DECREE OF June 21, 2006.

Creates the Unini River Extractive Reservation in the Municipality of Barcelos, State of Amazonas, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, inciso IV, of the Constitution, and with a view to the provisions of the art. 18 of the Law no 9,985, of July 18, 2000, and what is stated in the Process in the 02005.000485 /2004-88,

DECRETA:

Art. 1st It is created the Extractivist River Unini Reserve in the Municipality of Barcelos, State of the Amazonas, covering an area of approximately eight hundred and thirty-three thousand, three hundred and fifty and two hectares, twenty-four airs and three centiars, having on the basis of the Folles SA-20-V, SA-20-V-D and AS-20-X-C, in the 1:1.000.000 scale, published by the Brazilian Institute of Geography and Statistics-IBGE, with the following descriptive memorial: departing from Point 1, of approximate geographical coordinates 61 ° 32 '32.35 "WGr and 1 ° 39' 55.51" S, located at the confluence of the Unini River with the Black River, follows by the right bank of the Unini River, in the sense amount, by approximate distance of 25,806.80 metres up to Point 2, of approximate geographical coordinates 61 ° 39 '59.26 "WGr and 1 ° 36' 34.50" S, located at the confluence of the Igarapé Aduiá with the Unini River; of this, it follows by the right bank of the Unini River, in the sense amount, by a distance of 49,049.85 metres up to Point 3, of approximate geographical coordinates 61 ° 54 '33.23 "WGr and 1 ° 43' 30.33" S, located at the confluence of the Igarapé Mauaru with the Unini River; of this one, it follows by the right bank of the Rio Unini, in the sense amount, by an approximate distance of 91,570.62 metres up to Point 4, of approximate geographical coordinates 62 ° 16 '26.04 "WGr and 1 ° 46' 16.96" S, at the confluence of the Igarapé Aranari with Rio Unini; of this, it follows by the right bank of the Unini River, in the sense amount, by a distance of 114,399.05 metres up to Point 5, of approximate geographical coordinates 62 ° 37 '41.58 "WGr and 1 ° 46' 15.35" S, at the confluence of the Igarapé Carajuru with the Unini River; of this one, it follows by the right bank of the Rio Unini, in the sense amount, by an approximate distance of 83,767.55 metres up to Point 6, of approximate geographical coordinates 62 ° 56 '20.26 "WGr and 1 ° 36' 27.11" S, at the confluence of the Igarapé Jaurituba with Rio Unini; of this, it follows by the right bank of the Unini River, in the sense amount, by an approximate distance of 156,482.56 metres up to Point 7, of approximate geographical coordinates 63 ° 29 '45.68 "WGr and 1 ° 36' 57.56" S, at the confluence of the Igarapé Iraalready with the River Unini; of this, it follows by the right bank of the Unini River, in the sense amount, by an approximate distance of 101,161.86 metres up to Point 8, of approximate geographical coordinates 63 ° 48 '24.87 "WGr and 1 ° 40' 46.80" S, at the confluence of the Unini River with the Igarapé Black Water; of this, follows by the right margin of the Igarapé Water Preta, in the sense amount, by an approximate distance of 237,776.56 meters up to Point 9, of approximate geographical coordinates 64 ° 51'32.40 "WGr and 2 ° 0 ' 33.08" S, at the confluence of the Igarapé Black Water with an igarapé without denomination; of this, follows by the igarapé without denomination, in the sense amount, by an approximate distance of 15,869.48 meters to its spring in Point 10, of approximate geographical coordinates 64 ° 56 ' 4.95 " WGr and 1 ° 56 '44.30 "S; of this, it follows by the watershed of the Urumutum / Rio Cunini River with the Igarapé Water Preta for an approximate distance of 39,667.10 metres up to Point 11, of approximate geographical coordinates 64 ° 52' 51.92" WGr and 1 ° 39 ' 7.31 " S, at the nascent of an igarapé with no denomination; of this, it follows by the watershed of the Cunini River with the Igarapé Water Preta for a approximate distance of 84,046.35 metres up to Point 12, of approximate geographical coordinates 64 ° 13 '16.62 "WGr and 1 ° 30' 10.55" S, in the spring of the White Igarapé, affluent of the Caurés River; of this, follows by the watershed of the Igarapé Water Preta / River Cunini with the Caurés River by approximate distance of 84,189.62 meters to the Point 13, of approximate geographical coordinates 63 ° 31'4.59 " WGr and 1 ° 25 ' 2.35 " S, at the spring of an Igarapé without denomination, tributary of the Caurés River; of this, follows by the watershed of the Unini River with the Caurés River by a approximate distance of 139,314.33 meters to the Point 14, of approximate geographical coordinates 62 ° 27 '39.06 "WGr and 1 ° 34' 25.82" S, at the source of the Igarapé Aranari, affluent of the Unini River; of this, follows by the watershed of the Cunini River / Rio Negro with the Unini River by approximate distance of 56,554.12 meters to the Point 15, of coordinates approximate geographical 62 ° 2 '42.50 "WGr and 1 ° 30' 6.34" S, located in the spring of the Igarapé Muaru, affluent of the Rio Negro; this one follows by the watershed Rio Negro with the Unini River by approximate distance of 57,433.43 meters to the Point 16, from approximate geographical coordinates 61 ° 39 '53.07 "WGr and 1 ° 33' 11.20" S, located in the spring of the Igarapé Inajatuba, affluent of the Rio Negro; of this, follows by the Igarapé Inajatuba, by an approximate distance of 10,433.11 meters to the Point 17, of approximate geographical coordinates 61 ° 35 '7.51 "WGr and 1 ° 33' 29.74" S, at the confluence of the Igarapé Inajatuba with the Black River; of this, it follows by the right bank of the Rio Negro, in the downstream sense, by an approximate distance of 29,399.42 meters to the Point 1, start of this descriptive memorial, totaling an approximate perimeter of one million, three hundred and seventy nine, six hundred and thirty-nine meters and seventy six centimeters.

Art. 2nd Reserva Extractivist River Unini aims to protect the means of living and the culture of the population extractivist resident in the area of its comprehensiveness and ensure the sustainable use of the natural resources of the unit.

Art. 3rd Caberá to the Brazilian Institute of the Environment and Renewable Natural Resources-IBAMA to administer the Unini River Extractivist Reserve, adopting the measures necessary for their deployment and control, in the terms of the art. 18 of the Law no 9,985 of July 18, 2000, and formalizing the contract of free use cession with the traditional extractivist population, as well as monitoring compliance with the conditions therein stipulated, in the form of the law.

Art. 4th Ficam declared of social interest, for the purposes of misappropriation, in the form of the Law no 4,132, of 10 of september 1962, rural real estate of legitimate private domain and its benefits that come to be identified in the boundaries of the Unini River Extractivist Reservation.

§ 1st The IBAMA is allowed to promote and execute the dispropriations of which it treats the caput of this article, and may, for the purpose of immission in the possession, claim the urgency to which if refers to art. 15 of the Decree-Law no 3,365, of June 21, 1941.

§ 2nd The areas that come to be identified as a domain of the State of Amazonas will only be able to be misappropriated after due legislative authorization.

§ 3rd The Federal Attorney General, the organ of Advocate General of the Union, through its legal unit of execution together with the IBAMA, shall be authorized to promote the measures relevant administrative and judicial authorities, targeting the declaration of nullity of eventual property titles and their respective real estate records considered irregular, incidents in the Unini River Extractivist Reserve.

Art. 5th It is ensured the participation of the State of Amazonas and the Municipality of Barcelos in the Council Deliberative of the Unini River Extrativist Reserve.

Art. 6th This Decree takes effect on the date of its publication.
