DECREE NO. 4,653, OF March 27, 2003.

Approves the Regimental Structure and the Demonstrative Framework of the Cargos in Commission and of the Gratified Functions of the Ministry of Tourism, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that gives him the art. 84, incisos IV and VI, paragraph "a" of the Constitution, and with a view to the provisions of the arts. 47 and 50 of the Provisional Measure No. 103, 1º January 2003,

DECRETA:

Art. 1º Stay approved the Regimental Structure and the Demonstrative Framework of the Cargos in Commission and Functions Gratified from the Ministry of Tourism, in the form of the Annexes I and II to this Decree.

Art. 2º In due to the provisions of the art. 1º, stay remanded, in the form of Annex III to this Decree, of the Management Office, of the Ministry of Planning, Budget and Management, arising from the reorganisation of the organs and entities of the federal Public Administration, to the Ministry of the Tourism the following posts in committee of the Group-Direction and Superiors Superiors-DAS and Gratified Functions-FG: two DAS 101.6; ten DAS 101.5; twenty-six DAS 101.4; twenty-five DAS 101.3; three DAS 101.2; four DAS 102.5; five DAS 102.4; two of the 102.3; twenty-five DAS 102.2; twenty-three DAS 102.1; five FG-1; five FG-2 and five FG-3.

Art. 3º The internal regiment of the Ministry of Tourism's bodies shall be approved by the Minister of State for Tourism and published in the Official Journal of the Union, within ninety days, counted from the date of publication of this Decree.

Art. 4º This Decree comes into effect on the date of its publication.

REGIMENTAL STRUCTURE OF THE MINISTRY OF TOURISM

CHAPTER I

OF THE NATURE AND COMPETENCY

Art. 1º The Ministry of Tourism, the body of direct administration, has as an area of competence the following subjects:

I-national development policy of the tourism;

II-promotion and dissemination of national tourism, in the Country and abroad;

III-stimulus to public and private initiatives to encourage tourism activities; and

IV-planning, coordination, supervision and evaluation of the tourism incentive plans and programs.

CHAPTER II

OF THE ORGANIZATIONAL STRUCTURE

Art. 2º The Ministry of Tourism has the following Organizational Structure:

I- direct and immediate assistance bodies to the Minister of State:

a) Cabinet;

b) Executive Secretariat: Subsecretariat of Planning, Budget and Administration; and

c) Legal Consulting;

II-specific organs:

a) Office of Tourism Policies:

1. Department of Tourism Planning and Evaluation;

2. Department of Institutional Relations; and

3. Department of International Relations;

b) Secretary of Tourism Development Programs:

1. Department of Regional Development Programs;

2. Department of Promotion of Investments in Tourism; and

3. Department of Production Associated with Tourism;

III-collegiate body: National Tourist Board-CNT; and

IV-linked entity: EMBRATUR-Brazilian Institute of Tourism.

CHAPTER III

OF THE COMPETENCY OF THE ORGANS

Section I

Of The Direct and Immediate Assistance Bodies to the Minister of State

Art. 3º To the Chief Minister's Office compete:

I-attend the Minister of State in his political and social representation, occupy himself with the public relations and the preparer and dispatch of his personal expedient;

II-promote the articulation between the Ministry and the organs that make up the Presidency of the Republic;

III-provide for the fulfillment of the consultations and the requirements formulated by the Congress National and follow up on the progress of the projects, in tramway, of ministerial interest;

IV-provide for the official publication and dissemination of the subjects related to the Ministry's area of acting; and

V-plan, coordinate and supervise the development of the Ministry's media activities.

Art. 4º To the Executive Secretariat competes:

I- attend the Minister of State in the supervision and coordination of the activities of the integral Secretaries of the Ministry's structure;

II-overseeing and coordinating the execution of the activities related to the Systems Federal Planning and Budget Officer, Financial Administration, Accounting, Organization and Administrative Modernization, Administration of Information and Informatics Resources, Civil Personnel and General Services, in the framework of the Ministry; and

III-assist the Minister of State in the setting of the guidelines and the implementation of the policies and actions of the Ministry's area of competence.

Single paragraph. The Executive Office, still, the role of the sectoral body of the Civil Personnel Systems of the Federal Administration-SIPEC, of Organization and Administrative Modernization-SOMAD, of Information Resources Administration and Informatics-SISP, of General-SISG, Planning and Federal Budget and Accounting Services, through the Subsecretariat of Planning, Budget and Administration, to her subordinate.

Art. 5º À Subsecretariat of Planning, Budget and Administration competes:

I-plan, coordinate and supervise the execution of the activities related to the Federal Planning and Budget Systems, of Financial Administration of Organisation and Administrative Modernization, Accounting, Information and Informatics, Human Resources and General Services, within the Ministry;

II-promoting articulation with the central bodies of systems federal, referred to in the previous inciso and inform and guide the organs of the Ministry as to the compliance with established administrative standards;

III-promote and coordinate the drafting and consolidation of the plans and programs of the activities of your area of competence and submit them to the top decision;

IV-develop the activities of budgetary, financial and accounting execution, within the Ministry;

V-analyse and evaluate the benefits of accounts, partial or final, as to its technical and financial aspects, proposing to initiate special accounts and other measures of their competence when the accountability is not passed, after exauriating the enforceable arrangements; and

VI-carry out taken care of the expense payers and too many responsible for public goods and values and of all the one that gives cause to loss, stray or other irregularity that results in damage to the erarium.

Art. 6º À Legal Consulting, the sectoral body of Advocate General of the Union, competes:

I-advise the Minister of State in matters of a legal nature;

II-exercise the coordination of the legal activities of the Ministry and the entity to it bound;

III-fixing the interpretation of the Constitution, laws, treaties, and the remaining normative acts to be uniformly followed in their areas of acting and coordination, when there is no normative orientation of the Union Advocate General;

IV-elaborate studies and prepare information, by request of the Minister of State;

V-assist the Minister of State in the internal control of the administrative legality, of the acts by him practiced or already effective and of those arising from organs or entities under his coordination;

VI-examine, prior and conclusively, within the Ministry:

a) the texts of bidding editions, as well as those of the respective congenneric contracts or instruments, to be published and celebrated;

b) the acts by which it is going to recognize the undemanding or decide the bidding dispensation; and

c) proposals, studies, projects, anteprojects, and minutesof normative acts of interest of the Ministry.

Section II

From the Singular Specific Bodies

Art. 7º To the Registry of Tourism Policies competes:

I- to subsidize the formulation, elaboration and monitor the National Tourism Policy, in accordance with the proposed guidelines and subsidies provided by the National Tourism Board, as well as evaluate its implementation;

II- coordinating the drafting of the National Tourism Plan;

III-designing tools and proposing standards for the implementation of the National Tourism Policy;

IV-subsidize the formulation, the drawing up and evaluating the plans, programmes and ministerial actions necessary to achieve the National Tourism Policy;

V-designing guidelines for the formulation of studies, research, analysis and withdrawals from data aimed at the formulation, implementation and evaluation of the National Tourism Policy;

VI-perform the functions of the National Tourism Council's Secretariat-Executive;

VII- to guide the surveying and structuring of tourism indicators, with the purpose of monitoring the dynamics of the national and international tourism market and subsidizing the evaluation of the implementation of the National Tourism Policy;

VIII-acting, participate and articulate with national and international bodies and instances, aiming at the development of national tourism;

IX-promoting cooperation and articulation with the organs of the federal, state, federal and municipal Public Administration in projects of its initiatives that could contribute to the strengthening and development of national tourism; and

X-articular with the too many government bodies and public administration entities in its programs, projects and actions that have interface with the National Tourism Policy.

Art. 8º To the Department of Tourism Planning and Assessment competes:

I-plan, coordinate and evaluate the National Tourism Policy;

II- coordinating the drafting and evaluation of the National Tourism Plan;

III-elaborating the tools and standards aimed at the implementation of the National Tourism Policy;

IV-undertake studies, research, analyses and withdrawals of data and indicators necessary for the formulation, implementation and evaluation of National Tourism Policy;

V-follow up on the dynamics of the national and international tourist market with seen to subsidize the formulation and evaluation of the National Tourism Policy; and

VI-secretariats the National Tourism Board.

Art. 9º To The Department of Institutional Relations compete:

I-coordinate and exercise the articulation with the remaining bodies and entities of the public and non-government administration in their programs, projects and actions that have interface with the National Policy of Tourism;

II-coordinate and exercise cooperation and articulation with the organs of the federal, state, Federal and Municipal Public Administration in projects of their initiatives that can contribute to the strengthening and development of national tourism;

III-supporting the planning of programs and projects within the framework of the Administration of States, Federal District, of Municipalities and of micro-regions that contribute to the strengthening and local sustainable development by the increment of tourism activity; and

IV-promoting the integration of the Ministry's programs and actions with its linked entity.

Art. 10. The Department of International Tourism Relations competes:

I-support, plan, coordinate and follow up the Ministry of Tourism's performance and participation in forums and international bodies of interest of the national tourism;

II-support, plan, coordinate and follow up on the conclusion of international technical cooperation agreements and instruments;

III-support, plan, coordinate and follow up with acting by the Ministry in the negotiations of bilateral, regional and multilateral trade agreements, with the purposes of strengthening national tourism on the international stage; and

IV-support, plan, coordinate and follow up the articulation with the remaining bodies and governmental institutions with acting on the international stage.

Art. 11. The Office of Tourism Development Programs competes:

I-subsidize the formulation of the plans, programs and actions aimed at the development and strengthening of national tourism, necessary for the achievement of the National Tourism Policy;

II-subsidize the formulation and follow up the regional tourism development programmes and the promotion of technical, institutional and financial support necessary to strengthen the implementation and participation of states, the Federal District and the Municipalities, in these programs;

III-subsidize the development of plans, projects and actions for the catchment and stimulation of national private investments and international, in line with the guidelines of the National Tourism Policy;

IV-promoting the cooperation and articulation of the tools of the Public Administration for funding, support and promotion of activity sightseeing; and

V-coordinate, supervise and evaluate the tourism incentive plans and programs.

Art. 12. To the Department of Regional Tourism Development Programs competes:

I-subsidize the formulation, coordinate, support and follow up the regional tourism development programs, which aim to benefit the local populations and the increment of income generated by national and international tourism;

II-subsidize the formulation, coordinate, support and follow up with the promotion of the technical, institutional and financial support required by the strengthening the implementation and participation of states, the Federal District and the Municipalities, in these programs;

III-subsidize the formulation, coordinate, support and follow up the appropriate institutional and financial structure for the implementation of the regional tourism development programmes;

IV-subsidize the formulation, coordinate, support and follow up with the Ministry's responsive resource aport, in accordance with the guidelines and the funding matrix of each program; and

V-coordinate and follow up the integration of the actions of your competency with EMBRATUR.

Art. 13. To the Department of Financing and Promotion of Investments in Tourism competes:

I-subsidize the formulation, coordinate, support and follow up the stimulus actions and foster the mobilization of the private, national and international, for its active participation in the implementation of the National Tourism Policy;

II-subsidize the formulation, coordinate, support and follow up on the development of plans, projects and events that object to capturing and stimulation of national and international investments, in actions integrated with the guidelines and in the regions benefited by tourism development programmes;

III-subsidize the formulation, coordinate, support and follow up on the development, maintenance and promotion of projects and investment opportunities;

IV-subsidize the formulation, coordinate, support and follow up development, together with institutions financial lines and other financial instruments, aimed at financing the tourist and the companies of the productive chain of tourism; and

V-coordinate and follow up the integration of the shares of its competence with EMBRATUR.

Art. 14. The Department of Capaciation and Production Associated with Tourism competes:

I-format and implement the plans, programs and actions aimed at the development of the artisanal production and too many products associated with the tourism;

II-coordinate the actions aimed at the promotion and commercialization of the artisanal production and too much products associated with tourism;

III-format and implement the programs and actions aimed at the development of professional capacity-building; and

IV-coordinate actions aimed at professional empowerment and improvement of the quality of services provided to the tourist.

Section III

Of The Collegiate Body

Art. 15. The National Board of Tourism, created by art. 27 of the Provisional Measure No. 2.216-37 of August 31, 2001, it is to exercise the competences set out in specific regulation.

CHAPTER IV

OF THE ASSIGNMENTS OF THE LEADERS

Section I

From the Executive Secretary

Art. 16. The Executive Secretary is to:

I-coordinate, consolidate and submit to the Minister of State the planning of the Ministry's overall action, in consonance with the guidelines of the Federal Government;

II-supervise and evaluate the execution of the Ministry's projects and activities;

III-supervise and coordinate the articulation of the Ministry's organs with the central bodies of the systems affected to the area of competence of the Secretariat-Executive;

IV-supervise and coordinate the integral Secretaries of the Ministry's structure; and

VI-exercise other assignments that are committed to it by the Minister of State.

Section II

Of The Secretaries and Too many Leaders

Art. 17. To the Secretaries, the Chief Minister's Office, the Legal Adviser, the Undersecretary, the Directors and the other leaders it is incumbent on planning, directing, coordinating and directing the implementation of the activities of the respective bodies or units and to exercise other assignments that are committed to them in their areas of competence.

CHAPTER V

OF THE GENERAL PROVISIONS

Art. 18. The internal regiment shall define the detailing of the integral bodies of the Regimental Structure of the Ministry of Tourism, the competences of the respective units and the assignments of their leaders.
