cooperation and Sanitary Procedures in the Veterinary and Public Health Areas, celebrated in Brasilia, on November 10, 1999, apensed by copy to the present Decree, will be executed and fulfilled as entirely as in it se contains.

Art. 2º They are subject to the approval of the National Congress any acts that may result in revision of the said Agreement, as well as any further adjustments that, pursuant to the inciso I, from art. 49 of the Federal Constitution, carries charges or gravy commitments to the national heritage.

Art. 3º This Decree comes into effect on the date of its publication.

Agreement between the Government of the Federative Republic of Brazil and the Government of the Republic of Hungary on Technical Cooperation and Sanitary Procedures in the Veterinary and Public Health Areas

The Government of the Republic of Hungary

(henceforth named?Contracting Parties?),

Guided by the desire to cooperate in the veterinary and health areas animal public with views to the protection of life and human health and control of the diffusion of infectious diseases of animals;

Recognizing the importance of strengthening, expanding, and diversifying the trade of animals and products of animal origin between both countries on mutually beneficial bases;

Recognizing still the mutual benefits advinds from the increment of technical cooperation in the fields veterinarian and animal public health;

Considering the rights and obligations of both Contracting Parties to the Agreement on the Application of Sanitary and Phytosanitary Measures of the World Trade Organization, as well as the links and participation of both Contracting Parties to the relevant international organizations, including the Commission of the Codex Alimentarius and the International Office of Epizootics,

Wake up the next:

Article I

The competent health authorities for the purposes of this Agreement will be:

a) by the Federative Republic of Brazil, the Agropecuary Defense Secretariat of the Ministry of Agriculture and of the Supply;

b) by the Republic of Hungary, the Department of Animal Health and Control of Food from the Ministry of Agriculture and Regional Development.

Article II

In order to prevent the introduction of contagious or infectious animal diseases and from products of origin animal harmful to animal health in its territories, the Contracting Parties undertake to collaborate in the field of the export of live animals, products of animal origin and other objects that may be carriers of pathogen agents.

Article III

The Contracting Parties commit themselves to:

a) inform each other, without delay, about the identification of animal diseases included in the "A" List of the International Office of Animal Health International Office of the International Office of Epizootias (OIE);

b) this information, to be provided until the complete deletion of the disease, must include the species and the number of affected animals, the location of the disease, identification and the method of diagnosing and controlling the disease. In the case of foot-and-mouth disease, the type of isolated virus should also be indicated;

c) by solicitation, to inform one another about the occurrences of infectious diseases included in the "B" List of the International Animal Health Code of the International Office of Epizootics (OIE).

2. If any of the diseases referred to in paragraph 1, (a) occur in the territory of one of the Contracting Parties, the Contracting Parties shall collaborate with each other on the etiological diagnosis and, upon request, shall reciprocally provide the culture of the agent pathogen isolated.

3. The competent authorities of the Contracting Parties shall regularly exchange among themselves their monthly reports on the situation, in their respective national territories of infectious diseases of animals.

Article IV

In order to protect the health of the flocks, the competent authorities of the Contracting Parties shall inform one another about the practical application of up-to-date veterinary techniques that ensure the prevention of occurrences of infectious and parasitic diseases and other animal diseases.

Article V

With views the development of collaboration in the veterinary sector, as well as to increase the efficiency of scientific research in the two countries, the Contracting Parties undertake to:

a) promote the collaboration of scientific veterinary diagnostic institutions;

b) promote the exchange of technical journals and other publications of veterinary interest;

c) exchange legal documents and regulations, as well as information regarding changes in structures organizationof its veterinary sectors;

d) offer support for the participation of experts from both the Contracting Parties in meetings and technical programmes, on which they will inform each other.

Article VI

The problems that come to arise in the implementation of the provisions of this Agreement will be resolved by diplomatic means.

Article VII

The expenses, inclusive of international and domestic and maintenance trips, of delegations and individuals for the development of activities under the gift will be paid by the Contracting Party that sends them.

Article VIII

The present Agreement may be amended by mutual consent of the Contracting Parties, in writing.

Article IX

1. This Agreement shall enter into force 30 (thirty) days after the date of receipt of the second Note that communicates the fulfilment of the respective internal legal formalities for the entry into force of this Agreement and shall be effective for a period of 5 (five) years.

2. This Agreement may be denounced by diplomatic means. Your termination will take effect 6 (six) months after the date of the respective written notification.

Made in Brasilia, on November 10, 1999, in two exemplars, in the Portuguese, Hungarian and English languages, all texts being equally authentic. In the event of a controversy in the interpretation of this Agreement, the English version should prevail.
