DECREE OF January 8, 2004.

Declared of public utility, for purposes of dispropriation, total or partial, or institution of pass-through served, in favor of Brazilian Petroleum S.A. -PETROBRÁS, the real estate he mentions, in the State of Rio de Janeiro, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives him the art. 84, inciso IV, of the Constitution, with a view to the provisions of the art. 8º, inciso VIII, of Law No. 9,478 of August 6, 1997, in the Decree-Law No. 3,365 of June 21, 1941 and in the Decree-Law No. 1,075 of January 22, 1970 and what is stated in the ANP Process in the 48610.005149 /2003-84,

DECRETA:

Art. 1º Ficam declared of public utility, for purposes of dispropriation, total or partial, or institution of administrative servitude of passage, in favor of Brazilian Petroleum S.A. -PETROBRÁS, or of company by it controlled directly or indirectly, the real estate constituted of land and benfeits, of particular property, understood in the strip of land of thirty five metres wide, situated in the Municipalities of Quissamã, Carapebus and Macaé, in the State of Rio de Janeiro, in the stretch of Barra do Furado à Cabiúnas, necessary for the construction of the Barra Gas pipeline-Cabiúnas (GASCAB III), an integral part of the Plan Director of Gas Flow of the Campos Basin- PDEG.

Single Paragraph. The strip of land referred to this Decree, possesses approximately 2,380,700 m² of area, 35 m wide and 67,762 m extension, which thus describes itself and characterizes: the pipeline originates in the coordinates Ecuador and Central Meridian-39 degrees W. Gr (Zone 24) and as constants of the coordinates 10,000 km N and 500 km E. Art. 2º The Brazilian Oil S.A. -PETROBRÁS, or company by it directly or indirectly controlled, is authorized to promote, with own resources, amicably or judicially, the disappropriation, partial or total, or to institute the administrative servings of passage, in which case will be compensated, when cableable, the already indensed values in the perpetual servitude of passage instituted in favor of Brazilian Petroleum S. A-PETROBRÁS on part of the land strip described above.

Art. 3º Brazilian Oil S.A. -PETROBRÁS or company by it controlled directly or indirectly, in the exercise of the prerogatives secured to it by this Decree, may claim urgency for the purpose of the prior immission of possession, pursuant to the art. 15 of the Decree-Law No. 3,365 of June 21, 1941 and of the Decree-Law No. 1,075 of January 22, 1970.

Art. 4º This Decree comes into force on the date of its publication.
