DECREE OF December 29, 2008.

Gives new essay to § § 1^o, 2^o, 3^o and 4^o of the art. 1^o of the Decree of January 7, 2008, which declares of public utility, for the purposes of dispropriation, total or partial, or of administrative servitude institution, in favor of the Brazilian Oil S.A. -PETROBRÁS, the real estate it mentions, situated in the State of Rio de Janeiro, necessary for the construction of the Píer Gas pipeline of LNG-Fields Elyseos, as well as from its complementary facilities, and gives other arrangements.

The PRESIDENT OF THE REPUBLIC, in the use of the attribution that confers him the art. 84, inciso IV, of the Constitution, with a view to the provisions of the art. 8^o, inciso VIII, of the Law n^o 9,478, of August 6, 1997, in the Decree-Law n^o 3,365, of June 21, 1941, in the Decree-Law n^o 1,075, of January 22, 1970, and what is stated in the ANP Processes n^o 48610.013381 /2007-11 and MME n^o 48000.0003067 /2007-15,

DECRETA:

Art. 1^o The § § 1^o, 2^o, 3^o , and 4^o of art. 1^o of the Decree of January 7, 2008, which declares of public utility, for the purposes of dispropriation, total or partial, or of administrative servitude institution, in favor of the Brazilian Oil S.A. -PETROBRÁS, the real estate that mentions, located in the State of Rio de Janeiro, necessary for the construction of the Píer Gas pipeline of LNG-Campos Elíseos, as well as from its complementary facilities, go on to invigorate with the following essay:

§ 4^o The strip of land which refers to the caput of this article, situated in the State of Rio de Janeiro, intended for the construction of the SDV-02 Valve, thus describes and characterizes: land area of nine thousand square meters, situated in the Municipality of Magé, in the State of Rio of January, by limiting to the perimeter which has start at point Pc-01, of coordinates N=7.486.684, 14 and E=684.924, 29; of this point, with general south-east and distance of 100m, comes to point Pc-02, of coordinates N=7.486.584, 96 and E=684.911, 48; of this point, with general direction northeast and distance of 90 m, comes to point Pc-03, of coordinates N=7.486.573, 43 and E=685.000, 74; of this point, with general direction northwest and distance of 100 m, comes to the point Pc-04, of coordinates N=7.486.672, 60 and E=685.013,55; of this point, with general direction south-west and distance of 90m, comes to the point Pc-01, of coordinates N=7.486.684, 14 and E=684.924, 29. Art. 2^o Ficam convalidated the arrangements realized on the basis of the Decree of January 7, 2008, as referred to in art. 1^o, compatible with the coordinates held in this Decree.

Art. 3^o This Decree comes into effect on the date of its publication.

Art. 4^the It is revoked the § 5^o of the art. 1^o of the Decree of January 7, 2008, which declares of public utility, for the purposes of dispropriation, total or partial, or of administrative servitude institution, in favor of the Brazilian Oil S.A. -PETROBRÁS, the real estate it mentions, situated in the State of Rio de Janeiro, necessary for the construction of the Píer Gas pipeline of LNG-Elytic Fields, as well as from its complementary facilities.
