DECREE OF August 28, 2007.

Declara of social interest, for purposes of agrarian reform, the rural real estate named?Farm Azedem?, situated in the Municipality of Carira, State of Sergipe, and gives other arrangements. The PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, 184 and 186, inciso I, of the Constitution, and in the terms of the arts. 2º of the Supplemental Act No. 76, of July 6, 1993, 18 and 20 of Law No. 4,504 of November 30, 1964, and 2º and 9º, inciso I, of Law No. 8,629, of February 25, 1993,

DECRETA:

Art. 1st Is declared of social interest, for purposes of agrarian reform, the rural real estate named?Farm Azedem?, with area of two hundred and eleven hectares and sixty ares, situated in the Municipality of Carira, object of the Matriculation in the 4,569, fls. 89, Book 2-Q, of the Estate Registration Office of the 1º Oftice of the Comarch of Frei Paulo, State of Sergipe (Case INCRA/SR-23/nº 54370.001408 /2005-32).

Art. 2nd This Decree, regardless of discrimination or fundraising, does not hear any particular indennial effects, concerning areas of public domain consisting of law or registration and the private domain areas harvested by nullity, prescription, comb or ineffectiveness exclusively operated for the benefit of any legal person of public law, excepted good-faith benefiters in them previously to the science of the beginning of the administrative procedure, excluding still from their effects the semovens, machinery and agricultural implements and any benfeitory introduced by anyone who comes to benefit with their destination.

Art. 3rd The National Institute of Colonization and Agrarian reform-INCRA, attested to the private dominial legitimacy of the planimetry area, is allowed to promote the disappropriation of the rural real estate from which it treats this Decree, in the manner provided for in the Supplementary Act no 76, of July 6, 1993, and the hold the areas of Legal Reserve and permanent preservation provided for in Law No. 4,771, of September 15, 1965, preferentially in single gleba, so as to reconcile the settlement with the preservation of the environment.

Art. 4th This Decree goes into effect on the date of its publication.
