DECREE NO. 6,199, OF August 28, 2007.

Approves the Regimental Structure and the Demonstrative Table of the Cargos in Commission and of the Gratified Functions of the Oversight of Amazonian Development-SUDAM, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that gives him the art. 84, incisments IV and VI, paragraph (a) of the Constitution, and with a view to the provisions of the Supplementary Act no 124, of January 3, 2007,

DECRETA:

Art. 1st For the installation of the Oversight of the Amazonian Development-SUDAM and the beginning of its activities, stay approved of its Regimental Structure and the Demonstrative Framework of the Cargos in Commission and Gratified Functions, in the form of the Annexes I and II.

Art. 2nd In due to the provisions of the art. 1st, stay remanded, in the form of Annex III, the following posts in Commission of the Group-Direction and Superiors Superiors-DAS and Gratified Functions-FG:

I-from the extinct Amazonian Development Agency-ADA, to the Management Office, of the Ministry of Planning, Budget and Management: a DAS 101.6; three DAS 101.5; nine DAS 101.4; twenty DAS 101.3; one of DAS 102.2; sixteen DAS 102.1; ten FG-1; and ten FG-2; and

II- of the Office of Management, the Ministry of Planning, Budget and Management, for SUDAM: a DAS 101.6; four DAS 101.5; seventeen DAS 101.4; twenty-two DAS 101.3; one DAS 101.2; fifteen DAS 101.1; one DAS 102.4; seven DAS 102.3; twenty-three DAS 102.2; twelve DAS 102.1; and twenty-seven FG-1.

Art. 3rd The Superintendent of SUDAM will do publish in the Official Journal of the Union, within thirty days, counted from the date of publication of this Decree, nominal relation of the holders of the posts in committee of the Group-Direction and Superiors of Superiors-DAS referred to in Annex II, indicating, inclusive, the number of vacant positions, their denomination and their respective level.

Art. 4th O internal regiment of SUDAM shall be approved by the Colegiated Board and published in the Official Journal of the Union, within ninety days, counted from the date of publication of this Decree.

Art. 5th The holders of the sectoral Ministries should provide information in relation to the programs and actions under its responsibility, in the actuation area of SUDAM, to viabilize the drafting of the annual report on compliance with the plans, action guidelines and proposals for federal public policies, with views to subsidize the bill's appreciation budget of the Union by the National Congress.

Single paragraph. The information that it treats the caput should be presented as the methodologies to be established of common agreement between the central body of the Federal Planning and Budget System, the Ministry of National Integration and the SUDAM, objecting to the alignment with the model management of the multiannual plan and with the National Regional Development Policy-PNDR.

Art. 6th As of the date of publication of this Decree, they go on to constitute patrimony of SUDAM the goods and rights of ADA.

Art. 7th The servers that were transferred to the Ministry of Planning, Budget, and Management by force of the art. 21, § 4th, of the Provisional Measure no 2.157-5, of August 24, 2001, as well as those booked in the ADA may be redistributed to the Permanent Staff Framework of SUDAM under the art. 37 of the Law no 8,112, of December 11, 1990.

Single paragraph. The administration and payment of inactive and pensioner from ADA will be the responsibility of SUDAM.

Art. 8th At the installation meeting of the Deliberative Council of SUDAM, the proposed internal regiment of the Colegiaved internal regiment will be initiated, which is to be approved up to the second meeting.

Art. 9th ADA becomes extinct from the date of publication of this Decree.

Art. 10. This Decree comes into effect on the date of its publication.

Art. 11. It is revoked the Decree no 4,652, of March 27, 2003.

ANNEX I

STRUCTURE SUPERINTENDENCY REGIMENTAL

OF THE DEVELOPMENT OF THE AMAZON-SUDAM

CHAPTER I

OF NATURE, HEADQUARTERS, PURPOSE AND COMPETENCE

Art. 1st The Superintendence of Amazonian Development-SUDAM, created by the Supplemental Act no 124, of January 3, 2007, municipality of nature special, administrative and financially autonomous, integral to the Federal Planning and Budget System, linked to the Ministry of National Integration, based in the city of Bethlehem, in the State of Pará, has for the purpose of promoting the inclusive and sustainable development of its area of acting and the competitive integration of the regional productive base in the national and international economy and, as competences:

I-define economic and social goals and goals that lead to the sustainable development of your area of acting;

II-formulate plans and propose guidelines for the development of its area of acting, in line with the National Regional Development Policy-PNDR, articulating them with national, state and local plans;

III-propose guidelines for defining the regionalization of Industrial, Technological and Technological Policy Foreign trade-PITCE, which consider the potentialities and specificities of their area of acting;

IV-articular and propose programs and actions before the sectoral ministries for regional development, with emphasis on the priority character and strategic, of supra-state or sub-regional nature;

V- articulate the actions of the public bodies and foster the cooperation of the representative social forces in their area of acting, so as to ensure the fulfillment of the goals and targets of which it treats inciso I;

VI-acting, as an agent of the Federal Planning and Budget System, to promote the regional differentiation of national public policies and the observance of the § § 1st and 7th of the art. 165 of the Constitution;

VII-in the terms of the inciso VI, in articulation with the Ministry of National Integration, advise the Ministry of Planning, Budget and Management in the drafting of the multiannual plan, the budget guideline law and the General Budget of the Union, in relation to the projects and activities envisaged in the your area of acting;

VIII-support, in complementary character, public and private investments in the areas of economic and social infrastructure, empowerment of human resources, innovation and technological diffusion, social and cultural policies and sub-regional development initiatives;

IX-stimulate, by means of the administration of incentives and tax benefits, the investments private priority, productive activities and sub-regional development initiatives in their area of acting, as per the definition of the Deliberative Council, in line with the § 2nd art. 43 of the Constitution and in the form of the current legislation;

X-coordinate extension programs and rural management, international technical and financial assistance, in their area of acting;

XI-stimulate the achievement of patents and to coinhibit that biodiversity heritage is researched, appropriate and patented at the expense of the interests of the region and of the Country;

XII-propose, in articulation with the Ministries relevant, priorities and criteria for the application of the resources of development funds and sectoral funds in their area of acting, in particular those linked to scientific and technological development; and

XIII-promoting economic, social, and cultural development and environmental protection of the Amazonia, through the adoption of differentiated policies for the sub-regions.

Art. 2nd The acting area of SUDAM covers the States of the Acre, Amapá, Amazonas, Mato Grosso, Rondônia, Roraima, Tocantins, Pará and Maranhão in its portion west of the 44th Meridian.

Paragraph single. States and Municipalities created by dismemberment of the states and municipal by-laws situated in the area referred to in the caput will automatically be considered as integral to the SUDAM's acting area.

CHAPTER II

OF THE ORGANIZATIONAL STRUCTURE

Art. 3rd A SUDAM has the following organizational structure:

I-collegiated bodies:

a) Deliberative Council, which will contest with Secretariat-Executive; and

b) Directoria Colegiada;

II-bodies of direct and immediate assistance to the Superintendent:

a) Cabinet;

b) Advisory of Social Communication and Institutional Marketing;

c) Advisory of Institutional Management;

d) Technical Support Advising to the Colegals; and

e) Coordination of Civil Defense;

III-sectional organs:

a) Attorney General, linked to the Federal Attorney General;

b) Auditoria-Geral;

c) Ouvidoria; and

d) Direction of Administration;

IV-singular specific organs:

a) Directorate of Planning and Policy Articulation;

b) Directorate of Funds Management and Incentives and Attraction of Investments; and

c) Directorate for Promotion of Sustainable Development; and

V-decentralized organ: Representation Office in Brasilia.

CHAPTER III

OF THE DIRECTION AND APPOINTMENT

Art. 4th A SUDAM will be directed by a Colegiated Board made up of four directors and by the Superintendent, who will chair it.

§ First The Colegiated Board will be appointed by the President of the Republic.

§ 2nd The Superintendent will designate one of the members of the Colegified Directorate to replace it in its absences and eventual impediments.

§ 3rd The Superintendent will assign the substitutes of the Directors, among the members of the Colegiada Board of Directors.

§ 4th The Chief Prosecutor, the Chief Auditor-in-Chief and the Ouvidor will be nominees in the form of the current legislation.

Art. 5th The Board Collegiate will meet with the presence of at least three members, among them the Superintendent, or his replacement, and will deliberate by a simple majority of votes.

Paragraph single. To Superintendent it is up to the quality vote.

CHAPTER IV

OF THE COLLEGIATED BODIES

Section I

From the Council Deliberative

Art. 6th Integrate the Deliberative Council of the SUDAM:

I-the governors of the states of the area of their acting;

II-the Ministers of State for National Integration, Finance and the Planning, Budget and Management;

III-six Ministers of State of the too many areas of acting of the executive branch;

IV-three mayors of Municipalities, of different states in the area of their acting, indicated by the Brazilian Association of Municipalities, by the Brazilian Confederation of Municipalities and by the National Municipal Front;

V-three representatives of the business class and their alternates, from different states in the area of its acting, indicated by the National Confederation of Agriculture, by the National Confederation of Commerce and the National Confederation of Industry;

VI-three representatives of the class of the workers and their alternates, from different states in the area of their performance, indicated by the Confederation National of Workers in Agriculture, by the National Confederation of Workers in Trade and by the National Confederation of Workers in the Industry;

VII-your Superintendent; and

VIII-the President of the Bank of Amazonia S.A. -BASA.

§ First The Deliberative Council will be chaired by the Minister of State of National Integration.

§ 2nd The President of the Republic will chair the meetings of which to participate.

§ 3rd The representatives and respective alternates of which treat the incisos IV, V and VI will remain in the function for up to one year and will be indicated, alternately, observed the rotation criterion and the alphabetical order of the Federation's units that integrate the acting area of SUDAM and designated by the Minister of State for National Integration.

§ 4th It is incumbent upon the President of the Deliberative Council, depending on the tariff, to define the Ministers of State to which the inciso III refers.

§ 5th State governors, when absent, will only be able to be replaced by the respective deputy governors, the Ministers of State, by the Secretaries-Executives of the respective Ministries, and the mayors, by the vice-mayors.

§ 6th The leaders of the federal entities mentioned in the incisors VII and VIII, when absent, will only be able to be replaced by another member of the board.

§ 7th Powers will still be invited to participate in Council meetings, without voting rights, leaders of other bodies, entities and companies of the public administration.

§ 8th The Executive Secretariat of the Deliberative Council, whose organization and operation will constarve from the internal Regiment of the Colegiate, shall be directed by the Superintendent of SUDAM, and shall have as assignments the forwarding of the decisions submitted to the Colegiate and the monitoring of the resolutions of the Council.

§ 9th O Deliberative Council will meet quarterly, or whenever convened by its chairmanship, upon proposal of the Colegiated Directorate, by pauping itself by internal regiment to be approved by the Colegified.

§ 10. In the first quarter of each financial year, special meeting will be held to evaluate the implementation of the regional development plan in the previous financial year and to approve the schedule of plan activities in the current exercise.

§ 11. The President of the Republic will preside over the special meeting of the Council that it treats § 10.

CHAPTER V

DAS COMPETENCES OF THE ORGANS

Section I

From the Deliberative Council

Art. 7th To the Deliberative Council competes:

I-approve your internal regiment;

II-establish the action guidelines for the development of the actuation area of SUDAM;

III-propose to the President of the Republic, in articulation with the Ministry of Integration National, anteproject of law that will institute the regional development plan of the Amazon and the regional development programs to be forwarded to the National Congress, for appreciation and deliberation;

IV-follow and evaluate the execution of the plan and regional Amazonian programs and determine the measures of adjustments necessary to meet the objectives, guidelines and targets of the Amazon regional development plan;

V-approve the annual reports, presented by SUDAM, on compliance with the regional development plan of the Amazon, for forwarding to the mixed commission referred to in § 1st Art. 166 of the Constitution and the remaining pertinent thematic commissions of the National Congress, obeyed the same forwarding deadline of the Union budget law project;

VI-creating committees, permanent or provisional, fixing, in the act of creation, its composition and your competencies, as well as extinguish committees by it created;

VII- approve, annually, report submitted by the Colegiada Directorate, with the evaluation of the Federal Government's programmes and actions in the area of performance of SUDAM, forwarding it to the joint standing committee of which it treats art. 166, § 1st, the Constitution and the remaining pertinent thematic committees of the National Congress, at the same deadline of forwarding the Union budget bill;

VIII-propose, in articulation with the competent Ministries, the priorities and criteria of application of the resources of development funds and sectoral funds in the area of actuation of SUDAM, in particular those linked to scientific and technological development;

IX-define, in the area of actuation of SUDAM, the priority private investments, the productive activities and sub-regional development initiatives, the subject of stimulus through the administration of incentives and tax and financial benefits, in the form of the current legislation;

X-approve the modalities of operations that will be supported by the funds managed by the SUDAM;

XI-approve the regulation of incentives and benefits fiscal and financial-administered by SUDAM;

XII-in relation to the Northern Financing Constitutional Fund-FNO:

a) to establish annually, by August 15, the guidelines and priorities for application of resources in the following financial year, observed the guidelines and general guidelines of the Ministry of National Integration and in line with the regional plan of development of the Amazon;

b) approve the modalities of operations that will be supported;

c) define the infrastructure ventures economic considered priority for the regional economy;

d) evaluate the results obtained and determine the measures of adjustments necessary to comply with the established guidelines, approved funding programs and the adequacy of financing to regional priorities;

and) approve annually, until December 15, the proposal for funding programming for the following financial year, which should be accompanied by advice from SUDAM and the Ministry of National Integration;

f) forwarding the funding schedule referred to in point? e?, from which the individual ceilings of funding, among others, are stated elements, together with the result of the consideration of the proposed programming proposals, and the opinion which subsided the approval referred to in the aforementioned paragraph? e?, to the joint standing committee of which it treats the art. 166, § 1st, of the Constitution; and

g) appreciate and refer to the committee permanent mixed of which treats art. 166, § 1st, of the Constitution, the reports of which it treats art. 20 of the Act No 7,827 of September 27, 1989 on the activities developed and the results obtained, accompanied by the accounting statements, duly audited;

XIII-in relation to the Amazonian Development Fund-FDA:

a) establish, annually, the guidelines and priorities for the applications of resources in the subsequent exercise, observed the general guidelines and guidelines established by the Ministry of National Integration, in financing the ventures of great relevance to the regional economy;

b) approve the modalities of operations that will be supported;

c) define the criteria for the establishment of counterpart of the states and the Municipalities in the investments;

d) approve regulation that it has on the participation of the FDA in the investment projects; and

and) define the criteria for the application of resources earmarked for the costing of activities in research, development and technology of interest of regional development, corresponding to an integer and five tenths per cent, calculated on the amount of each installment released by the FDA; and

XIV-articulate with the House of National Integration and Regional Development Policies for presentation of the regional development plan of the Amazon, pursuant to art. 5th of the Decree no 6,047, of February 22, 2007.

Section II

From the Colegiated Directorate

Art. 8th À Directoria Colegiada competes:

I-attend the Deliberative Council, suing it from the information, studies and projects that if it is necessary to the exercise of its attributions;

II-exercise the administration of SUDAM;

III-edit norms on competence subjects of SUDAM;

IV-approve of the internal regiment of SUDAM;

V-comply and enforce the guidelines and proposals approved by the Council Deliberative;

VI-study and propose guidelines for the development of the region, consolidating the proposals in the regional development plan of the Amazon, with targets and objective indicators for evaluation and follow-up, of common agreement with the Ministry of National Integration;

VII-forward to SUDAM's budget proposal to the Ministry of Integration National;

VIII-draw up annual assessment report of the action federal in the area of actuation of SUDAM, heard the Ministry of National Integration, sending it to the mixed commission that it treats the § 1st art. 166 of the Constitution, and the thematic commissions of both the Houses of the National Congress, after consideration of the Deliberative Council, obeyed the same forwarding deadline of the Union budget law project;

IX-forward the management reports and the accounting demonstratives of SUDAM to the organs competent;

X-authorize the disclosure of reports on the activities of SUDAM;

XI-decide on the sale, assignment or rental of integral goods of SUDAM's heritage;

XII-notify and apply the penalties provided for in the legislation;

XIII-know and judge requests of reconsideration of decisions by members of the Board;

XIV- forward, for approval of the Deliberative Council, proposal of internal regiment of that Council;

XV-approve carts-consultations, investment projects, conclude contracts with the operators' operators and carry out the remaining management acts concerning the FDA;

XVI-draw up the proposals of the regional plan of development of the Amazon and the respective bybill of law, to be forwarded to the Deliberative Council;

XVII-approve the constitutive lauds, the opinions, the declarations and congenic documents and carry out other necessary management acts to the administration of incentives and tax and financial benefits;

XVIII-approve the Annual Plan of Internal Audit Activities-PAINT for the subsequent exercise; and

XIX-exercise other competencies established in the internal regiment.

§ First decisions related to the institutional competencies of SUDAM will be taken by the Colegified Directorate.

§ 2nd While not dispend of technical qualification for the analysis of feasibility economic-financial and the risk of the FDA's projects and resource borrowers, as predicted in the inciso XV, SUDAM will firm up contract or convenium with official federal financial institution, pursuant to the Decree no 4,254, of May 31, 2002.

§ 3rd Act of the Head of the Executive Power will recognize, upon proposal of the Minister of State for National Integration, the qualification of SUDAM for the exercise of the competence of which it treats the § 2nd.

Section III

Dos Direct and Immediate Assistance organs to the Superintendent

Art. 9th To the Cabinet competes:

I-watch the Superintendent in his political and social representation;

II-coordinate the planning and the elaboration of the Tariff of dispatches and hearings of the Superintendent;

III-support the realization of SUDAM events with representations and regional, national and international authorities;

IV-follow up on the plotting of SUDAM's projects of interest in the National Congress and subsidize the Superintendent in listening to the queries and requirements formulated by parliamentarians;

V-support the Superintendent in the follow-up to the implementation of the annual action plan of the municipality; and

VI-exercise other competencies established in the internal regiment.

Art. 10. To the Advisory of Social Communication and Institutional Marketing competes:

I-plan, coordinate and execute the social communication activities of SUDAM, in consonance with the guidelines set out by the Social Communication Registry of the Presidency of the Republic;

II-program, coordinate, and administer advertising campaigns, noted the provisions of the art. 37, § 1st, of the Constitution;

III-provide for the official publication and the disclosure of the subjects related to the performance area of SUDAM;

IV-promote the dissemination of events, institutional services, and action instruments of SUDAM;

V-reception and follow up media professionals in SUDAM; and

VI-exercise other competencies established in the internal regiment.

Art. 11. To the Institutional Management Advisory competes:

I-coordinate the processes of elaboration, implementation, monitoring and evaluation concerningthe institutional planning of SUDAM;

II-plan, coordinate, and evaluate the execution of the organizational development activities within SUDAM;

III-accompany and evaluate the fulfillment of the institutional functions affected to SUDAM;

IV-elaboration of institutional management reports;

V-check, beforehand formalization of the acts, the conformity of procedures related to the management of the funds, incentives, tax and financial benefits, arrangements and contracts;

VI-plan, coordinate, and supervise the execution of the activities related to the federal planning and budget system, in what couber;

VII-elaboration, in conjunction with the Ministry of National Integration and with the remaining directorships, proposals for the Multiannual Plan, for the Budget Guidelines Act and for the General Budget of the Union, in relation to the projects and activities foreseen in the SUDAM's acting area; and

VIII-exercise other competencies established in the internal regiment.

Art. 12. To the Technical Support Advisory to the Colegiors competes:

I-support the Superintendent in his directing functions of the Executive Secretariat of the Deliberative Council;

II-perform and coordinate the activities of administrative, technical and institutional support to the collegiate bodies instituted within the framework of SUDAM;

III-scheduling the plenary meetings, board meetings and others, together with the interested units or bodies of SUDAM;

IV-coordinate, guide and follow up the acting of SUDAM's representation in collegial bodies and in technical encounters;

V-elaboration, for appreciation of the Colegiated Directorate, the calendar of meetings of the collegiate bodies;

VI-elaboration, for appreciation of the Colegiated Directorate, proposal of internal regiment of collegiated in the framework of SUDAM;

VII-elaboration, for appreciation of the Collegiate Board, proposals for setting up committees and standards of organizing and functioning of collegians in the framework of SUDAM; and

VIII-exercise other competencies established in the internal regiment.

Section IV

From the Sectional Organs

Art. 13. To the Attorney General, in the capacity of the executor organ of the Federal Attorney General, compete:

I-represent judicial and extrajudicially the SUDAM;

II-ascertain the liquidity and certainty of the credits, of any nature, inherent in the activities of SUDAM, inscribing them in active debt, for the purposes of friendly or judicial collection;

III-exercise the activities of consulting and legal advising, applying, in what couber, the provisions of the art. 11 of the Supplementary Act no 73, of February 10, 1993;

IV- attend to the authorities in the internal control of the administrative legality of the acts to be practiced, including by examining in advance the texts of normative acts, the bidding editions, contracts and other acts of them arising, as well as the acts of dispensation and bidding inchargeability;

V-opiniont beforehand on the form of compliance with judicial decisions;

VI-represent to the Colegiada Board on legal order arrangements that should be adopted to cater to the public interest and the prevailing norms; and

VII-exercise other competencies established in the internal regiment.

Art. 14. The Auditoria-General competes:

I-proceed to internal control, scrutinizing and examining the results as to the economicity, effectiveness and efficiency of budget, financial, accounting, heritage and personnel management, as well as of the other administrative and operational systems of SUDAM;

II-advise the Colegiated Board for the fulfillment of the goals institutional of SUDAM, as a matter of priority, in the supervision and administrative internal control;

III-conduct audits and issue report on the physical and financial implementation and the results obtained in the application of the resources, concerning the programs, actions and tax incentives under the responsibility of the municipality;

IV-examine and issue opinion on the provision of annual accounts of the SUDAM;

V-formulate the standards and guidelines of the area of the Audit, in set with the other administrative units of SUDAM;

VI- follow up with the attention to the representations and the implementation of the recommendations of the bodies and units of the Internal Control System of the Federal Executive Power and the Court of Auditors of the Union;

VII-elaboration of PAINT;

VIII-evaluate the actuation of SUDAM, with views to the fulfillment of the policies, goals and projects established; and

IX-exercise other competencies established in the internal regiment.

Art. 15. À Ouvidoria competes:

I-analyze, giving the proper treatment, and forward to the competent areas the complaints, compliments, requests, suggestions and information received;

II-follow up and evaluate the arrangements adopted in relation to the information received;

III-offer direct, agile and impartial channels for the reception of information, suggestions and criticism from society, as well as from the internal public, in relation to SUDAM;

IV-analyze the relevance of complaints regarding inadequate provision of public services, recommending the introduction of administrative procedures for technical examination of the issues and the adoption of sane and preventive measures of faults and omissions of those responsible;

V-organizing and interpreting the set of the demonstrations received and produce indicators on the level of satisfaction of the users of the public services provided in the framework of the Federal Executive Power related to the institutional competences of SUDAM; and

VI-exercise other competencies established in the internal regiment.

Art. 16. To the Board of Directors competes:

I-plan, coordinate and to supervise the implementation of the activities related to the federal Human Resources, Budget, Financial Administration, Accounting, Information and Informatics, General Services and Archives systems within SUDAM;

II-plan, coordinate, and follow up the execution of the activities inherent in the management and information security in the framework of SUDAM;

III- plan, coordinate and follow up on the execution of the activities reaching the maintenance and conservation of the physical facilities, the bibliographic and documentary arrangements and the hiring for support of the administrative activities of SUDAM;

IV-elaboration, in articulation with the other directorships, the program of development of personnel for SUDAM's servers, including habilitation-oriented actions for the exercise of senior directing and advising positions; and

V-exercise other competencies established in the internal regiment.

Section V

Of The Organs Singular Specific

Art. 17. To the Directorate of Planning and Policy Articulation, compete:

I -articulate with public bodies and representative institutions of society the proposition of strategies, guidelines and priorities to guide the elaboration of plans, programs, and projects in the area of actuation of SUDAM;

II-articular with the Ministries of National Integration, Planning, Budget, and Management, of Development, Industry and Foreign Trade and Science and Technology the formulation of guidelines that promote the regional differentiation of federal policies, in particular the Industrial, Technological and Foreign Trade Policy;

III-propose, in articulation with the Ministry of National Integration and too much Ministries, programs and sectoral actions for regional development, with an emphasis on the priority and strategic character of supra-state or sub-regional nature;

IV-formulate plans and programs for the development of the SUDAM's acting area, considering the resources earmarked for regional development, in consonance with the PNDR and with the national, state and local plans running, the policies and guidelines of the Federal Government, for forwarding by the Colegiated Directorate and the Deliberative Council, so as to behave the Multiannual Plan, the Law of Budget Guidelines and the General Budget of the Union;

V-propose, in articulation with the Directorate for Promotion of Sustainable Development, programs and actions for the Amazon region, aimed at economic, social and cultural development and environmental protection;

VI-propose guidelines, targets and economic, social, environmental, and institutional indicators to subsidize the formulation of the regional Amazon development plan and the assessment of the impacts of the development actions of the SUDAM's acting area;

VII-follow up on implementation and assess the socio-economic impacts of national and regional promotion plans, programs and projects inclusive and sustainable development and investments in economic, technological and sociocultural infrastructure in the area of actuation of SUDAM;

VIII-elaborating studies and researches, systematizing and programming databases to subsidize the processes of formulation, monitoring, and evaluation of plans and programs;

IX-articular with national bodies and institutions and international programs for technical and financial cooperation and coordinate their implementation;

X-overseeing the realization of studies and proposals aimed at spatial planning;

XI-elaboration, following guidelines from the central body of the Planning and Budget System Federal, annual report on the evaluation of the programs and actions of the Federal Government, contemplating compliance with the plans, action guidelines and proposed federal public policy proposals aimed at the area of acting of SUDAM;

XII-elaboration, in conjunction with the Ministry of National Integration, with the Ministries setorials, with the federal bodies and entities present in the area of acting and in articulation with the state governments, the regional development plan of the Amazon and the anteproject of law that will institute it;

XIII-elaboration annual report on compliance with the regional development plan of the amazonia;

XIV-elaborated proposal, within the framework of FNO, to subsidize the Deliberative Council in defining the economic infrastructure ventures considered to be priority for the regional economy, in articulation with the Directorate of Fund Management and Incentives and Investment Attraction and with the Directorate of Promotion of Sustainable Development;

XV-elaboration, in articulation with the Ministry of Science and Technology, for consideration of the Deliberative Council, proposal of priorities and criteria for the application of the resources of the funds linked to scientific and technological development in the area of acting of the SUDAM;

XVI-elaboration, in articulation with the sectoral Ministries, for purposes of consideration of the Deliberative Council, proposal of priorities and criteria for the application of the resources of other development funds and of the sectoral funds in the area of actuation of SUDAM;

XVII-formulating proposals for guidelines and priorities for application of FDA resources, of the benefits and tax incentives and FNO, in line with the regional development plan of the Amazon and the guidelines of the Ministry of National Integration;

XVIII-propose to the Deliberative Council the criteria for the application of resources intended for the costing of activities in research, development and technology of interest of regional development, corresponding to a whole and five tenths per cent, calculated on the amount of each parcel released by the FDA;

XIX-administering the application of the features of which treats the inciso XVIII in specific projects related to research, development and technology of interest of regional development;

XX-disseminate priority knowledge for the promotion of inclusive and sustainable development in the region; and

XXI-exercise other competencies established in the internal regiment.

Art. 18. To the Directorate of Fund Management and Incentives and Investment Attraction competes:

I-analyze, in articulation with the Ministry of National Integration, the proposal for annual application programming of FNO resources, drawn up by the BASA;

II-evaluate, in articulation with the Ministry of National Integration, the semiannual reports presented by the administrator bank on the developed activities and the results obtained with the application of the resources of FNO;

III-evaluate, in articulation with the Ministry of National Integration, the activities developed and the results obtained with the application of the resources of the FDA and the tax and financial benefits and incentives;

IV- to propose, in articulation with the Ministry of National Integration, measures of adjustments for compliance with the guidelines, guidelines and priorities set by the Deliberative Council;

V-carry out the management acts related to tax and financial benefits and incentives, to FNO and to the FDA, inclusive of those arising from contracts with the operator agent;

VI-propose criteria for the establishment of counterpart of the states and Municipalities in the FDA investments;

VII-draw up proposal for regulation by disciplining the FDA's participation in investment projects;

VIII-carry out actions, articulated with the diverse entities, with vistas to attract and support investments in the area of actuation of SUDAM;

IX-promote, nos national and international markets, the opportunities for existing investments and business in the region;

X-analyze letters-queries and projects relative to the FDA;

XI-analyze and issue opinions related to the granting of tax and financial benefits and incentives;

XII-promote the dissemination of business opportunities and support actions that enable the national and international insertion of the products of the region;

XIII- drawing up proposal for a regulation of incentives and tax and financial benefits administered by SUDAM;

XIV-propose the definition, in the area of actuation of SUDAM, of the priority private investments, of the productive activities and of the initiatives of sub-regional development, stimulus object through the administration of incentives and tax and financial benefits;

XV-elaborating proposal of the FDA's modalities of operations that will be supported by SUDAM; and

XVI-exercise other competencies established in the internal regiment.

Art. 19. To the Directorate for Promotion of Sustainable Development competes:

I -to promote and articulate with local bodies and institutions the implementation of programs and actions aimed at economic, social, cultural development and environmental protection in the area of actuation of SUDAM;

II-spreading knowledge about the economic, sociocultural, technological potentials and environmental of the region;

III-supporting diffusion initiatives of priority knowledge for the promotion of inclusive and sustainable development in the region;

IV-supporting public and private investments in the area of actuation of SUDAM, aimed at the elaboration and implementation of capacity-building programs for management of sub-regional development projects;

V-support the implementation of preventive civil defense actions;

VI-promote actions aimed at the implementation and modernization of the social and economic infrastructure;

VII-promoting programs and actions of fostering and supporting scientific and technological development, innovation, and the patenting of technologies;

VIII-develop actions aimed at capturing other sources of funding for demand of local development and infrastructure;

IX-administrate the application of the resources of which it treats the inciso XVIII of the art. 17 in programs or projects of interest for regional development, aimed at the productive sector;

X-supporting the Ministry of National Integration in the implementation of regional development programs and actions in the area of actuation of SUDAM;

XI-promote and support actions of institutional strengthening and articulation of the organs and entities acting in the local development;

XII- elaborate, in articulation with the remaining Ministries, proposal of priorities and criteria for applying the resources of other funds, in the area of actuation of SUDAM;

XIII-overseeing and monitoring the implementation of multi-institutional programs and projects aimed at the conservation, preservation and recovery of the medium environment and the sustainable use of the natural resources of the region;

XIV- promote, in articulation with local bodies and institutions, actions to support micro and small enterprises and micro entrepreneurs; and

XV-exert other competencies established in the internal regiment.

Section VI

Of The organs Decentralized

Art. 20. The Representational Office in Brasilia competes to attend SUDAM in the institutional activities and joints with the National Congress and the organs of the federal public administration.

CHAPTER VI

DAS ATTRIBUTIONS OF THE LEADERS

Section I

Do Superintendent

Art. 21. The Superintendent is incumbent:

I-exercise the representation of the SUDAM;

II-comply and enforce the decisions of the Council Deliberative of SUDAM;

III-firming agreements, contracts and congeniums with national, foreign and international entities, previously authorized by the Colegiated Board;

IV-provide posts and functions, admit, requisition, dispense and practice the remaining acts of personnel administration;

V-submit to the Deliberative Council the subjects that depend on the appreciation or approval of that collegiate or of the committees by him created;

VI-order expenses and practice the necessary management acts within reach of the goals of SUDAM;

VII-approve editions of tenders and homologate awardees;

VIII-forwarding to the Ministry of National Integration the budget proposal of SUDAM;

IX-directing the Secretariat-Executive Board of the Deliberative Council; and

X-chairing the Colegiated Directorate and the committees that come up to be created by the Deliberative Council.

Section II

From the rest Leaders

Art. 22. To Directors, the Chief Prosecutor, the Auditor-in-Chief, the Ouvidor, the Coordinators-General and the remaining leaders is to plan, direct, coordinate and evaluate the execution of the activities of their respective units, as well as exercise others assignments that are committed to them by delegation of competence and by the internal regiment.

CHAPTER VII

DOS INSTRUMENTS OF ACTION

Art. 23. Are the action instruments of SUDAM:

I-the regional plan of development of the Amazon;

II-other regional plans of multi-annual and annual development, articulated with the federal, state, and local plans;

III-the Constitutional North Funding Fund-FNO;

IV-the Amazonian Development Fund-FDA;

V-the reduction of the tax on the income and additional non-restitution of which they treat the arts. 1st and the 2nd and the deposits for reinvestments referred to in art. 3rd, all of the Provisional Measure no 2.199-14, of August 24, 2001;

VI-the incentive of accelerated depreciation and discount of the contribution credits for the PIS/PASEP and COFINS of which it treats art. 31 of the Law no 11,196, of November 21, 2005;

VII-os Benefits of exemption from the Additional to the Freight for Renewal of the Merchant Navy-AFRMM and exemption from the Financial Operations Tax-IOF in the foreign exchange transactions carried out for payment of imported goods, provided for in the art. 4th of the Law no 9,808, of July 20, 1999; and

VIII-others programs of incentives and tax and financial benefits, in the form of the law and the Constitution.

CHAPTER VIII

DO HERITAGE AND REVENUE

Art. 24. Constitute revenue of SUDAM:

I-budget allocations consignments in the General Budget of the Union;

II-transfers from the FDA, equivalent to two percent of the value of each release of the resources;

III-fundraising of one percent of each share of resources released for reinvestment that treats § 2nd art. 19 of the Law no 8,167, of January 16, 1991;

IV-result of financial application of its resources;

V-the collection product of emoluments;

VI-revenues resulting from the divestment of goods and the application of heritage values, credit operations, appropriations, legacies and grants; and

VII-other revenue provided for in law.
