DECREE NO. 6,780, OF February 18, 2009.

Approves the National Civil Aviation Policy (PNAC) and gives other providences.

The PRESIDENT OF THE REPUBLIC, in the use of the attribution that confers him the art. 84, inciso VI, point (? a?, of the Constitution,

DECRETA:

Art. 1° It is approved the National Civil Aviation Policy (PNAC), formulated by the Aviation Council Civil (CONAC), appends to this Decree.

Art. 2o The Aviation Registry Ministry of Defence civil shall monitor the implementation of the PNAC by the organs and entities responsible for the management, regulation and surveillance of civil aviation, civil airport infrastructure and air navigation infrastructure civil linked to that Ministry.

Art. 3o This Decree comes into force on the date of its publication.

OF THE NATIONAL CIVIL AVIATION POLICY

1-INTRODUCTION

A National Civil Aviation Policy (PNAC) corresponds to the set of guidelines and strategies that will guide the planning of the institutions responsible for the development of Brazilian civil aviation, setting objectives and strategic actions for that sector, and integrates into the context of Brazilian national policies.

The main purpose of PNAC is to assure the Brazilian society the development of broad civil aviation system, safe, efficient, economical, modern, competitive, compatible with environmental sustainability, integrated to the other transport modalities and underpinned in the productive capacity and service provision in the national, South American and world areas.

It is up to highlight that civil aviation is the factor of integration and national development. One of the purposes of PNAC is therefore to characterize the importance of the development and increase of the availability of aeronautical and airport infrastructure, with a view to increasing the supply of air transport services. Such a condition will allow broadening of the availability of services, enabling, in this manner, increased welfare of Brazilian society, as well as greater integration of the Country in the international context, in the face of the exceptional importance of aviation for modern social and economic activities.

PNAC has as its premises the fundamentals, objectives and principles laid down in the Constitution and harmonize with the international conventions and treaties ratified by Brazil. It should be noted, therefore, that the observance of national legislation and the consideration of international civil aviation related standards and best practices is an indispensable commitment to good planning of activity. In the same way, the maintenance of an updated legal milestone and the surveillance of its compliance are essential requirements to the development of the Brazilian air sector.

The necessary resources and deadlines involved in the complex and interdependent productive, operational, technical, and administrative activities-fundamental to the success of the national aviation-, they claim the effective acting of the Brazilian state to coordinate, under the optics of the public interest, the performance of the various public and private bodies and entities. It is up to him to set the goals to be pursued, with a view to disciplining the choices, harmonizing the interdependent achievements and preventing disparities for the sake of greater joint efficiency.

The achievement of PNAC's goals demands interaction with international organizations, agreements with other countries and trade relations with foreign companies. Such activities underline the necessity of political acting of the Brazilian state in defending national interests.

Nthese terms, this paper reflects the political intentions of the Brazilian society for the development of the Civil Aviation System. It has, equally, the virtue of getting to every citizen, in an organized and systemic way, the goals and strategies applicable to the sector.

This paper composes a political part, which contemplates the objectives of PNAC; of a strategic part, where the strategic, general and specific actions, and of a final part are presented, in which the methodology of monitoring, evaluation and revision of PNAC is presented.

Finally, it emerges the importance that PNAC is observed by the federal, state and municipal governments, well as too much responsible for the development of civil aviation, so as to be implemented harmonic and coordinately by all.

2-GOALS

2.1.The SECURITY

The permanent goal that guides and enhances the actions of civil aviation is the security, being this, therefore, prerequisite for the functioning of the sector.

The concept of security comprises a permanent state of assurance of physical integrity and heritage of the users of the civil aviation system. Security covers OPERATIONAL SAFETY and PROTECTION AGAINST ILLICIT ACTS, which are permanent goals in civil aviation activities.

The actors of the system will act in a coordinated fashion, within their assignments, to to ensure the implementation of the highest practicable degree of safety in the proper provision of the public air transport service.

2.2.THE PROVISION OF THE APPROPRIATE SERVICE

The appropriate provision of the public air transport service regular by operators presupposes CONTINUITY, REGULARITY and PUNCTUALITY OF THE SERVICE, among others, without which it discharacterizes.

Concurrent to the guarantee of the provision of appropriate services the availability and the continuity of services provided by the providers of the aeronautical and civil airport infrastructure.

For the guarantee of continuity, regularity and punctuality of the service is required to establish measures that identify and eliminate the threats to these precepts and to respond swiftly and positively to natural, material or human factors that may disrupt the provision of the air transport service. The cooperation between organs and entities of public administration and the private sector should be encouraged so as to ensure the continuity, regularity and punctuality of the air transport service.

2.3.THE ENVIRONMENT PROTECTION

Minimize the detrimental effects of civil aviation on the medium environment is the duty of all, mainly of the organs, entities and persons bound for aviation, particularly with regard to noise and emission of gases from aircraft engines and impacts of the infrastructure. Stimulating the adoption of mechanisms aiming to mitigate such effects is action that is necessary for the protection of the environment.

Efforts should also be made in the sense of establishing or enforcomplying agreements with national and international bodies that contribute to the conservation and maintenance of the environment.

2.4.A CONSUMER PROTECTION

The fulfilment of the needs of consumers, respect to their dignity, health and safety, the protection of its economic interests, as well as the transparency and harmony of consumer relations, constitute itself in important milestone in the relations between consumers and suppliers of goods and services.

The peculiarities of civil aviation impose the need for self-standardization, which behold the prevailing principles in the Consumer Protection Code and ensure, clearly and properly, the user's rights of the air transport service, without that having to resort to the judicial route, with views to harmony in their relations with the providers of the public air transport service.

Thus, it is the duty of the State to ensure the existence of the necessary mechanisms to the protection of the consumer of the air transport service, in line with the precepts of the Constitution, the infraconstitutional legislation, the jurisprudence and the prevailing agreements.

2.5.The DEVELOPMENT OF CIVIL AVIATION

Few economic sectors cover set of activities as complex as those of civil aviation.

Tracts from sector marked by regulation (technical and economic) and intense oversight; capital intensive, skilled labour and cutting-edge technology; vulnerable to adverse weather and geographical conditions; network-structured; dependent on international agreements; extremely diversified as to the stage of business development; and supplier of goods and services of high specific value.

Diant of such complexity, the proper coordination of industry activities aeronautics, training of professionals at all its levels, civil airport infrastructure, civil aeronautical infrastructure and air services is a key task for the development of civil aviation Brazilian.

Measures such as the stimulus to the training and empowerment of professionals, to the opening up of companies of manufacturing and maintenance of aeronautical components, the broadening of supply of the civil aeronautical infrastructure, the growth of air transport, competitiveness and the drafting and maintenance of upgraded legal milestone, transparent and appropriate are to be, among others, object of specific public policies, but which keep from each other great correlation as to the goals to be collimated.

The Brazilian state should be able, therefore, to adequately predict the demand for goods and aeronautical services and to propitiate the conditions for the development of civil aviation to be done in a harmonic, balanced and appropriate manner. Such a condition becomes even more relevant in what tange the infrastructure necessary for the development of civil aviation.

Infrastructure provisioning, either by the Public Power or by private actors by means of of delegation, as laid out in the Constitution, shall provide for the development of air transport activities. There is to overcome the obices that prevent the growth of civil aviation in an orderly manner and in line with the national goals of integration and broadening access to service, so as to promote prosperity equitably.

2.6.The EFFICIENCY OF CIVIL AVIATION OPERATIONS

The efficiency of civil aviation operations benefits everyone and is a goal to be pursued. For so much, the enhancement of air navigation, the optimization of the use of airspace and civil airport infrastructure, in a coordinated and harmonic manner, and the improvement of management methods, processes and practices, must be continuously fetched.

The big beneficiary of technological advancements should be modern management and dynamic air traffic, capable of minimizing the limitations imposed on the user of the airspace. Without compromising security, the user should be able to adhere to his / her flight profile as planned and requested.

The Civil Aviation System should be able to keep track of the performance of its elements constitutive and to equip themselves in a manner compatible with the advances and innovations introduced in the system.

In the same sense, the regulatory milestone of civil aviation, in all its segments, should be drawn in a manner to seek greater economic efficiency, again without prejudice to the security and observed the strategic interests of the Country.

Getting greater economic efficiency allows for the broadening of social welfare and enables better allocation of productive resources. The efficient allocation of resources makes it possible to provide greater supply of air transport services, which, under the aegis of the appropriate regulatory instruments, results in the expansion of competition. The increased competition, in turn, by encouraging greater levels of quality and lower prices, acts towards aggregating new users to the air transport modal.

3-STRATEGIC actions

3.1.The SECURITY

General Actions

? To promote the permanent updating and improvement of the legislation, incorporating, when practicable, the standards and procedures and recommended practices, issued by the International Civil Aviation Organization (ICAO) or arising from others treaties, conventions and international acts, of which Brazil is a party.

? Broaden public awareness on prevention of aeronautical accidents and the protection against illicit acts.

? Ensure the improvement of safety by means of surveillance and constant improvement of operating standards.

? Promoting the improvement of safety through the constant improvement of actions and surveillance of maintaining operational standards, as well as the pursuit of achieving the goals and safety goals set.

? Enhancing the Brazilian security systems by integrating their premises and mechanisms to the planning of the sector's organs and entities.

? Ensure periodic realization of external audits, when programmed by OACI, and internal by organ recognized by the Brazilian government, aiming at the improvement of security mechanisms.

? Promote the training, empowerment and upgrading of professionals, so as to ensure the proper implementation of measures to the advantage of security.

? Enhancing protection against illicit acts in all links of the Civil Aviation System by designing proactive measures, taking into account the concepts of facilitation, mainly in what tange the application of new technologies to the processing of passengers, their baggage and air cargo.

Specific actions

Operational security

? Promote the updating of norms, standards, methods and procedures to ensure the management of operational security.

? Manage risk and deploy mitigating and supervising measures and continued surveillance of services.

? Conduct periodic audits by body recognized by the Brazilian government, to identify deficiencies and fix them.

? Promote the constant updating of the documentation on operational safety.

? Ensure operational safety, including accident prevention and aeronautical incidents, as a curriculum discipline in the training and capacity-building programs of Civil Aviation System professionals.

? Regularly scrutinize the airworthiness conditions, workshops and technical capacity-building of personnel.

? Promote integrated actions in the area of aeronautical certification and operational safety.

? To stimulate greater public awareness, through educational and promotional campaigns on operational safety.

? Act together with the competent authorities to adopt measures to reduce urban activities that constitute or come into being in potential bird-attraction hotbeds in the areas of influence of aerodromes.

? Stimulate coordination between the federal, state and municipal bodies aiming at compliance with the legislation dealing with the aerodromes protection zone, noises and air navigation aids.

? Ensure the coordination, control, enhancement and execution of the activities of prevention and investigation of aeronautical accidents and incidents.

? To promote the constant updating of regulation on the prevention of accidents and aeronautical incidents.

? Promote the permanent supervision of hazard identification and the preventive management of risks to operational safety.

? To promote the coordination of accident prevention activities and aeronautical incidents to the bodies and entities of public administration and the private sector.

? Carry out periodic evaluations of accident prevention and aeronautical incidents in civil aviation, per organ recognized by the Brazilian government, to identify deficiencies and correct them.

? Enhance and ensure the application of the supervision procedures for the compliance of the established measures for the sake of the prevention of accidents and aeronautical incidents.

? Ensure the appropriate handling of information in the context of the investigation of accidents and incidents, observed the secrecy of its exclusive use for the purposes of preventing aeronautical accidents, in accordance with treaties, conventions and acts international, of which Brazil is a party.

? To foster the exchange of information between domestic and foreign institutions to promote the exchange of experiences on the prevention of accidents and aeronautical incidents.

Protection from Unlawful Acts

? Permanently promote the assessment of the degree of risk for civil aviation, in the aim of identifying and eliminating illicit threats and acts.

? Ensure the application of the provisions regarding the protection against illicit acts, observed the treaties, conventions and international acts of which Brazil is a party.

? Enhance and ensure the enforcement of the surveillance procedures for the fulfillment of the established measures for the sake of protection against unlawful acts.

? Conduct periodic audits of protection against illicit acts, per organ recognized by the Brazilian government, to identify deficiencies and correct them.

? Promote the constant updating of the documentation on the protection against illicit acts.

? Enhance the methods and procedures that guarantee the safety of passengers, crews, personnel on land and general public against illicit acts.

? Foster the exchange of information between national and foreign institutions to promote mutual trust and the exchange of experiences on protection against illicit acts.

? Enhance security against illicit acts in all links of civil aviation by encouraging the use of new technologies, in the aim of incorporating the requirements of facilitation correports.

? Promote inclusion, in public safety policies, of actions for the protection against illicit acts.

? Stimulate the interaction between public safety organs and civil aviation bodies and entities, aiming to coordinate the actions of protection against illicit acts.

? To stimulate greater public awareness, through educational and promotional campaigns on the protection against illicit acts.

? Seek the inclusion of civil aviation protection against illicit acts in the formation and empowerment of Civil Aviation System professionals.

3.2.THE PROVISION OF THE PROPER SERVICE

General Actions

? Promote joint efforts in the sense that the services provided by the public and private bodies and entities that make up the Civil Aviation System are chopped up by safety, efficiency, continuity, regularity and punctuality, in a manner ensure predictability to its users.

? To stimulate the use of new technologies to ensure regularity and punctuality to passenger transport, cargo and postal suitcase.

? Develop capacity to respond quickly and effectively to the adverse factors-natural, material or human-that may disrupt the provision of the proper air transport service.

? Ensure the provision of the appropriate service by means of the supervision of air service providers, airport infrastructure and civil aeronautics.

? To continuously improve the parameters for the proper provision of air transport services.

Specific actions

? Establish standards and procedures for air transport services to be provided with respect to their users in general and, specifically, to those with special needs.

Continuity

? Scrutinizing the airline services companies so as to allow the regulator to build contingency plans for possible discontinuity events.

Regularity

? Promote measures that identify and eliminate threats to the continuity of the provision of air transport services and that respond quickly and effectively to natural, material or human factors that may affect their regularity.

Pontuality

? Promote integration between the organs and public entities and companies, so as to avoid delays arising from their functions.

3.3.THE PROTECTION OF THE ENVIRONMENT

General Actions

? To stimulate the reduction of the noise levels of aircraft engines.

? Minimise the impact of aircraft engine gas emissions on air quality.

? To promote the involvement of civil aviation related entities in the protection of the environment.

? To stimulate the development and use of technologies that reduce the impacts of aeronautical activity on the environment.

Specific actions

? Ensure the inclusion of environmental aspects in the planning, deployment and operation of aerodromes.

? Permanently seek the reduction of the adverse impacts caused by aeronautical noise and engine gas emissions from aircraft in the environment.

? Adopt, in the issues concerning noise, a balanced approach, which consists of the following elements: noise reduction in the source, planning of land use in the surroundings of aerodromes, adoption of mitigating measures, and operational constraints, of agreement with national interests.

? Encouraging the development of technologies within civil aviation, with a focus on the aeronautical industry, respecting the environment.

? Promote and enhance measures that disstimulate population adensation in areas subject to significant levels of emission of noises and gases by aircraft engines, in compliance with legislation regarding the protection zones of aerodromes, of noises, of aid for navigation and the airport security area.

? Stimulate and support the adoption of environment-related policies in the areas of surroundings of aerodromes in the federal, state and municipal spheres, aiming at the establishment of more suitable conditions for the practice of activities aeronautics.

? Enhance air navigation procedures en route and in terminal area and flight techniques that result in reduced noise impact and engine gas emissions from aircraft engines.

? To foster environmental education with the airport community, to the resident communities in areas of aerodromes ' surroundings.

3.4.The CONSUMER PROTECTION

General Actions

? To promote legal certainty in existing consumer relations in the civil aviation sector.

? Ensure the predictability, accuracy and clarity of the obligations of the air service providers.

? Ensure proper regulation of the rights and obligations of users, air service providers, aeronautical and civil airport infrastructure, so as to provide the balance in the relationship between the parties and minimise the administrative and judicial litigation.

? Ensuring transparency and provision of information regarding the relation of consumption by the various participating segments of the Civil Aviation System.

? Minimise differences in legal treatment in existing consumer relations in the provision of domestic and international air transport services.

Specific actions

Right to information

? To assure the user of air transport services the right to information regarding their consumption relationship.

? Streamline procedures so that essential information about the service hired by air transport users is provided in a correct, clear, accurate, ostensible and timely manner.

? Reduce the asymmetry of information between users, service providers, regulatory bodies, and too many government bodies.

? Ensure means that will propitiate the provision of accurate information about flight schedules and reasons for any delays or cancellations.

3.5.The DEVELOPMENT OF CIVIL AVIATION

General Actions

? Ensure the exploitation of the domestic air transport market to companies constituted under the Brazilian laws.

? Enhance the coordination of the affairs and actions of civil aviation, civil airport infrastructure and civil aeronautical infrastructure actors.

? Identify and study trends, coordinate planning, and draw up guidelines and policies that ensure sustainable civil aviation growth and safe, regular, efficient, comprehensive and punctual public service compliance.

? Stimulating effective management and consolidation of institutional and regulatory environment favorable to the development of civil aviation.

? Ensure legal certainty and the reduction of regulatory risks, aiming to encourage investments in Brazilian civil aviation.

? Promote the development of civil aviation by cooperation between the System's links, ensuring that their schedules are elaborated in an integrated manner.

? Promote the expansion of international air transport with views to increase the flow of people and goods between Brazil and other countries.

? To promote the integration of air services within the framework of South America.

? Ensure clear and well-defined economic regulation that will propitie stability to public and private investors, aiming at increasing investments and broadening the supply of air transport services.

? Ensure effective and continuous surveillance for the purposes of regulating the provision of the service and development of civil aviation.

? Follow up the development of the Civil Aviation System by means of permanent evaluation and dissemination of indicators.

? Keep up-to-date and coordinated the schedules of the civil aeronautical infrastructure, the civil airport infrastructure and the remaining System links.

? Seek the continued suitability of the infrastructure capacity for the expansion of air transport, including by means of delegation, as laid out in the Constitution.

? Encouraging the exchange of information and technologies between national and international institutions.

? Encouraging the integration of civil aviation with the sectors of tourism and commerce.

? Facilitating the movement of people and goods in the South American region through the creation of specific and unified border control procedures.

? Recognizing the specificity of most of the functions inherent in the management of air traffic and adopting measures that promote the proper empowerment of human resources that the Brazilian Air Space Control System (SISCEAB) in need.

? Stimulate the development of the low and medium traffic density connections.

? Recognizing the specificity and promoting the development of agricultural, experimental and aero-sport aviation activities, developing specific regulation for the sectors and stimulating the diffusion of their use.

? Ensuring transparency and publicity of regulatory activity.

? Consider the international operation of Brazilian air companies instrument of economic and commercial projection of political and strategic importance for the Country and for regional integration, owing to tax, tax and credit treatment similar to that of the export and infrastructure activities.

? Promote the initiatives required to ensure the implementation of the planning of the civil aeronautical and airport infrastructures.

? Consider government purchases in the interest of the development of the aeronautical infrastructure.

Specific actions

Institutional organization

? Define the competencies and assignments of the sector's bodies and entities, in order for the activities to be developed efficiently and without duplicity of efforts.

? Ensure the coordination of the sector, aiming at the integration, harmonisation and interaction of the organs and entities linked to civil aviation.

? Properly allocate financial resources in the sector's bodies and entities, so as to ensure that everyone carries out their functions, considering their different degrees of autonomy.

? To ensure compliance with the obligations assumed in treaties, conventions and international acts.

? Promote the proper interaction between the government bodies essential to air transport, responsible for the activities of federal police, health surveillance, customs control, among others, seeking joint planning of their activities.

? Keep up to date the legal milestone governing the Brazilian civil aviation, promoting consultation with the agents of the sector.

Training, Capacitation, and Human Resources Update

? Fostering proper human resource training, aiming to meet the national and regional needs of the System.

? Encouraging the training of human resources by the public sector and the private initiative.

? Continuously broaden the actions of training and empowerment of human resources, including through the addition of new features and partnerships.

? Enhance the process of monitoring the requirements and conditions for the operation of personnel training institutions, so as to ensure the quality of the capacity-building by means of periodic evaluation procedures.

? To promote the proper functioning of the aeroclubes and aviation schools to ensure the practical training of professionals, seeking the enhancement of the resourcing system of resources and equipment by selecting those entities that meet the standards of established quality and efficiency.

? Enhance professional certification processes through the periodic review of requirements, curriculum guidelines and knowledge assessment and verification system, in a participatory manner with the civil aviation segment related.

? To stimulate the training of professionals by means of incentives to educational institutions, the extension of government scholarship grant programmes and the fostering of the installation of vocational qualification poles.

? Foster the empowerment and upgrading of teaching staff, through the establishment of the professional requirements, the encouragement of government programs and the realization of national and international partnerships between the civil aviation's people.

? To foster research networks in teaching centres by encouraging the international exchange of industry professionals and supporting scientific production and specialized training programs in the Country and abroad.

? Foster actions for training and empowerment of professionals in the English language, through partnerships with public and private organizations, to enable these to attain the criteria of linguistic proficiency set out in agreements international.

? Probing the qualification of public administration professionals for acting in the sector.

? Extend the acting of the bodies of regulation and labour supervision in the development of the activities of professionals acting in the various branches of civil aviation, in the sense of ensuring appropriate working conditions.

? Encouraging the participation of the academic community in the development of civil aviation through convents with universities, sponsorships, development of research, projects and others.

Civil Airport Structure

? Promote the proper provision, broadening and optimization of the civil airport infrastructure, through the strategic targeting of investments, targeting economic development, national integration and the fulfillment of difficult regions access.

? Harmonize the capacity and demand of the civil airport infrastructure, based on investment plans that consider short, medium and long term schedules based on specific studies and integrated information.

? Ensuring the rationality of airport habilitation for international traffic, always justified on the basis of demand projection, econome-financial feasibility studies and strategic interests of the Country.

? Develop economic and regulatory incentives in such a way as to manage the demand and optimize the use of airports by ordering the air transport services.

? Ensure the preservation and protection of airport sites and the compatibilization of urban planning with the protection zones and the airport security area, through the development and enhancement of control mechanisms along with the municipalities.

? Stimulate private investment in the construction and operation of aerodromes.

? Planning the use of airport areas, so as to ensure complete utilization of the potential of your sites.

? Maintain civil airport facilities in conditions of properly servicing air transport users, ensuring the timely and appropriate maintenance of infrastructure.

? Promote the intermodality of transport, seeking the constant integration of civil aviation sector planning with that of the road, rail and aquaviary modals.

? Encouraging the installation of appropriate economic activities in the vicinity or at the airport site, observed the restrictions imposed by the protection zones, and without prejudice to the operations of the aerial activities.

? Promote together to the respective federates the infrastructure required for the deployment and operation of aerodromes, including the vivid access.

Science and Technology

? To foster the development of technologies for use in civil aviation, through government programs and the incentive for private participation.

? Seek the integration of the government's Science and Technology policy with the demands of civil aviation.

? Encouraging the development of alternative fuel technology studies for use in the various segments of civil aviation.

? To promote the participation of educational and research institutions in the development of technologies for use in civil aviation.

Aeronautical industry

? Encouraging the participation of the domestic industry in international programs of development and production of services, systems and components.

? Promote the adensation of the productive chain by means of the incentive and support for related industries.

? Encouraging international cooperation aiming at the productive integration of the national supplier chain.

? Enhancing funding mechanisms and tax policy to boost the development of the sector.

? Develop conditions for the Brazilian aeronautical industry to meet competitively the needs of the various segments of civil aviation.

? Strengthen and optimize the activities of certification, homologation and surveillance of aeronautical products and services, so that Brazil qualifies as an international reference in these activities.

? Stimulates the commercial promotion of national aeronautical products and services.

Civil Aeronautical Infrastructure

? Ensure the constant modernization of air traffic management systems by keeping them in line with the most advanced international technologies and standards.

? Ensure the operational safety of air traffic management services.

? Maintain supervision of air space control activities by ensuring the fulfillment of the established technical-operational requirements.

? Monitor the relationship between air service demand and installed capacity, aiming to plan for the magnification or adequacy of the infrastructure and minimise possible imbalances.

? Ensure the proper training and empowerment of human resources necessary for the provision of the essential services to the safe, regular and efficient management of air traffic.

Air services

? To stimulate the development of air services throughout the Brazilian territory.

General Actions

? To improve the efficiency of civil aviation operations, including by technical cooperation programmes.

? Elaborate standards, methods, guidelines and plans to support the deployment of the concepts of the organization and management of air traffic, project and operation of aerodromes, operational safety management and activities of aviation operators civil.

? Seek the early and coordinated expansion of the provision of aeronautical and civil airport infrastructure for service demand of air services.

Promote the growth of the sector by efficient regulation of the market, stimuli to private investments and the incentive to compete, aiming to co-curb anti-competitive practices and ensure the appropriate provision of services, the modicity of the prices and the guarantee of the rights of the users.

Civil Aeronautical Infrastructure

? Monitor and evaluate the performance of air operations for the purpose of enhancing services and the civil aeronautical infrastructure.

? Introduce new technologies, methods and processes of air traffic management that demonstrably produce efficiency gains without compromising the safety of air operations.

? Suit the civil aeronautical infrastructure to the most favorable operating requirements for efficiency gains.

? Ensure the empowerment and training of human resources in consonance with the need to enhance the efficiency of SISCEAB.

? Properly coordinate the transition to the efficient use of the various elements that make up the CNS/ATM concept (Communication, Navigation and Surveillance / Air Traffic Management) of the OACI.

? Establish guidelines that confirm to the market the role of balancing supply and demand, by prevailing tariff freedom in air transport services.

? Follow up on the behavior of the air transport market aiming at the adoption of measures to meet demand based on economic efficiency, seeking the increment of supply and the extension of the capacity of the aeronautical and airport infrastructure civilians.

? Support the Brazilian Competition Defence System (SBDC) in combating the infractions against the economic order within the framework of the civil aviation sector.

? Elaborate standards and procedures to facilitate the access of potential entrants in those aerodromes that present saturation of traffic with views to the magnification of the competition.

? Allow the use of the civil aeronautical and airport infrastructure up to the limit of the established capacity, second rules previously stipulated and in coordination with the users and without compromising operational safety.

? Establish exit procedures of the air transport market and discontinuity of services.

? Establish legal standards for the disengagement of civil airport areas and facilities occupied by companies that have ceased to operate.

4-FOLLOW-UP, EVALUATION AND REVIEW

The deployment of PNAC is to be monitored continuously by the Ministry of Defence, via the Civil Aviation Registry, aided by the remaining bodies and entities that integrate the Civil Aviation Council (CONAC).

For so much, indicators should be drawn up referring to the goals and established actions, which will be assessed annually, seeking to verify the repercussion of PNAC in the civil aviation sector, within a systemic and intersectoral vision.

The Policy and its strategic objectives and actions should be constantly updated as changes in the national, regional, and international context, ensuring that their results are adequate to the needs of the Civil Aviation System.
