DECREE OF August 20, 2007.

Declara of public utility, for purposes of misappropriation, total or partial, or of institution of administrative servitude, in favor of Brazilian Petroleum S.A. -PETROBRAS, the real estate it mentions, situated in the State of Rio Grande do Norte, necessary for the construction of the Sugar Sugar Pipeline, as well as from its complementary facilities, including optical cables, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers the art. 84, inciso IV, of the Constitution, and with a view to the provisions of the art. 8th, inciso VIII, of the Law no 9,478, of August 6, 1997, in the Decree-Law no 3,365 of June 21, 1941, in the Decree-Law no 1,075, of January 22, 1970, and what is stated in the ANP Process in the 48610.003046 /2007-11,

DECRETA:

Art. 1st Ficam declared of public utility, for purposes of disappropriation, total or partial, or of institution of administrative servitude, in Brazilian Petroleum S.A. -PETROBRÁS, or of company by it controlled directly or indirectly, which comes to be in charge of the construction, installation, operation, maintenance, repair and surveillance of the Sugar Sugar Pipeline, the real estate constituted of lands and benfeits, of private property, excluded from public domain goods, understood in the lanes of land located in the State of Rio Grande do Norte, and whose administrative restrictions are indispensable to the construction of the Sugar Sugar Pipeline, as well as its complimentary facilities, including optical cables.

§ 1st A strip of land referred to in the caput of this article, with approximately four hundred and ninety nine thousand and thirty-one square metres, situated in the State of Rio Grande do Norte, in the Municipalities of Alto do Rodrigues, Carnaubais and Serra do Mel, thus describes itself and characterizes: strip of land with twenty meters wide and approximate span of thirty-one thousand and three hundred and sixty-six meters, whose guideline has commenced at the point of coordinates N=9.404.560,53 and E=741.645, 61, in the Municipality of Alto of the Rodrigues-RN; Art. 2nd Brazilian Oil S.A. -PETROBRAS, or company by it controlled, directly or indirectly, is authorized to promote, with own resources, amicably or judicially, the disappropriation, total or partial, or the institution of administrative servitude of which it treats art. (I) may, including, invoke the character of urgency for purposes of provisional immission in the possession of the goods, pursuant to art. 15 of the Decree-Law no 3,365, of June 21, 1941, and of the Decree-Law no 1,075, of January 22, 1970.

Art. 3rd This Decree comes into effect on the date of its publication.
