DECREE OF April 14, 2004

Declares of social interest, for the purposes of agrarian reform, the rural real estate it mentions, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2º of the Supplemental Act No. 76, of July 6, 1993, 18 and 20 of Law No. 4,504 of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993,

DECRETA:

Art. 1º Ficam declared of social interest, for purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of Law No. 4,504, of November 30, 1964, and 2º of Law No. 8,629, of February 25, 1993, the following rural real estate:

I-" Sale Chumbados, Serra Negra e Mendanha ", with area of three thousand, three hundred and seventy and three hectares and sixteen airs, situated in the Municipality of Goianesia, object of the Records in the R-2-3.472, Ficha 01, Book 2; R-2-3.473, Ficha 01, Book 2 and R-2-6.245, Ficha 01, Book 2, of the Carthorium of Registration of Real estate of the Comarch of Goianesia, State of Goiás (Process INCRA/SR-04/no 54150.001169 /2002-62);

II-"Barrier Funda", with area of a thousand, three hundred and thirty-three hectares, situated in the Municipality of Palmeiras, object of the Registry in the R-1-267, fls. 15, Book 2-C, of the Office of the 1st Offer of the Comarch of Palmeiras, State of the Piauí (Case INCRA/SR-24/no 54380.002018 /2002-18);

III-"Açude New"-part, with area of two thousand, nine hundred and thirty-five hectares, forty-seven airs and thirty-eight centiars, situated in the Municipality of Passage Franca, object of the Records in the R-13-763, fls. 231, Book 2-D; R-9-260, fls. 260, Book 2; R-8-224, fls. 224, Book 2; R-9-764, fls. 140, Book 2-E; R-5-1.238, fls. 94, Book 2-E; R-8-515, fls. 115, Book 2-B; R-5-778, fls. 164, Book 2-C and R-7-815, fls. 184, Book 2-C, from the Carthorium of the 1st Oftice of the Comarch of Elesbao Veloso, State of the Piauí (Process INCRA/SR-24/no 54380.001134 /2003-09);

IV-"Fazenda Zumbi", with area of three hundred and eighty and two hectares, sixty and six airs and twenty-five centiars, situated in the Municipality of Tobias Barreto, object of the Records in the R-1-2.640, fls. 66, Book 2-R and R-6-747, fls. 58, Book 2-B, of the Estate Registration Office of the Comarch of Tobias Barreto, State of Sergipe (Case INCRA/SR-23/no 54370.000396 /2003-67); and

V-"Fazenda São Cristóvain", with area of a thousand and nine hectares and eighty ares, situated in the Municipalities of Carira and Our Lady of Glory, object of the Registry in the R-7-2.023, fls. 269, Book 2-AD, of the Estate Registration Office of the Comarch of Our Lady of Glory, State of Sergipe (Case INCRA/SR-23/no 54370.000109 /2003-19).

Art. 2º Excludes from the effects of this Decree os semovens, agricultural machinery and implements, as well as existing benfeits in the real estate referred to in art. 1º and belonging to those who will be benefited from their targeting.

Art. 3º The National Institute of Colonization and Agrarian Reform-INCRA is allowed to promote the dispropriations of rural real estate from which treats this Decree, in the form provided for in the Supplementary Act No. 76 of July 6, 1993, and to keep the areas of Legal Reserve and permanent preservation provided for in Law No. 4,771 of September 15, 1965, preferentially in single gleba, so as to reconciling the settlement with the preservation of the environment.

Art. 4º This Decree comes into force on the date of its publication.
