DECREE OF November 10, 2005.

Declares of social interest, for the purposes of agrarian reform, the rural real estate it mentions, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2nd of the Supplemental Act no 76, of July 6, 1993, 18 and 20 of the Law no 4,504, of November 30, 1964, and 2nd of Law no 8,629, of February 25, 1993,

DECRETA:

Art. 1º They are declared to be of social interest, for the purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of the Law no 4,504, of November 30, 1964, and 2nd of Law no 8,629, of February 25, 1993, the following rural real estate:

I-"Farm Imborés, Bela Vista and Santa Rosa", with a registered area of three thousand hectares, and measured area of three thousand, two hundred and thirty-seven hectares, eighty-seven ares and twelve centiars, situated in the Municipalities of Site do Mato and Santana, object of the Registry in the R-1-3.929, fls. 183, Book 2-M, of the Estate Registration Office of the Comarch of Good Jesus da Lapa, State of Bahia (Case INCRA/SR-05/no 54160.004991 /2004-28);

II-"Fazenda Santa Cecilia", with area of a thousand, three hundred and two hectares, eighty and one airs and thirty-three centiars, situated in the Municipality of Uruaçu, object of the Records in the R-3-8.232, Book 2; R-3-8.233, Book 2; R-6-1.795, Book 2; and R-3-9.151, Book 2, of the Estate Registration Office of the Comarch of Uruaçu, State of Goiás (Case INCRA/SR-04/no 54150.001575 /2004-97);

III-"Farm Ponderoza"-part, with area of a thousand and four hundred hectares, situated in the Municipality of Santa Luzia, object of the Registry in the R-2-2.240, fls. 82, Book 2-H, of the Carthorium of the 1st Oftice of the Comarch of Santa Luzia, State of the Maranhão (Process INCRA/SR-12/no 54230.000953 /98-61);

IV-"Fazenda Sao Raimundo", with area of a thousand, eighty and three hectares and twenty ares, situated in the Municipality of St. Matthew of the Maranhão, object of the Registry in the R-1-979, 48v, Book 2-F, from the Real-estate Registration Office of the 1st Offer of the Comarch of St. Matthew of the Maranhão, State of the Maranhão (Process INCRA/SR-12/no 54230.003619 /2004-23);

V-"Farm Santa Tereza", with area of two thousand, three hundred and fifty and one hectares, seven airs and ninety centiars, situated in the Municipality of Upper Bridge of the Tocantins, object of the Registry in the R-2-69, fls. 69, Book 2-B, from the Estate Registration Office of the High Bridge Comarch of the Tocantins, State of the Tocantins (Process INCRA/SR-26/no 54400.001043 /2005-41); and

VI-"Fazendas Santo Onofre and Santa Rosa", with area of two thousand, five hundred and two hectares, six ares and three centiars, situated in the Municipality of Upper Bridge of the Tocantins, object of the Registers in the R-2-327, fls. 67, Book 2-D; and R-2-323, fls. 63, Book 2-D, from the Estate Registration Office of the High Bridge Comarch of the Tocantins, State of the Tocantins (Process INCRA/SR-26/no 54400.001042 /2005-05).

Art. 2º Excludes from the effects of this Decree the soothing, the machines and agricultural implements, as well as the existing benfeons in the real estate referred to in the art. 1st and belonging to those who will be benefited from their intended purpose.

Art. 3º The National Institute of Colonization and Agrarian Reform-INCRA is allowed to promote the rural real estate dispropriations of which it treats this Decree, in the manner provided for in the Supplementary Act no 76, of July 6, 1993, and to maintain the areas of Reserva Legal and permanent preservation provided for in the Law no 4,771, of September 15, 1965, preferentially in single gleba, so as to reconcile the settlement with the preservation of the environment.

Art. 4º This Decree goes into effect on the date of its publication.
