THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confers it on art. 84, incisos IV and VI, of the Constitution,
D E C R E T A:
Art. 1º Stay approved the Regimental Structure and the Demonstrative Framework of the Cargos in Commission and of the Gratified Functions of the Ministry of Education, in the form of Annexes I and II to this Decree.
Art. 2º On the basis of the provisions of the preceding article, they shall be remanded, in the form of Annex III to this Decree, of the Office of Management, of the Ministry of Planning, Budget and Management, coming from extinct organs of the Federal Public Administration, for the Ministry of Education, the following posts in committee of the Group-Direction and Superiors-DAS: a DAS 101.6; four DAS 101.5; ten DAS 101.4; twenty-three DAS 101.3; twelve DAS 101.2; three DAS 101.1; one DAS 102.3; three DAS 102.2; and eight DAS 102.1.
Art. 3º The apostilles arising from the approval of the Regimental Structure, of which it treats art. 1º, should occur within twenty days, counted from the date of publication of this Decree.
Single paragraph. After the apostilaments provided for in the caput of this article, the Minister of State for Education will be publishing, in the Official Journal of the Union, within thirty days, counted from the date of publication of this Decree, nominal relation of the holders of the posts in committee of the Group-Direction and Superiors-DAS, referred to in Annex II, indicating, including, the number of vacant positions, their denomination and their respective level.
Art. 4º The internal regiments of the organs of the Ministry of Education shall be approved by the Minister of State for Education and published in the Official Journal of the Union, within ninety days, counted from the date of publication of this Decree.
Art. 5º This Decree enters into vigour on the date of its publication.
Art. 6º Stay revoked the Decrees #s 3,118, of July 15, 1999; 3,501, of June 12, 2000; and 3,709, of December 27, 2000.

CHAPTER I
OF THE NATURE AND COMPETENCE
Art. 1º The Ministry of Education, the body of the administration direct, has as an area of competence the following subjects:
I-national education policy;
II-child education;
III-education in general, understanding fundamental education, high school, higher education, youth and adult education, vocational education, special education and distance education, except military education;
IV-assessment, information and educational research;
V- university-level research and extension;
VI-magistery; and
VII-financial assistance to needy families for the schooling of their children or dependents.

CHAPTER III
OF THE COMPETENCE OF THE ORGANS
Section I
From the Direct and Immediate Assistance Bodies to the Minister of State
Art. 3º To the Cabinet of the Minister competes:
I-assist the Minister of State in his political representation and social, occupy yourself with the public relations and the preparer and dispatch of your personal expediency;
II-follow the progress of the Ministry's projects of interest, in tramway in the National Congress;
III- provide for the fulfillment of the consultations and the requirements formulated by the National Congress;
IV-provide for the official publication and disclosure of the matters related to the Ministry's area of acting; and
V-exercise other assignments that are committed to it by the Minister of State.
Art. 4º To the Executive Secretariat competes:
I-assist the Minister of State in the supervision and coordination of the activities of the member Secretaries of the structure of the Ministry and of the entities to it linked;
II-supervise and coordinate the activities related to the Federal Planning and Budget Systems, Organization and Administrative Modernization, Administration of Information and Informatics Resources, Human Resources, General Services, Financial Administration and Accounting, within the Ministry; and
III-assist the Minister of State in the definition of guidelines and in the implementation of the actions of the Ministry's area of competence.
Single paragraph. The Executive Secretariat exercises, still, the role of the sectoral body of the Civil Personnel Systems of the Federal Administration-SIPEC, of Organization and Administrative Modernization-SOMAD, of Administration of Information Resources and Informatics-SISP, of General Services-SISG, Planning and Federal Budget, Federal Accounting and Federal Financial Administration, through the Sub-Secretaries of Administrative and Planning Affairs and Budget to it subordinates.
Art. 5º À Subsecretary of Administrative Affairs competes:
I-plan, coordinate, and supervise the execution of the activities related to the Federal Organization Systems of Organization and Administrative modernization, of Administration of Information Resources and Informatics, Human Resources and General Services, within the Ministry;
II-promoting the articulation with the central organ of the federal systems referred to in the previous inciso, and inform and guide the organs of the Ministry as to compliance with established administrative standards; and
III-promote the drafting and consolidation of the plans and programs of the activities of their area of competence and submit them to the top decision.
Art. 6º À Subsecretary of Planning and Budget competes:
I-plan, coordinate, and supervise the execution of the activities related to the Federal Systems of Planning and Budget, of Financial Administration and Accounting, within the Ministry;
II-promoting the articulation with the central bodies of the systems referred to in the previous inciso, informing and guiding the bodies of the Ministry as to compliance with the established standards;
III-coordinate the drafting and consolidation of the Ministry's annual and multiannual plans and programmes and submit them to the top decision;
IV-follow up, consolidate and evaluate the results of the physical-financial implementation of the Ministry's annual and multi-annual plans and programs, in articulation with program managers;
V-develop the activities of budgetary, financial and accounting execution, within the Ministry; and
VI-conduct taking of the accounts of the expense payers and too many responsible for public goods and values and of all the one that gives cause and loss, strays or other wrongdoing that results in damage to the erarium.
Art. 7º À Legal Consultancy competes:
I-advise the Minister of State in matters of a legal nature;
II-exercise the coordination of the legal activities of the Ministry and linked entities;
III-fix the interpretation of the Constitution, laws, treaties, and the remaining normative acts, to be uniformly followed in its area of acting and coordination, when there is no normative orientation of the Union Advocate General;
IV-elaborate studies and prepare information, by request of the Minister of State;
V-watch the Minister of State in the internal control of the administrative legality of the acts to be by him practiced or already effective, and of those arising from organ or entity under his legal coordination; and
VI-examine, preview and conclusively, within the framework of the Ministry:
a) the texts of bidding edital, as well as those of the respective congenital contracts or instruments, to be published and concluded; and
b) the acts by which if go acknowledge the inexigibility, or decide the bidding dispensation.
Single paragraph. Legal Consulting exercises, still, the role of the sectoral organ of Advocate General of the Union.
Section II
Of The Singular Specific Bodies
Art. 8º To The Registry of Education Fundamental competes:
I-planning, guiding and coordinating, in a national framework, the process of formulating policies for fundamental education, in all its modalities and forms, as well as fostering the implementation of policies by means of technical and financial cooperation, aiming to ensure the equesity of the teaching offer and the stay of the student at school;
II-develop actions aiming at improving the quality of learning in the area of teaching fundamental, having the school as the main focus of its acting;
III-developing actions objecting to the decrease of the repeatable indices, improving learning levels in elementary school;
IV- develop actions objecting to the decrease in the illiteracy indices of young people and adults, in the poorest regions of the Country, with special attention to the age group of fifteen to nineteen years;
V-ensuring access to the school for the population in the age group of seven to fourteen years, with special attention paid to those who are, still, out of school;
VI-encouraging improvement in the quality of child education;
VII-supporting functioning of the school in Indigenous communities; and
VIII-ensure compliance with the legal devices concerning fundamental education.
Art. 9º To the Department of Fundamental Education Policy compete:
I-subsidize the formulation of the fundamental education policy, as well as the definition of technical-pedagogical strategies and guidelines;
II-propose and coordinate technical cooperation actions with the fundamental education systems targeting their effective development and caretaking for the training of educating for the exercise of citizenship; and
III-propose and support the articulation with governmental and nongovernmental organizations to strengthen the development of fundamental education.
Art. 10. To the Department of Development of Fundamental Education Systems competes:
I-adopt measures for the improvement of the planning process of state and municipal elementary school systems;
II-analyzing financial feasibility and suitability to the educational policies and guidelines of plans, programs and educational projects in the area of fundamental education;
III-promote studies of the functioning and the managerial performance of elementary school systems;
IV-orienting state and municipal education systems in formulating standards and establishing standards to be adopted at school institutions of education fundamental;
V-propose criteria for the allocation of financial resources, in articulation with the competent bodies;
VI-follow-up directly or indirectly to the execution of plans, programs and projects approved by the Registry; and
VII-adopt measures for the articulation between the state and municipal education systems, aiming at improving the quality of elementary education.
Art. 11. The Department of Fundamental Teaching Projects competes:
I-subsidize policy formulation and the definition of strategies for the implementation of projects in the area of fundamental education;
II-propose criteria for setting guidelines, standards and technical standards that guide the execution of the projects in the area of fundamental education; and
III-define and propose goals and objectives to be achieved in the implementation of the projects.
Art. 12. To the Follow-up Department of the Maintenance and Development Fund of the Fundamental Education and Valuation of the Mystery Compete:
I-follow up and supervise the deployment and operationalization of the Fund;
II-coordinate, within the framework of the Ministry, the elaboration of information necessary for the execution of the Fund's operationalization activities;
III-follow up, articulating with the Ministry of Finance, the repasses effective by the Union to the units of the Federation;
IV-coordinate, in articulation with the other organs of the Ministry, the periodic evaluation of the results of the application of the relevant legislation to the Fund; and
V -conduct studies on the impacts of the deployment of the Fund on state and municipal education systems.
Art. 13. The Secretary for Average and Technological Education competes:
I-plan, guide, coordinate and supervise the process of formulating and implementing the medium and technological education policy;
II-support the development of the education systems of middle and technological education, at the different levels of government, by technical and financial support;
III-establish mechanisms of articulation and integration with the productive sectors in the concerning the quantitative and qualitative demand of professionals, in the framework of technological education;
IV-promoting exchanges with public and private bodies; national, foreign and international;
V-ensure compliance with educational legislation within the framework of medium and technological education; and
VI-overseeing the activities developed by the Federal Agrotechnical Schools, by the Federal Technical Schools, by the Federal Centers for Technological Education and by the College Pedro II.
Art. 14. The Bureau of Higher Education competes:
I-plan, guide, coordinate and supervise the process of formulating and implementing the national higher education policy;
II-promote and disseminate studies on higher education and its relations with society;
III-promoting exchange with national, foreign and international entities on matters of their competence;
IV-supporting technique and financially the higher education institutions;
V-articulate with other governmental and non-governmental bodies and institutions, aiming for improvement of education;
VI-acting as the sectoral body of science and technology of the Ministry for the purposes provided for in the legislation that has on the National Scientific and Technological Development System;
VII-subsidize the elaboration of programs and projects aimed at reform of the federal education system;
VIII-ensure compliance with educational legislation in the framework of higher education; and
IX-subsidize the formulation of the funding offer policy to the student of the non-free higher education and supervise the programs aimed at that purpose.
Art. 15. To the Department of Higher Education Policy competes:
I-subsidize the formulation of the National Education Plan, within the framework of higher education;
II-promote strategic policy studies objecting to the development of higher education;
III-propose criteria for the implementation of policies and strategies for the organization and supervision of higher education;
IV-promote evaluation academic of courses and institutions of higher education, public and private;
V-promoting and supporting cooperation programs between public and private higher education institutions;
VI-supporting the implementation of teaching and extension programmes, aiming at the suitability of higher education institutions to local and regional reality and their integration with society;
VII-organize and follow up with the formation of the Commissions of Verification of Processes, designated by the Registry;
VIII-examine and issue opinion on matters related to higher education, in particular those forwarded by the National Board of Education; and
IX-overseeing higher education in the Federal District.
Art. 16. To the Department of Higher Education Development competes:
I-support the federal higher education institutions-IFES through the allocation of budget resources for the execution of their activities;
II-evaluate the managerial performance of the federal higher education institutions;
III-analyze the accountability processes of the supervised and supervised institutions;
IV- to monitor the budget implementation and cost ascertaining of the supervised and supervised institutions;
V-coordinate and monitor the implementation of the management activities of the hospitals linked to the federal educational institutions superior, aiming for enhancement in the areas of human resources, managerial development and physical and technological infrastructure; and
VI-organizing and keeping up to date the enrollment of higher education institutions.
Art. 17. To the Department of Special Projects of Modernization and Qualification of Higher Education competes:
I-develop special projects of fostering for higher education, aiming at the modernization and qualitilization of the institutions of higher education and university hospitals;
II-promote and coordinate the deployment, monitoring and evaluation of special fosters projects for higher education institutions and hospitals university-level; and
III-supporting and monitoring the implementation of special prgrams targeting the integration of higher education with society and, particularly, interaction with local and regional reality.
Art. 18. The Secretary of Special Education competes:
I-plan, guide, coordinate and supervise the process of formulating and implementing the National Special Education Policy;
II-support, technique and financially, the special education education systems;
III-set guidelines for the organization of the special education education systems;
IV-promoting articulation with national bodies, foreign and international, aiming at improving care in the area of special education;
V-orienting and monitoring the elaboration and definition of plans, programs and projects in the special education area;
VI-evaluate plans, programs and projects developed by the public and private systems of teaching, supported, technically and financially, by the Registry; and
VII-ensuring compliance with national law pertinent to special education.
Art. 19. The Office of Distance Education competes:
I-plan, guide, coordinate and supervise the process of formulating and implementing the distance education policy;
II-articulate with the too much organs of the Ministry, the Secretaries of Education of the States, the Municipalities and the Federal District, with public and private telecommunications networks, and with the class associations for the improvement of the education process to the distance;
III-plan, coordinate and supervise the execution of capacity-building programs, guidance and support for teachers in the area of distance education;
IV-support the adoption of technologies educational and pedagogical that assist learning in the distance education system;
V-promoting studies for identification of educational needs, aiming at the development of production and dissemination of programs of distance education;
VI-planning, implementing and evaluating distance education programs in the states, Municipalities and the Federal District, in articulation with the Education Secretaries of Federation Units and with the network of telecommunications;
VII-promoting technical and financial cooperation between Union, States, Federal District and Municipalities and national, foreign and international bodies for the development of education programs to the distance; and
VIII-optimizing the technological infrastructure of the media, aiming at the improvement of teaching.
Art. 20. The Department of Distance Education Policy competes:
I-plan and coordinate actions aiming at the implementation of programs and educational projects;
II-follow and control the implementation and the development of distance education, by means of programmes in television networks;
III-promoting and coordinating distance education programmes, for all levels of education;
IV-promote and coordinate projects aimed at improving the quality of distance education;
V-coordinate programs and actions developed in conjunction with state, municipal, and Federal District education secretaries and with other institutions in the area of distance education; and
VI-define and propose criteria for the acquisition and production of distance education programs.
Art. 21. The Department of Informatics in Distance Education competes:
I-planning and coordinating actions aiming at the execution of educational informatics projects;
II-foster the development of the supporting infrastructure in the area of informatics along the education systems in the states, Municipalities and Federal District;
III-supporting the development of computer technologies and their use by the fundamental education, medium and higher and in special education;
IV-carry out studies and research aiming to know national and foreign production, in the area of informatics, aimed at distance education, at their different levels; and
V-promoting the development of researches on educational informatics programs.
Art. 22. To the Department of Production and Dissemination of Educational Programs competes:
I-propose the production of educational programs and printed material;
II-elaborate production projects of educational programs, of post-production, as well as acquisition of productions together with third parties;
III-subsidizing the pedagogical sector in the design of educational programmes and printed material;
IV-coordinate and accompany productions the office of third parties; and
V-indicate the means appropriate to the diffusion and dissemination of distance education programs.
Art. 23. To the Secretary of the National Scholarship Program compete:
I-plan, guide, coordinate and supervise the process of formulating and implementing the National Minimum Income Guarantee Program Linked to Education- "Bolsa School";
II-articulate with the Municipalities and the Federal District, so as to stimulate the adherence of those in the national program;
III-articulate themselves with the responsible federal public bodies by the production and dissemination of statistics and information relevant to the program;
IV-carry out the procedures regarding the granting, maintenance and payment of the Union's liability benefits;
V-periodically evaluate the execution of the program; and
VI-conduct internal and external audits in the cadasters and procedures regarding the program.
Art. 24. The Benjamin Constant Institute competes:
I-subsidize the formulation of the National Policy of Special Education in the area of visual impairability;
II-promoting the education of visually impaired, upon its maintenance as a fundamental education body, aiming to ensure educational listening and preparation for the work of blind and impaired people, as well as to develop experiences in the pedagogical field of the area of visual impairment;
III-promote and carry out human resource capacity-building programs in the area of visual impairment;
IV-promote, carry out and disseminate studies and research in the pedagogical, psychosocial, ophthalmic fields, of prevention of the causes of the blindness of integration and reintegration of blind people and reduced vision to the community;
V-promoting programs for dissemination and exchange of experience, knowledge and technological innovations in the area of care for blind and impish people;
VI-elaborating and producing teaching material-pedagogical for the teaching of blind and impish people;
VII-support technique and financially the teaching systems and the institutions that act in the area of visual impairment, in articulation with the Secretary of Special Education;
VIII-promoting pedagogical development targeting enhancement and updating of resources instructional;
IX-developing rehabilitation programs, labour market research, and professional forwarding promotion aiming to enable, blind and vision-reduced people, the full exercise of citizenship; e
X-acting on a permanent basis with society, by means of mass communication and other resources, aiming at the rescue of the social image of blind and impish people.
Art. 25. To the National Institute of Deaf Education competes:
I-subsidize the formulation of the National Policy of Special Education in the area of hearing impairment;
II-promote and carry out programs of empowerment of human resources in the area of hearing impairment;
III-attend technically to education systems targeting educational care for the hearing impaired, in articulation with the Office of Education Special;
IV-promoting exchanges with associations and educational institutions of the Country, aiming to encourage the integration of hearing impaired;
V-promoting the education of hearing impaired persons, by medium of its maintenance as a fundamental education organ and middle education, aiming to ensure educational listening and preparation for the work of deaf people, as well as to develop experiences in the pedagogical field in the disability area hearing;
VI-promoting, carrying out and disseminating studies and research in the areas of deafness prevention, evaluation of the methods and techniques used and development of didactic resources, aiming at improving the quality of the listening to the hearing impaired;
VII-promoting programs for exchange of experience, knowledge and innovations in the area of hearing impaired education;
VIII-elaboration and production of material didactico-pedagogical for the teaching of hearing impaired;
IX-promoting constant action with the society, through mass media and other resources, aiming at the rescue of the social image of the hearing impaired; and
X-developing rehabilitation programs, labour market research, and professional forwarding promotion with the purpose of enabling people to surf the full exercise of citizenship.
Section III
Of The Representation
Art. 26. The Representation in the State of São Paulo competes to carry out the activities of the Ministry in the State, as well as others that are committed to it by the Minister of State for Education.
Art. 27. To Representation in the State of Rio de Janeiro compete to practise the acts of management of inactive personnel and pensioner, as well as providing support of the Minister's Office, in the respective State.
Section IV
Of The Body Collegiate
Art. 28. The National Board of Education is to exercise the powers of which it treats Law No. 4,024 of December 20, 1961, with the amendments laid down in Law No. 9,131, of November 24, 1995.
CHAPTER IV
OF THE ASSIGNMENTS OF THE LEADERS
Section I
From the Executive Secretary
Art. 29. The Executive Secretary is to:
I-coordinate, consolidate and submit to the Minister of State the Ministry's overall plan of action;
II-supervise and evaluate the execution of projects and activities of the Ministry;
III-supervising and coordinating the articulation of the organs of the Ministry with the central bodies of the systems concerning the area of competence of the Secretariat-Executive; and
IV-exercise other assignments that are committed to him by the Minister of State.
Section II
Of The Secretaries
Art. 30. To the Secretaries it is incumbent on planning, directing, coordinating, directing, monitoring and evaluating the execution of the activities of the units that integrate their respective Secretaries, and to exercise other assignments that are committed to them in internal regiment.
Single paragraph. It is also incumbent upon the Secretaries to exercise the assignments expressly delegated to them, admitted to sub-delegation to the directly subordinate authority.
Section III
Of The Remaining Leaders
Art. 31. To the Chief Minister's Office, the Legal Adviser, the Directors, the Representatives and the remaining leaders it is incumbent on planning, directing, coordinating, guiding, monitoring and evaluating the implementation of the activities of the respective units and the projects and programs and exercise other assignments that are committed to them, in their respective areas of competence.
CHAPTER V
OF THE GENERAL AND TRANSITIONAL PROVISIONS
Art. 32. The positions in committee and gratified functions of the Benjamim Constant Institute and the National Institute of Surf Education are the constants in the Annex to Decree No. 228 of October 11, 1991.
Art. 33. The internal regiments will define the detailing of the integral bodies of the Regimental Structure, the competencies of the respective units and the assignments of their leaders.
