Decree No. 5376 of 17 FEBRUARY 2005 on the National System of Civil Defense-SINDEC and the National Council of Civil Defense, and other matters.
The PRESIDENT of the REPUBLIC, in the use of the role that gives the art. 84, item VI, item "a", and in view of the provisions of art. 21, subparagraph XVIII of the Constitution, DECREES: Art. first the organs and entities of the federal public administration, the States, the Federal District and the Municipalities, private entities and the community, responsible for civil defence actions throughout the national territory, shall constitute the National System of Civil Defense-SINDEC, under the coordination of the National Civil Defense Secretariat, the Ministry of national integration.
Art. 2nd civil defense actions are articulated by the SINDEC and aim, above all, to disaster reduction, including the following aspects: (I) global-disaster prevention;
II-preparing for emergencies and disasters;
III-the response to disasters;
IV-the reconstruction and recovery.
Art. 3 for the purposes of this Decree: I-civil defense: the set of preventive actions, for help, assistance and recuperativas designed to prevent or minimize disasters, preserve the morale of the population and re-establish normalcy;
II-disaster: the result of adverse events, whether natural or caused by man on a vulnerable ecosystem, causing damage to human, material or consequential economic losses and environmental and social aspects;
III-emergency situation: the recognition by the Government of abnormal situation caused by disasters causing damage surmountable by the affected community;
IV-State of public calamity: the recognition by the Government of abnormal situation caused by disasters, causing serious damage to the affected community, including the safety or life of its members.
Art. 4 the SINDEC aims: I-plan and promote permanent defense against natural disasters, anthropogenic and mixed, most prevalent in the country;
II-conduct studies, assess and reduce disaster risks;
III-Act on the verge and in disaster circumstances;
IV-to prevent or minimise damage, help and assist affected populations, and to rehabilitate and recover the scenarios of disasters;
V-to promote and coordinate joint SINDEC agencies throughout the national territory.
Art. 5 of the top organ SINDEC: I-: the National Council of Civil Defense-CONDEC, responsible for the formulation and resolution of system policies and guidelines;
II-central body: the National Civil Defense Secretariat, responsible for the coordination, coordination and technical supervision of the system;
III-regional bodies: the Regional Civil defence company departments-CORDEC, or corresponding organs, located in the five macroregions of Brazil geographical and responsible for the articulation and coordination of regional level System;
IV-State organs: State Civil Defense company departments-CEDEC or corresponding bodies, coordination of the Federal District Civil Defense or corresponding body, including its regional, responsible for the articulation and coordination of the system at the State level;
V-agencies: Municipal Civil Defense-company departments-COMDEC or corresponding bodies and Civil Defence Community Cores-NUDEC, or the corresponding entities responsible for the articulation and coordination of municipal-level System;
VI-sector bodies: the organs of public administration federal, State, municipal and Federal District, working with the coordination bodies, with the aim of ensuring systemic action;
VII-supporting agencies: public agencies and private entities, voluntary associations, service clubs, and non-governmental organizations and community associations, who support the other agencies taking part in the system.
Art. 6. The National Council of Civil Defense-CONDEC, collegial body of normative character, Member of the Advisory and deliberative regimental structure of the Ministry of national integration, aims at the formulation and deliberation of governmental guidelines on civil defence, and competence: I-approve policies and procedures for coordination of federal actions with the Federal District, States and municipalities as well as the cooperation of private entities, with a view to the coordinated action of the civil defence activities;
II-approve and update the national civil defense policy and the guidelines for governmental action, relating to the subject;
III-recommend to the various organs of SINDEC priority actions that can prevent or minimize natural disasters or manmade;
IV. approve the criteria for declaration, the approval and recognition of emergency situation or State of public calamity;
V-approve global and sectoral plans and programmes prepared by the SINDEC;
VI-deliberate on the actions of international or foreign cooperation of SINDEC's interest, in compliance with the regulations in force;
VII – approve the creation of interinstitutional technical committees to conduct studies, research and specialized work, of interest of civil defence;
VIII-designate emergency working institutions aiming to articulate and expedite Federal actions in disaster situations of great intensity;
IX-approve technical criteria for review and approval of works and services, aimed at preventing risks, minimize damage and recover damaged areas by disasters;
X-to elaborate the internal regulations, which shall have on your operation as well as propose amendments;
XI-submit bylaws to approval of the Minister of State for national integration.
Art. 7 the CONDEC consists of: I-House;
III-Technical Committees and working groups.
Sole paragraph. The Technical Committees and working groups shall be established by the Chairman of CONDEC, in order to promote studies and preparation of proposals on specific issues, to be submitted to the plenary of the Council composition, setting at the time of its creation the specific objectives, composition and deadline for completion of the work.
Art. 8 the plenary of CONDEC will be chaired by the National Secretary of Civil Defense at the Ministry of national integration and will be composed of one representative of each organ below: I-Ministry of Justice;
II-Ministry of defence;
III-Ministry of Foreign Affairs;
IV-Ministry of finance;
V-Ministry of transport;
VI-Ministry of agriculture, livestock and food supply;
VII. Ministry of education;
VIII-Ministry of culture;
IX-Ministry of labor and employment;
X-Ministry of Social development and hunger alleviation;
XI-Ministry of health;
XII-Ministry of development, industry and foreign trade;
XIII-Ministry of mines and energy;
XIV-Ministry of planning, budget and management;
XV-Ministry of communications;
XVI-Ministry of science and technology;
XVII-Ministry of environment;
XVIII-Ministry of sport;
XIX-Ministry of tourism;
XX-Ministry of national integration;
XXI-Ministry of agrarian development;
XXII-Ministry of cities;
XXIII-Ministry of Social Welfare;
XXIV-Casa Civil da Presidência da República;
XXV-the institutional security cabinet of the Presidency of the Republic;
XXVI-secretariat of political coordination and institutional affairs of the Presidency of the Republic;
XXVII-Secretary of Government communication and strategic management of the Presidency of the Republic;
(1) the members of CONDEC, holders and alternates shall be appointed by the Minister of State for national integration, by indication of the bodies represented.
§ 2 the CONDEC shall meet in ordinary character at least once a year and, extraordinarily, whenever called by its Chairman, either on his own initiative or at the request of one third of its members.
(3) on the basis of urgency, the President of CONDEC may deliberate ad referendum of the Board.
Art. 9 the Advisory Committee, Advisory Unit to CONDEC, will be integrated by holders: I-civil defence regional bodies;
II-civil defense State organs;
III-civil defense organs of the Federal District.
Art. 10. The National Civil Defense Secretariat, acting as the central organ SINDEC, shall: (I)-to promote and coordinate the actions of civil defense, articulating and integrating SINDEC's organs at all levels;
II-standardize, monitor and guide the actions developed by the members of SINDEC;
III. promote, in conjunction with the States, Municipalities and the Federal District, the Organization and the implementation of the COMDECs, or corresponding bodies, and of the NUDECs, or the corresponding entities;
IV-set priority areas for investments that contribute to minimize the vulnerabilities of the municipalities, States, the Federal District and of the country's geographical macro-regions;
V-to promote studies on the causes and possibilities of occurrence of disaster from any source, its incidence, extent and consequence;
VI-systematize and integrate information within the SINDEC;
VII-prepare, update and propose to CONDEC national civil defense policy and the guidelines of the Government action in the area of civil protection, as well as promote their implementation;
VIII to consolidate and reconcile overall plans and programmes, sectoral and regional policies, and guidelines of the Government civil defense action;
IX-keep the Disaster support group, formed by a multidisciplinary technical team, which at any time, to act in critical situations, at the request of States, Municipalities and the Federal District;
X-develop and implement contingency plans of civil defense, as well as projects related to the subject, in its sphere of activity;
XI-run training program for civil defence resources and supporting the States, Federal District and Municipalities in these activities;
XII-encouraging, at the national level, the development of human resources in civil defense;
XIII-to encourage the deployment of University Centers of teaching and research on disasters-CEPED or multidisciplinary centers intended for research, extension and training of human resources with a view to managing and execution of civil defence activities;
XIV-to create working groups with the aim of providing the necessary technical support to the agencies or entities acting in the area of civil defense;
XV-propose to CONDEC criteria for the Declaration, the approval and recognition of emergency situation or State of public calamity;
XVI-an opinion on reports and applications relating to the recognition of the State of emergency and the State of public calamity;
XVII-to propose to the Minister of State for National integration, the recognition of emergency situation or State of public calamity, according to the criteria established by CONDEC;
XVIII-provide technical and administrative support to the Board and Deliberative CONDEC of the Special Fund for Public Disasters-FUNCAP, created by Decree-Law No. 950, 13 October 1969;
XIX-participate in the Protection system to the Brazilian Nuclear Program-SIPRON, in the form of Decree-Law No. 1809 of October 7, 1980, and companion legislation;
XX-deploy and operationalize the National Disaster and risk management-CENAD, and promote the consolidation and interconnection of information risks and disasters within the framework of SINDEC;
XXI-promote and guide technically municipalities, in conjunction with the States and the Federal District, the Organization and the implementation of operational commands to be used as a management tool to command, control, and coordinate emergency actions in disaster circumstances;
XXII-deploy and implement Disaster information systems in Brazil-SINDESB, the disaster monitoring system, the early warning system and disaster Alarm, the Disaster response system, the system of Aid and assistance to the population and the system of Prevention and reconstruction, under the SINDEC, and encourage the creation and interconnection of centers of operations in its three levels;
XXIII-propose technical criteria for review and approval of works and services aimed at preventing risks, minimize damage and recover damaged areas by disasters;
XXIV-give priority to support for preventive actions and the other related to the minimization of disasters;
XXV-participate in collegiate bodies dealing with the implementation of measures related to the protection of the population, preventive and in case of disasters, including nuclear accident;
XXVI-promote technical exchange among governmental bodies and international civil defense, participating as a Member representative of the Brazilian Civil Defense.
Sole paragraph. The National Civil Defense Secretariat will be responsible for providing administrative support and the necessary resources for the implementation of the work of the Secretariat and its committees CONDEC and workgroups.
Art. 11. regional bodies shall: (I)-coordinate, guide and assess, on a regional level, the actions developed by the members of SINDEC;
II-conduct studies about the possibility of disaster in any source, its incidence, extent and consequence;
III-keep up-to-date and available information related to civil defense;
IV-to coordinate the preparation and implementation of civil defence plans, contingency plans and operations plans, as well as projects related to the subject;
V-to facilitate and consolidate the plans and State programs of civil defense, for the preparation of regional plans;
VI-to support the human resources training activities directed at civil defense actions;
VII-to support the distribution and control of supplies to people affected by disasters, in conjunction with members of SINDEC assistance;
VIII-to encourage the implementation of COMDECs, or corresponding bodies, and NUDECs, or corresponding entities;
IX-promote in the municipalities, in conjunction with the States and the Federal District, the Organization and the implementation of operational commands to be used as a management tool to command, control, and coordinate emergency actions in disaster circumstances;
X-participate in the systems art. 22 and foster the establishment and interconnection of operational centres;
XI-give priority to support for preventive actions and the other related to the minimization of disasters.
Art. 12. State agencies and the Federal District shall: I-articulate, coordinate and manage the actions of civil defense at the State level;
II-keep up-to-date and available information related to civil defense;
III-to elaborate and implement civil defense plans, contingency plans and operations, as well as programs and projects related to the subject;
IV-to provide budgetary resources necessary to the actions themselves, recovery or preventive social assistance, in return for the transfer of resources of the Union, in accordance with the legislation in force;
V-empower human resources for civil protection actions;
VI-promote the inclusion of the principles of civil defence in the public school curricula and in the Federal District and fundamental, providing all the support to the teaching community in the development of educational material-didactic to that end;
VII-keep SEDEC and CORDEC, or corresponding body informed of occurrences of disasters and civil defence activities;
VIII-to propose to the competent authority the approval of emergency situation and State of public calamity, according to criteria established by CONDEC and, in exceptional cases, CONDEC, defined its Declaration;
IX-to support the collection, distribution, and control of the necessary supplies to the supply of the population concerned in disaster situation;
X-promote and support the implementation and operation of the COMDECs, or corresponding bodies, and of the NUDECs, or the corresponding entities;
XI-to promote in the municipalities and the Federal District, in conjunction with the COMDECs, or corresponding organs, the Organization and the implementation of operational commands to be used as a management tool to command, control, and coordinate emergency actions in disaster circumstances;
XII-empowering and supporting the municipalities and the Federal District to carry out the assessment of damages and losses in areas struck by disasters;
XIII-participate in the systems art. 22 and foster the establishment and interconnection of operational centres;
XIV-guide the surveys of risk areas, intervene or recommend preventive intervention, the isolation and the evacuation of the population of vulnerable buildings and areas;
XV-perform simulated exercises for team training and improvement of the contingency plans;
XVI-give priority to support for preventive actions and to minimize related disasters.
(1) the State civil defense agency may create the State Civil Defense Regional-REDECORATING as an integral part of its structure and establish their assignments in order to articulate and coordinate civil defense actions in all the municipalities that constitute their practice areas.
(2) a Member State may exercise, on its jurisdiction, control and supervision of activities capable of causing disasters.
Art. 13. At COMDECs, or corresponding organs, shall:
I-articulate, coordinate and manage civil defense actions in municipal level;
II-promoting the broad participation of the community in civil defense actions, especially in planning activities and actions of responses to disasters and reconstruction;
III. develop and implement plans, contingency plans and plans for civil defence operations, as well as projects related to the subject;
IV-to elaborate the annual action plan, aiming at the service real-time actions of normality, as well as in emergency situations, with the guarantee of resources from municipal budget;
V-to provide budgetary resources necessary to the actions themselves related to disaster reduction and with the re-establishment of the situation of normality, to be used as consideration for the transfer of Union and Member State resources, in accordance with the legislation in force;
I saw train human resources for the civil defense actions and promote the development of voluntary associations, seeking to articulate, at maximum, joint activities with communities supported;
VII-promote the inclusion of the principles of civil defense, in school curricula of municipal high school and junior high, providing all the support to the teaching community in the development of educational material-didactic to that end;
VIII-inspect buildings and areas of risk and promote or articulate the preventive intervention, the isolation and the evacuation of the population of risk areas intensified and the vulnerable buildings;
IX-deploy databases and prepare thematic maps on multiple threats, vulnerabilities and mobiliamento, risk level and related resources and equipment available to the operations support;
X-analyze and recommend the inclusion of risk areas in the strategic plan established by paragraph 1 of art. 182 of the Constitution;
XI-keep the State civil defense Agency and the National Civil Defense Secretariat reported on the occurrence of disasters and on civil defence activities;
XII-perform simulated exercises, with the participation of the population, for the teams training and improvement of the contingency plans;
XIII-to assess damage and losses of the disaster-hit areas, and the completion of forms of Preliminary Notification-NOPRED disaster and damage assessment-AVADAN;
XIV-to propose to the competent authority in the decreeing of emergency situation or State of public calamity, according to the criteria established by CONDEC;
XV-periodically inspect sites and suitable for temporary shelters, providing the relevant information to the population;
XVI-run collection, distribution and control of supplies in disaster situations;
XVII-planning the Organization and administration of temporary shelters for population assistance in disaster situation;
XVIII-participate in the systems art. 22, promote the creation and interconnection of operational centres and increase the activities of monitoring, alert and alarm, with the goal of optimizing the disaster forecast;
XIX-promoting community mobilization and deployment of NUDECs, or corresponding entities, especially at primary and secondary level schools and areas of intensified risks and deploy volunteer training programs;
XX-implement operational commands to be used as a management tool to command, control, and coordinate emergency actions in disaster circumstances;
XXI-link up with the State Civil Defense Regional-or corresponding organs REDECORATING, and participate actively in the plans of mutual support PAM, in accordance with the principle of mutual assistance between the municipalities.
§ 1 the municipal civil defense agency may create Civil Defence District, or corresponding organs, as an integral part of its structure and establish its mission, in order to articulate and execute civil defense actions in specific areas in districts, neighborhoods or localities of the Municipality.
§ 2 the municipalities may exercise, on its jurisdiction, control and supervision of activities capable of causing disasters.
Art. 14. The NUDECs, or the corresponding entities, work as centers of meetings and debates between the-COMDEC and local communities and plan, promote and coordinate civil defence activities, with emphasis on: i. the disaster risk assessment and preparation of thematic maps related to the threats, vulnerabilities and scenarios with the intensified risk areas;
II-promoting structural preventive measures and non-structural, with the aim of reducing the risks of disasters;
III-the preparation of contingency plans and operations, with the objective of responding to disasters and simulated exercises, to improve them;
IV-the training of volunteers and technical teams to work in disaster circumstances;
V-joint with monitoring, alert and alarm, with the goal of optimizing the disaster forecast; and I saw the Organization of calling plans, aiming to optimize the alert status on the verge of disaster.
Art. 15. The sectoral organs, at the federal level, through their secretariats, entities and organs linked, and in conjunction with the central body of SINDEC, plus other activities in accordance with their legal skills, fit: I-to the Ministry of Justice, coordinating the actions of the National System of Public Security and the activities of the Federal Police, aiming at the preservation of public order , the safety of people and property in areas of disaster situation;
II-the Ministry of Defense, coordinate combined operations of Natural Forces in the civil defense actions;
III-the Ministry of Foreign Affairs, coordinating the actions involving the relationship with other countries and with international organizations and foreign cooperation logistics, financial, scientific and technical and joint participation in civil defence activities;
IV-the Ministry of finance, adopt measures of financial, fiscal and credit character, intended for the care of populations in areas in a State of public calamity or emergency situation;
V-the Ministry of transport, adopt measures for the preservation and rehabilitation of road systems and land transport terminals, sea and river, in areas struck by disasters, as well as control the transportation of dangerous goods;
I saw the Ministry of agriculture, livestock and food supply, promoting preventive actions related to disasters caused especially by plant and animal pests; adopt measures for the care of populations in areas affected by disasters, providing the distribution of seeds and food supplies; provide data and analyses relating to weather forecasts and climate change, with civil defense actions;
VII-to the Ministry of education, to cooperate with the human resources development programme and disseminate, through the networks of formal and informal education, educational content relating to disaster prevention and civil defense and, through the Federal universities, conduct and disseminate research in seismic SINDEC's interest;
VIII-the Ministry of culture, promote the development of the sense of risk perception in the brazilian population and contribute to the growth of cultural change related to disaster reduction;
IX-to the Ministry of labor and employment, promote actions that aim to prevent or minimize work-related accidents and harm to workers in disaster circumstances;
X-to the Ministry of Social development and fight against hunger, social assistance to the populations in disaster situation and support them with supplies needed for survival, especially food;
XI-to the Ministry of health, implement and oversee public health actions, the supply of medicines, water quality control and food and health promotion in disaster circumstances; promote the deployment of pre-hospital care and emergency units, oversee the preparation and mobilization plans of hospitals in disaster circumstances; and disseminate, in community level basic cardiopulmonary resuscitation techniques and first aid;
XII-the Ministry of development, industry and foreign trade, propose measures to minimize damages that disaster situations may cause the national productive means and participate actively in the prevention of human disasters technological in nature;
XIII-the Ministry of mines and energy, to plan and promote the reduction of environmental degradation caused by the mining and prospecting, monitoring hydrological conditions and the deflúvios of the dams of hydroelectric systems and river basin management;
XIV-to the Ministry of planning, budget and management, give priority to the allocation of resources for population assistance and the execution of works and services of prevention and recovery in disaster areas and in a State of public calamity or emergency situation;
XV-the Ministry of communications, adopt measures in order to ensure and give priority to telecommunication services in areas affected by disasters and to stimulate the involvement of the media in the activities of prevention and preparedness, as well as the mobilization of radio amateurs in disaster situation;
XVI-the Ministry of science and technology, develop research determining risk areas, as well as providing information for the guidance of the civil defense actions and analyses relating to weather forecasts;
XVII-the Ministry of the environment, establish standards, criteria and standards relating to the control and protection of the environment, the rational use of renewable natural resources with the objective of reducing disasters; provide data and analyses relating to the monitoring of rivers and dams, with views to the civil defense actions and promote the control of floods and floods;
XVIII-the Ministry of sport, increasing sports practices with the goal of reducing the vulnerabilities to human social nature disasters and risks related to the marginalized youth;
XIX-the Ministry of tourism, propose measures with the aim of reducing the negative impacts on the tourist activities in disaster circumstances;
XX-the Ministry of national integration, promote and coordinate the actions of SINDEC, through the National Civil Defense Secretariat, and to make the regional development plans with the prevention or minimization of damage caused in circumstances of disaster;
XXI-the Ministry of agrarian development, contribute to the reduction of human disasters in areas related to its activities;
XXII-the Ministry of cities, manage the application of resources in urban development policies aimed at the recovery and reconstruction of houses for the low-income population affected by disasters and in works and sanitation services in areas of risk;
XXIII-the Ministry of Social Security, support the suffering populations, in the context of its mission;
XXIV-the Civil House of the Presidency of the Republic, the support to surveys carried out by the Amazon monitoring system SIVAM;
XXV-the Cabinet of Institutional Security, support and information activities SINDEC other related tasks;
XXVI-the Secretariat of political coordination and institutional affairs, articulate the actions of the various powers and Government ranks in favor of SINDEC;
XXVII-the Secretariat Government communications and strategic management of the Presidency of the Republic, support the SINDEC in outreach activities;
XXVIII-the command of the army, cooperate with the actions of reconstruction and disaster response and search and rescue; participate in prevention and reconstruction activities; support the actions of civil defence personnel, material and means of transport;
XXIX-the Navy Command, coordinate the harm-reduction actions related to maritime and river claims and participate in the actions of rescue of shipwrecked; support disaster response actions, with hospitals, occurring in the Amazon River; support the actions of civil defence personnel, material and means of transport;
XXX-the Air Force Command, coordinate the actions of aeromedical evacuations and missions of mercy, cooperate in search and rescue actions; support the actions of civil defence personnel, material and means of transport.
§ 1 The Federal agencies located in the States and Municipalities are authorized to participate in the State and municipal level, SINDEC and make represent in their respective Advice, if requested by the competent authority.
§ 2 in the States and Municipalities, the sectoral bodies correspond to the federal level and will play civil defence activities according to their legal duties, in conjunction with the respective civil defense organs, ambits of their jurisdictions.
Art. 16. support bodies racing performance of specific tasks in line with their normal activities, subject to prior coordination with the coordination bodies of SINDEC.
Art. 17. The State of public calamity and the emergency situation, in compliance with the criteria established by CONDEC, will be declared by Decree of the Governor of the Federal District or the Mayor.
(1) the approval of the Act of Declaration of a State of public calamity or emergency situation, by Decree of the Governor of the State, is a condition of having legal effect within the State administration, and will occur when requested by the Mayor, who shall declare the municipal measures and actions already underway, its ability to act and human resources, materials, financial and institutional employees and not enough to the restoration of normalcy in the city.
(2) the Governor of the State may practice the Act of declaration reaching one or more Municipalities in disaster circumstances that may require immediate action in the sphere of administration.
(3) the Act of Declaration of a State of public calamity or emergency situation, by order of the Minister of State for national integration, is to have legal effect within the federal administration and will occur when requested by the State Government or the Federal District, which will declare the State measures and actions already underway, its ability to act and human resources , materials, financial and institutional employees and not enough to the restoration of normalcy in the municipalities.
§ 4 In exceptional cases, the Federal Government may issue the recognition, in the sight of the city Ordinance, before the State approval.
§ 5 In any case, the acts, approval and recognition and its extensions will be issued by the competent authorities, until they reach a maximum of 180 days.
paragraph 6 All these acts, will be technically justified by the competent civil defense, based on damage assessment attesting the abnormality or worsening of the previous situation, in the light of the criteria established by CONDEC.
Art. 18. In situations of disaster response and actions of reconstruction and recovery will be the responsibility of the Mayor or the Federal District.
(1) When the capacity of the municipal administration is proven to be employed, it is for the Government, State or federal, that confirm the State of public calamity or emergency situation, complementary activities of response to disasters and recovery and reconstruction, under their respective administrations.
(2) it will be up to public agencies located in the area reached the immediate implementation of the measures that are needed.
§ 3 the performance of federal, State and municipal agencies in the affected area will be in cooperation, and the-COMDEC or corresponding body, activate an immediate operational command to administer all actions and measures to respond to disaster, depending on their characteristics and complexity, unified command agreed between the entities involved with the disaster.
Art. 19. In cases of a State of public calamity, the State Minister of national integration can hire specialized technical personnel for the provision of any services in civil defense actions, subject to the provisions of the Act No. 8745, of 9 December 1993.
Art. 20. For the fulfilment of the responsibilities assigned to them in this Decree, the federal public agencies and entities members of SINDEC will use own resources budget appropriations specific object, which may be supplemented through the opening of extraordinary credit, in the form of art. 167, paragraph 3, of the Constitution.
Art. 21. The CENAD referred to in art. 10, subparagraph XX, you have the following skills: I-consolidate the information risks and disasters;
II-monitor the parameters of adverse events;
III-spread disaster alarm and alert and provide preventive guidance to the population;
IV-to coordinate the actions of responses to disasters; and V-mobilize resources for prompt response to occurrences of disasters.
Sole paragraph. The State organs, civil defense and municipal district will be able to create, within the framework of their administrations, with the same powers of CENAD, that will be connected to the central body for civil defence information network.
Art. 22. Constitute SINDEC instruments: I-Disaster information system in Brazil-SINDESB, which will allow the knowledge of occurrences of higher prevalence in the country, besides enabling the development of epidemiological studies, guiding the planning and facilitate the taking of decisions in the search for disaster reduction and its consequences;
II-disaster monitoring system, which will allow the sharing of information, the monitoring of parameters of the adverse events, in conjunction with predictive and prognostic organs of public administration federal, State and municipal levels;
III-early warning system and disaster Alarm, which will allow the issuance of bulletins in advance, resulting in timely decision-making, reduce response time, in anticipation of preventive measures and the rapid mobilization of resources to ready emergency;
IV-the Disaster response system, which will allow the prompt mobilization of State and Federal groups of responses to disasters, in addition to the allocation of resources for prompt response to emergency disasters;
V-Aid system and service to the population, which will guide the people hit by the disaster relief and protection measures, and coordinate efforts to allocate material resources to the aid of the homeless; and Prevention and reconstruction system, which will coordinate the studies of threats, vulnerabilities and risks, and the implementation of structural measures (engineering) both as preventive reconstruction, especially the relocation of families of risk areas affected by disasters, among others.
Art. 23. The arts. 2nd and 8 of Decree No. 1080, 8 March 1994, shall take effect as follows: Art. 2 the condition for the application of resources provided for in the actions set out in art. 1 of this Decree is the recognition of the State of public calamity or emergency situation by the Federal Government.
(1) the Act of Declaration of a State of public calamity or emergency situation, by order of the Minister of State for national integration, is to have legal effect within the federal administration, and will occur when requested by the State Government or the Federal District, which will declare the State measures and actions in progress, its ability to act and human resources , materials, financial and institutional employees and not enough to the restoration of normalcy in the municipalities.
(2) In exceptional cases, the Federal Government may issue the recognition, in the sight of the city Ordinance before the State approval. " (NR)
"Art. 8. In case of application of financial resources to the area in a State of public calamity or emergency situation, the Mayor may authorize expenditure ad referendum of the Deliberative Board, which will be justified within 72 hours. " (NR)
Art. 24. This Decree shall enter into force on the date of its publication.
Art. 25. Are revoked by Decree No. 895, 16 August 1993, and Decree No. 4980, of 4 February 2004.
