DECREE OF November 18, 2004

Declares of social interest, for the purposes of agrarian reform, the rural real estate that mentions, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2º of the Supplemental Act No. 76, of July 6, 1993, 18 and 20 of Law No. 4,504 of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993,

DECRETA:

Art. 1º Ficam declared of social interest, for purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of Law No. 4,504, of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993, the following rural real estate:

I-"Farm Rio de Fish", with registered area of eight hundred and twenty-two hectares, seventy-nine ares and seventeen centiars, and measured area of eight hundred and twenty-nine hectares and eighty-three centiars, situated in the Municipality of Verissima, object of the Matriculation in the 62,421, fls. 67, Book 3-BN, of the Estate Registration Office of the Comarch of Uberaba, State of Minas Gerais (Case INCRA/SR-06/no 54170.001313 /2004-94);

II-"Farm Grota of the Dark", with registered area of four thousand, three hundred and ninety-five hectares and forty-eight airs, and measured area of four thousand and five hundred and forty-two hectares, nineteen airs and seventy two-centiars, situated in the Municipality of Juvenniture, object of the Registry in the R-1-3.159, fls. 63, Book 2-L, from the Estate Registration Office of the Comarch of Manga, State of Minas Gerais (Case INCRA/SR-06/no 54170.007893 /2002-61); and

III-"Fazenda Sidamar", with registered area of novecents and fourteen hectares and seventy-six airs, and measured area of eight hundred and fifty and one hectares and twenty centiars, situated in the Municipality of Silver, object of the Registry in the R-1-1.009, fls. 23, Book 2, of the Real Estate Registration Office of the Comarch of Silver, State of Minas Gerais (Case INCRA/SR-06/no 54170.001311 /2004-03).

Art. 2º Excludes from the effects of this Decree the semovents, the machines and agricultural implements, as well as the existing benfeons in the real estate referred to in art. 1st and belonging to those who will be benefited from their targeting.

Art. 3º The National Institute of Colonization and Agrarian Reform-INCRA gets authorized to promote the dispropriations of rural real estate that treats this Decree, in the form provided for in the Supplementary Act No. 76 of July 6, 1993, and to keep the areas of Legal Reserve and permanent preservation provided for in Law No. 4,771 of September 15, 1965, preferentially in single gleba, so as to reconciling the settlement with the preservation of the environment.

Art. 4º This Decree comes into force on the date of its publication.
