DECREE NO. 6,316, OF December 20, 2007.

Approves the Status and the Demonstrative Framework of the Cargos in Commission of Level Personnel Improation Coordination Superior-CAPES, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confers you the art. 84, incisos IV and VI, paragraph (a) of the Constitution, and with a view to the provisions of the art. 50 of the Law no 10,683, of May 28, 2003,

DECRETA:

Art. 1st Ficam approved the Statute and the Letters Demonstration Board of the Cargos in Coordination Commission of Improvement of Higher Level Personnel-CAPES, in the form of the Annexes I and II to this Decree.

Art. 2nd Out of the provisions of the art. 1st, stay remanded, in the form of Annex III to this Decree, the following posts in committee of the Group-Direction and Higher Assessors and Gratified Functions:

I-from CAPES to the Office of Management, of the Ministry of Planning, Budget and Management, 17 FG-1; and

II-of the Registry of Management, of the Ministry of Planning, Budget and Management, for CAPES: three DAS 101.5; thirteen DAS 101.4; Seventeen DAS 101.3; five DAS 101.2; two DAS 101.1; nine DAS 102.3; and three DAS 102.2.

Art. 3rd The apostilaments arising from the approval of the Statute that it treats art. 1st shall occur within twenty days, counted from the date of publication of this Decree.

Single paragraph. After the apostilaments provided for in the caput, the Minister of State for Education shall publish, in the Official Journal of the Union, within thirty days, counted from the date of publication of this Decree, nominal relation of the holders of the posts in committee of the Group-Direction and Superiors Superiors-DAS, referred to in Annex II, indicating, including, the number of vacant positions, their denomination and their respective level.

Art. 4th The internal regiment of CAPES will be approved by the Minister of State for Education and published in the Official Journal of the Union, within ninety days, counted from the date of publication of this Decree.

Art. 5th This Decree comes into effect on the date of its publication, producing effects from January 2, 2008.

Art. 6th It is revoked the Decree no 4,631, of March 21, 2003.

ANNEX I

STATUTE OF THE IMPROVEMENT COORDINATION

OF TOP LEVEL PERSONNEL-CAPES

CHAPTER I

OF NATURE AND PURPOSE

Art. 1st The Coordination of Higher Level Personnel-CAPES, public foundation, instituted by force of art. First of the Decree No 524 of May 19, 1992 on the basis of the Laws in the 8,405 of January 9, 1992, and 11,502, of July 11, 2007, linked to the Ministry of Education, with registered office and venue in Brasilia, Federal District, will be term of indeterminate and shall be governed by this Statute.

Art. 2nd CAPES has for the purpose of subsidizing the Ministry of Education in formulating policies and developing activities of supporting the training of magministry professionals for basic and higher education and for scientific development and technological of the Country.

§ First in the framework of higher education, CAPES will have as its purpose to subsidize the Ministry of Education in formulating policies for postgraduate education, coordinate the graduate system and evaluate the courses of that level, and stimulate, upon scholarships, aids and other mechanisms, the formation of human resources highly qualified for the top grade faculty, the research and demand fulfillment of the public and private sectors and especially:

I-subsidize the elaboration of the National Education Plan and elaborate, every five years, the proposal of the National Post-Graduate Plan, in articulation with the units of the Federation, university institutions and entities involved;

II-coordinate and accompany the implementation of the National Post-Graduate Plan;

III-elaboration of sectoral acting programmes or regional;

IV-set minimum standards of quality to regulate the functioning of the master's and doctoral courses in the country;

V-regulating selection of consultants scientific and the procedures of the evaluation of the postgraduate programs stricto sensu;

VI -to promote studies and assessments necessary for the development and improvement of graduate education and the performance of their activities;

VII-promote the dissemination of scientific information;

VIII-stimulate the fixation of newly doctorates and foster postdoctoral programs in the country;

IX-fomenting studies and activities that directly or indirectly contribute to the development and consolidation of the institutions of higher education;

X-support the scientific development process and national technology; and

XI-maintain exchange with other bodies of the Public Administration of the Country, with international bodies and with domestic or foreign private entities, aiming to promote cooperation for the development of postgraduate education by concluding agreements, agreements, contracts and adjustments that are necessary for the achievement of your goals.

§ 2nd In the framework of basic education, CAPES will have as purpose to induce and nurture, including in collaboration arrangements with States, Municipalities and the Federal District and exclusively upon arrangements with higher education institutions, the initial and continuing education of professionals of the basic education magistery, and, especially:

I-fostering initial and continuing training programs of professionals of the magisterium for basic education with views to the construction of a national teacher training system;

II-articulate training policies of practitioners of the magister of basic education at all levels of government, based on the collaborative regime;

III-planning long-term actions for the initial and continued formation of the professionals of the education magministry basic in service;

IV-elaborate setorial or regional acting programs, so as to meet the social demand for professionals from the magistration of basic education;

V-follow the performance of the graduate courses in the assessments conducted by the National Institute of Educational Studies and Educational Research Anthem Teixeira-INEP;

VI-promoting and supporting studies and assessments necessary for the development and improvement of content and curriculum orientation of the initial and continuing education courses of magistration professionals;

VII-maintain exchange with other bodies of the Administration Public of the Country, with international bodies and with domestic or foreign private entities, aiming to promote cooperation for the development of the initial and continuing training of magistery professionals, upon the celebration of convemians, agreements, contracts and adjustments that are necessary for the achievement of your goals.

Art. 3rd For the performance of its activities, CAPES will be able to use opinions from scientific advisors, with the purpose of:

I-proceed to the follow-up and evaluation of courses and programs of foment; and

II-appreciate the merit of the scholarship solicitations or aids.

§ First For the purposes of the provisions of this article, CAPES will be advised by professionals of recognized competence, acting in the area of teaching and training of teachers of the basic education, as well as in postgraduate education and research.

§ 2nd In the framework of higher education, the advisor will be provided by coordinators of the various areas of assessment, chosen from among professionals of recognized competence, acting in postgraduate education and research, observed the Internal Rules.

§ 3rd The evaluation area coordinators will be able to nominate other professionals who, approved by CAPES, will issue opinions, either individually or in committee, when it comes to the analysis of solicitations concerning scholarships, aid and programmes of foment, as well as evaluation of courses, institutions and proposals for new courses.

§ 4th CAPES could be worth from its enrollment of scientific advisors for designation of professionals who will issue opinions that they treat incisions I and II of this article.

CHAPTER II

FROM THE ORGANIZATIONAL STRUCTURE

Art. 4th CAPES has the following Organizational Structure:

I-collegiate bodies:

a) Superior Council;

b) Technical-Scientific Council of Higher Education; and

c) Technical-Scientific Council of Basic Education.

II-executive body: Diretoria-Executive;

III-bodies of direct and immediate assistance to the President:

a) Cabinet; and

b) Secretariat-Executive of the Collegiated Bodies;

IV-sectional organs:

a) Federal Prosecutor's Office;

b) Internal Audit; and

c) Directorate of Management;

V-specific organs:

a) Directorate of Programs and Bolsas in the Country;

b) Direction of Evaluation;

c) Directorate of International Relations;

d) Directorate of Basic Education Presential; and

e) Directorate of Education the Distance.

CHAPTER III

DA DIRECTION AND NOMINATION

Art. 5th The upper administration of CAPES will be exercised by the Executive Directorate and the Higher Council.

§ CAPES Executive Director shall be composed of the President and the Directors, who shall be appointed in the form of the current legislation, by appointment of the Minister of State of the Education.

§ 2nd The Chief Prosecutor and the Auditor-in-Chief to the CAPES will be chosen and appointed in the form of the legislation in force.

§ 3rd The remaining positions in committee and gratified functions shall be provident in the form of the relevant legislation.

CHAPTER IV

OF THE COLLEGIATED BODIES

Art. 6th The Superior Council, made up of twenty members, will have the following composition:

I- natos members:

a) the President of CAPES, who will preside over it, being replaced in his absences by its legal substitute;

b) the Secretary of Basic Education, of the Ministry of Education;

c) the Secretary of Higher Education, of the Ministry of Education;

d) the President of the National Council for Scientific and Technological Development -CNPq;

e) the President of the Financier of Studies and Projects-FINEP;

f) the Director-General of the Department of Scientific, Technical and Technological Cooperation of the Ministry of Relations Exteriors; and

g) the President of the National Association of the Leaders of Institutions Federal Higher Education-ANDIFES;

II-assigned members:

a) seven members chosen among practitioners of recognized competence, acting in teaching and research;

b) two members chosen from among the leaderships of recognized competence of the business sector;

c) a chosen member from among the components of the collegiate of the National Forum of the Pro-Rectors of Research and Post-Graduation, being necessarily leading from Higher Education Institution that provide doctoral courses recommended by CAPES;

d) a doctoral student, representative of the National Association of Post-Graduates;

e) a member of the Technical-Scientific Council of Higher Education elected by its peers; and

f) a member of the Technical-Scientific Council of Basic Education elected by its peers.

§ First of the Higher Council meetings will be able to participate, without the right to vote and at the invitation of its President, the remaining CAPES leaders and servers, as well as representatives of entities.

§ 2nd The members of which it treats the inciso I of this article will represent themselves, in their absences, by their legal substitutes.

§ 3rd The members of which treats the inciso II of this article will be assigned upon act of the Minister of State for Education, with a three-year term, admitted a redrive.

§ 4th The members referred to in (? a? of the inciso II of this article will be preferentially chosen so as to represent the diverse acting sectors of CAPES, as well as the areas of expertise, when possible.

§ 5th The member of which deals with point? d? of the inciso II of this article will lose the mandate at the time that it loses its regular student condition in the doctoral course it is carrying out.

§ 6th Ocurring vacancy in the cases of the inciso II of this article, will be designated a new member to complete the mandate.

§ 7th will lose the mandate the designated member who laces, in the same year, without justification, to two ordinary meetings of the Top Council.

Art. 7th The Higher Council shall convene, ordinarily, twice a year and, extraordinarily, when convened by its President or by two-thirds of its members.

§ First the deliberations of the Higher Council will be taken by a majority of votes of the members present to the meeting and will be expressed by means of resolutions signed by its President.

§ 2nd The President of the Board Superior will be entitled to the vote of quality in addition to the nominal vote.

Art. 8th The Technical-Scientific Council of Higher Education will have the following composition:

I-o President of CAPES, who will chair it;

II-the Director of Evaluation, the Director of Programs and Scholarships in the Country and the Director of International Relations;

III-representatives of each of the great areas of knowledge, as disposed of in art. 9o;

IV-a representative of the National Forum of the Pro-Rectors of Research and Post-Graduation, by he chosen from among the leaders of institutions offering doctorate courses recommended by CAPES; and

V-a doctoral student, representative of the National Association of Postgraduate Graduates.

§ First of the meetings of the Technical-Scientific Council of Higher Education will be able to participate, without the right to vote and at the invitation of its President, the remaining leaders and servers of the CAPES, when necessary to the enhancement or clarification of the matter under discussion.

§ 2nd The members of which treat the incisors I and II of this article shall represent themselves, in their absences, by their legal substitutes.

§ 3rd Three months after your inauguration, the area coordinators will elect their representatives set out in the inciso III of this article, for a mandate that will win three months after the breakup of his tenure as coordinators, admitted a redrive.

§ 4th The member of which treats the inciso V of this article will lose the mandate at the time that it loses its regular student condition in the doctoral course it is carrying out, being designated new member to complete its mandate.

Art. 9th will be formed three electoral colleges upon grouping of areas of knowledge, to choose from their representatives who will have a seat on the Technical-Scientific Council of Higher Education.

§ First the grouping of the areas of knowledge will be indicated by the Executive Directorate, heard the Council Technical-Scientific Education of Higher Education, and approved by the Higher Council of CAPES.

§ 2nd Each college shall elect, three months after the possession of the new area coordinators, its representatives in the Technical-Scientific Council of Higher Education, in total of six, being at least one and at most three of each large area than the make up.

§ 3rd Chosen the advisors, each college shall elect its alternates, observed the balance of the representation of its large areas.

Art. 10. The Technical-Scientific Council of Basic Education will have the following composition:

I-o President of CAPES, who will chair it;

II-the Secretaries of Basic Education, of Education Higher, Professional and Technological Education, Distance Education, Special Education and Continued Education, Alphabetization and Diversity of the Ministry of Education;

III-the Directors of Presential Basic Education, of Teaching the Distance, Evaluation and International Relations of the CAPES; and

IV-up to twenty representatives of civil society chosen from among professionals of recognized competence in Basic Education, observed regional representativeness and by area of formation, when possible.

§ First of the meetings of the Technical-Scientific Council of Basic Education will be able to participate, without the right to vote and at the invitation of its President, the remaining leaders and servers of the CAPES, as well as representatives of entities when necessary for the enhancement or clarification of the matter under discussion.

§ 2nd The members of which treat the incisos I, II and III of this article shall represent themselves, in their absences, by their legal substitutes.

§ 3rd The members of which it treats the inciso IV of this article will be designated by the President of CAPES, from lists triplets drawn up by the Higher Council, after consultation with civil society, and will have three-year terms, admitted a redrive.

§ 4th In the impossibility of attendance to the meetings, the members of which treats the inciso IV of this article will be replaced by the respective alternates, which will be chosen as laid out in § 3rd.

Art. 11. The Technical-Scientific Councils of Higher Education and Basic Education shall convene, ordinarily, twice a year and, extraordinarily, when convened by the President or by most of its members.

§ First decisions will be made by the majority of its members present at the meetings and expressed through resolutions, signed by its President.

§ 2nd Councils will be able to, at the discretion of their President, meet in chambers for examination and pronouncement around subjects that require specific analyses.

CHAPTER V

OF THE COMPETENCIES OF THE ORGANS

Section I

From the Collegiated Bodies

Art. 12. To the Superior Council, the deliberative collegiate body of CAPES, competes:

I-establish priorities and guiding lines of the entity's activities, as of proposal submitted by the President of CAPES;

II-appreciate the proposal of the National Post-Graduate Plan, for forwarding to the Minister of State for Education;

III-subsidize the drafting of the National Plan of Education with proposals regarding the purposes of CAPES;

IV-appreciate criteria, priorities, and procedures for the grant of scholarships and aid;

V-approve the annual programming of CAPES;

VI-approve the budget proposal of CAPES;

VII-approve the annual activities report of CAPES;

VIII-approve the appointment and exoneration of the internal audit holder;

IX-appreciate proposals regarding changes in the status and internal regiment of CAPES; and

X-define the process and criteria of choice of the coordinators of the evaluation areas of which it treats the § 2nd of the art. 3rd and forward to the President your referrals via triple-order lists.

Art. 13. To the Technical-Scientific Council of Higher Education competes:

I-watch the Executive Director-Executive in the elaboration of CAPES's specific acting policies and guidelines in regard to the formation of high-level human resources, the postgraduate system and the national scientific and technological development system;

II-collaborate on the drafting of the proposal of the National Graduate Plan;

III-opines on the annual programming of CAPES in the specific area of Higher Education;

IV-opines, in the area of its acting, on criteria and procedures for the distribution of scholarships and institutional and individual aid;

V-opinionated on cooperation agreements between CAPES and national, foreign or international institutions in the area of their acting;

VI-propose criteria and procedures for the follow-up and evaluation of postgraduate education and the programs implemented by CAPES in the framework of higher education;

VII-deliberating ultimately in the framework of CAPES on proposals for new courses and concepts awarded during the Evaluation of the Graduate Programs;

VIII-propose the realization of studies and programs for the enhancement of the CAPES activities in the regard to the formation of high-level human resources, the postgraduate system and the national scientific and technological development system;

IX-opinionated on subjects that are submitted to it by the President of CAPES; and

X-elect your representative in the Top Council.

Art. 14. To the Technical-Scientific Council of Basic Education competes:

I-watch the Executive Director-Executive in the elaboration of CAPES ' specific acting policies and guidelines in regard to the initial and continuing training of professionals of the basic education magistery and the construction of a national training system of professors;

II-attend the Directors of Presential Basic Education and Education a Distance with regard to the consolidation of the collaborative regime between all levels of government;

III-discuss long-term guidelines for the initial and continual training of the practitioners of the basic education magister in service;

IV-fix parameters for assessment of demand by professionals of the basic education magistration, inclusive to subsidize the installation of municipal poles of presential support;

V-follow up the assessment of the courses in pedagogy, graduate and upper normal in the evaluation processes conducted by the INEP;

VI-manifold in the recognition and renewal processes of recognition of courses of pedagogy, graduate and upper normal, in advance to the decision of the Registry competent;

VII-collaborate in the drafting of proposals, relating to initial training and continued from basic education practitioners of basic education, to subsidize the National Education Plan;

VIII-opinionated on the annual programming of CAPES, in the specific area of Basic Education;

IX-opines on criteria and procedures for fostering studies and research concerning the curricular orientation and content of the initial and continuing education courses of practitioners of the basic education magistration;

X-establish parameters by which will be evaluated the fostering programs and courses that receive financial resources from CAPES;

XI-propose the realization of studies and programs for the enhancement of CAPES activities in your area of acting;

XII-opinionated on subjects that are submitted to it by the President of CAPES; and

XIII-elect your representative in the Superior Council.

Section II

Do the Executive Body

Art. 15. To the Executive Director competes:

I-formulate the guidelines and strategies of CAPES, in consonance with the general policies of the Ministry of Education;

II-manage the elaboration and implementation of the plans, programmes and actions relating to the purposes and assignments of CAPES, observing, when couber, the deliberations of the Higher Council and the Technical-Scientific Councils; and

III-promote the internal and external joints necessary for the execution of the activities of CAPES.

Section III

From the Direct Assistance Organs and Immediate to the President

Art. 16. To the Cabinet competes:

I-attend the President on his social and political representation;

II-tasked with the preparer and dispatch of the President; and

III-exercise other competencies that are committed to it by the President of CAPES.

Art. 17. The Executive Secretariat of the Collegiated Bodies competes to promote technical-administrative support to the Councils and the chambers that are eventually constituted by providing the conditions for compliance with the legal powers of the collegiated bodies.

Section IV

From the Sectional Organs

Art. 18. To the Federal Prosecutor's Office to the CAPES compete to perform the assignments provided for in the Act no 10,480 of July 2, 2002, observed the guidelines emanating from the Federal Attorney General.

Art. 19. The Internal Audit competes to examine the legal compliance of the budget management acts-financial, heritage, personnel, too much administrative and operational systems and, specifically:

I-check the regularity of internal and external controls, especially of those concerning the realization of the revenue and expense, as well as the financial execution of contracts, arrangements, agreements and adjustments firmed up by CAPES;

II-examine the specific legislation and correlates norms, orienting as to their observance;

III-promote regular inspections to check the physical and financial execution of the programs, projects, and activities and perform extraordinary audits determined by the President;

IV-examine and issue opinion on the provision of annual accounts of the entity and taken from special accounts; and

V- propose actions to ensure the legality of the acts and the scope of the results, contributing to the improvement of the management.

Paragraph single. In the exercise of its powers, the Internal Audit governs, administratively, to the Superior Council pursuant to art. 15 of the Decree no 3,591, of September 6, 2000.

Art. 20. The Management Directorate competes to coordinate and supervise the execution of the activities related to the Federal Planning and Budget Systems, Financial Administration, Accounting, Organization and Administrative Modernization, of Administration of Information and Informatics Resources, Human Resources and General Services, within the framework of CAPES.

Section V

Of the Singular Specific Organs

Art. 21. To the Directorate of Programs and Grants in the Country competes:

I-supervise and coordinate the process for granting scholarships and aid in the country and fosters for the maintenance of postgraduate education;

II-support with programs of fostering and fellowships the creation of postgraduate courses in geographic regions and in areas of knowledge considered strategic by CAPES;

III-promoting innovation and scientific and technological development upon implementation of special scholarship programmes and aids; and

IV-homologation opinions emanating from the scientific advisors.

Art. 22. The Evaluation Directorate competes:

I-promote and coordinate the evaluation processes and follow up, within the framework of CAPES;

II-provide for consideration and voting, by the Council Technical-Scientific Higher Education, from the opinions exarted by the committees of the areas of assessment as to the quality of proposals for new postgraduate courses, as well as to the periodic evaluation of existing courses; and

III-support visits and induction activities leading to the enhancement or creation of courses of postgraduate education, especially in the areas of knowledge, regions and geographical microrregions and levels of courses considered to be given priority by the policy of CAPES.

Art. 23. To the Directorate of International Relations competes:

I-promoting the internationalization of the postgraduate Brazilian, articulated with the other levels of teaching, when necessary;

II- to promote and participate, in articulation with the Ministry of Education, Foreign Affairs and other governmental bodies, of the negotiations of agreements and arrangements for exchange and educational, scientific and technological cooperation;

III-supervise and coordinate the process of granting scholarships and aid abroad and of international cooperation in the educational, scientific and technological areas, in the framework of CAPES acting; and

IV-homologation opinions emanating from scientific advisors as to the merit and quality of scholarship solicitations, aid and support projects for cooperation projects technique.

Art. 24. The Directorate of Presential Basic Education competes:

I-fomenting articulation and the regime of collaboration between the education systems of basic education and higher education, inclusive of postgraduate education, for the implementation of the national teacher training policy;

II-subsidize the formulation of initial and continued formation policies of practitioners of the magister of the basic education;

III-supporting the lecturer training of the basic education magistery, upon grant of fellowships and aid for the development of curriculum and teaching material; and

IV-supporting docent training by stimulus programs for admission to the career of the basic education magistery.

Art. 25. To the Directorate of Education the Distance competes:

I-fomenting public institutions of higher education and municipal poles of presential support, aiming for the quality offer of degree courses in the distance modality;

II-articulate the public institutions of higher education to the municipal poles of presential support, within the framework of the Open University of Brazil-UAB;

III-subsidize the formulation of initial and continual teacher training policies, potentializing the use of the methodology of distance education, especially within the framework of the UAB;

IV-support the training initial and continuing education practitioners of basic education, upon grant of fellowships and aid for lecturers and tutors in the public institutions of higher education and presential tutors and coordinators at the municipal poles of presential support; and

V-plan, coordinate and evaluate, in the framework of the actions of foment, the offer of higher courses in the modality the distance by public institutions and the physical and personnel infrastructure of the municipal poles of presential support, in support of initial and continuing teacher education for basic education.

CHAPTER VI

DAS ATTRIBUTIONS OF THE LEADERS

Art. 26. The President is incumbent on:

I-submit to the Higher Council of CAPES matters of its competence, as disposed of in the Internal Rules;

II-plan, direct, coordinate and control the execution of the activities of CAPES;

III-guide and coordinate the general operation of CAPES in all sectors of its activities, as well as of the general policy and the plans, programs and projects formulated by the Ministry of Education, affections its purposes;

IV-firming, on behalf of CAPES, contracts, arrangements, arrangements, adjustments and other similar instruments, as well as represent it in judgment;

V-designate the leaders of the technical and administrative units defined in the Internal Rules of CAPES;

VI-designate the area coordinators of evaluation, according to § 2nd of the art. 3rd and his representatives in the Technical-Scientific Council of Higher Education, observed the provisions of the art. 9o;

VII-designate the members of the Technical-Scientific Council of Basic Education that treats the inciso IV of the art. 10;

VIII-authorize the hiring of consultants and arrange technical commissions for the conducting studies and drafting opinions, in accordance with the specific needs of CAPES, in line with the current legislation;

IX-practice the necessary acts to the technical, administrative, budgetary and financial management of CAPES; and

X-exercise the remaining assignments bestowed upon it by this Statute and the Internal Rules of CAPES.

Art. 27. To Directors, the Chief Prosecutor, Auditor-Chief, the Chief of Staff, the Head of Advising and the remaining leaders is to direct, coordinate and guide the implementation of the activities of the respective units and to exercise other incumbencies which are committed by the President of CAPES.

CHAPTER VII

OF THE HERITAGE AND FINANCIAL RESOURCES

Art. 28. They constitute the patrimony of CAPES:

I-the movable and immovable property, installations and rights, transferred in the form of the art. 3rd of the Law no 8,405, of 1992; and

II-the movable and immovable property that comes to acquire, including by donations and legacies of natural or legal persons.

Art. 29. The financial resources of CAPES come from:

I-appropriations consigned to the Act Union budget;

II-aid and grants awarded by entities of law public or private law;

III-renown of any species produced by their goods or activities;

IV-contributions from domestic, foreign entities or international;

V-financial balances of the exercises; and

VI-other eventual rends.

Art. 30. The patrimony and resources of CAPES will be used, exclusively, in the execution of its purposes.

CHAPTER VIII

DAS GENERAL PROVISIONS

Art. 31. CAPES will send annually to the Minister of State for Education the general accounts relating to the previous financial year, accompanied by report of activities, obeyed to the deadlines set out in the legislation in force.

Art. 32. CAPES will be able to carry out credit operations with domestic, foreign or international entities, observed the prevailing standards on matter, conditional on the approval of the Higher Council.

Art. 33. CAPES will be able to hire with national, foreign or international public and international entities the execution of the services that necessitate the performance of their duties, in the framework of the execution of actions linked to the development of Science and Technology, observed the incisos XIV, XXI and XXV of the art. 24 of Law No. 8,666 of June 21, 1993.

Art. 34. The standards of organization and operation of the administrative units of CAPES and the assignments of its leaders shall be established in internal regiment, proposed by its President and submitted to the approval of the Minister of State for Education.

Art. 35. The missing cases and the doubts raised in the application of this Statute shall be addressed by the President of CAPES ad referendum of the Minister of State for Education.
