DECREE NO. 6,372, OF February 14, 2008.

Approves the Regimental Structure and the Demonstrative Table of the Cargos in Commission and of the Gratified Functions of the Superintendence of the Franca Zone of Manaus-SUFRAMA, and gives other arrangements

The PRESIDENT OF THE REPUBLIC, in the use of the assignments that gives him the art. 84, incisments IV and VI, paragraph (a?) of the Constitution, and with a view to the provisions of the Act No 10,683 of May 28, 2003,

DECRETA:

Art. 1st Ficam approved the Regimental Structure and the Demonstrative Framework of the Cargos in Commission and Gratified Functions of the Superintendence of the Franca Zone of Manaus-SUFRAMA, in the form of the Annexes I and II to this Decree.

Art. 2nd The internal regiment of SUFRAMA will be approved by the Minister of State for Development, Industry and Foreign Trade and published in the Official Journal of the Union, within ninety days, counted from the date of publication of this Decree.

Art. 3rd This Decree comes into effect on the date of its publication.

Art. 4th It is revoked the Decree no 4,628, of March 21, 2003.

ANNEX I

STRUCTURE AREA SUPERINTENDENCY OF THE ZONE

FRANCA OF MANAUS-SUFRAMA

CHAPTER I

OF NATURE AND PURPOSE

Art. 1st The Superintendence of the Franca Zone of Manaus-SUFRAMA, municipality created by the Decree-Law no 288, of February 28, 1967, and bound by the Ministry of Development, Industry and Foreign Trade, has as its purpose to promote the socio-economic development, sustainably, in its area of acting, upon generation, attraction and consolidation of investments, supported in technological empowerment, aiming for competitive international insertion, from the following actions:

I-identify opportunities with views the attraction of endeavors to the region;

II-identify and stimulate public and private investments in infrastructure;

III-stimulate and strengthen investments in the formation of capital intellectual and in science, technology and innovation by the public and private sectors;

IV- step up the process of articulation and partnership with public and private bodies and entities;

V-stimulation of foreign trade actions; and

VI-administering the granting of tax incentives.

CHAPTER II

OF THE ORGANIZATIONAL STRUCTURE

Art. 2nd Superintendence of the Franca Zone of Manaus-SUFRAMA has the following organizational structure:

I-top body of deliberation: Board of Directors;

II-organs of direct and immediate assistance to the Superintendent:

a) Cabinet;

b) Coordination-General for Social Communication;

c) General Coordinating Council Administration;

d) Coordinator-General for Economic and Entrepreneurship Studies;

e) Coordinator-General Representation of Institutional Representation; and

f) Coordination-General of Foreign Trade;

III-sectional organs:

a) Federal Prosecutor's Office;

b) Internal Audit;

c) CorregInternal; and

d) Adjunta Superintendency of Administration;

IV-specific organ-specific organs:

a) Adjunta Superintendency of Regional Planning and Development;

b) Adjunta Superintendency of Projects; and

c) Adjunta Superintendency of Operations;

V-decentralized units:

a) General coordinator of the Western Amazon Portal;

b) Areas of Free Trade; and

c) Regional Coordinations.

CHAPTER III

OF DIRECTION AND NOMINATION

Art. 3rd A SUFRAMA is directed by a Superintendent and four Adjoined Superintendents.

Single paragraph. Nominations for the committee posts and gratified roles integral to the regimental structure of SUFRAMA will be effected in compliance with the current legislation.

CHAPTER IV

OF THE COMPETENCE OF THE ORGANS

Section I

Of The Body Top of Deliberation

Art. 4th To the Board of Directors of SUFRAMA competes:

I-approve:

a) the general guidelines for elaboration of the annual and multi-year work plans;

b) its internal regiment;

c) the projects of companies that object to enjoy the tax benefits provided in the arts. 7º and 9º of Decree-Law No. 288, of 1967, specifying the incentives to be earned by the company, as well as setting standards, requirements, limitations and conditions for the approval, surveillance and monitoring of the said projects;

d) the indication for appointment and exoneration of the internal audit holder;

e) the Annual Activity Plan of Internal Audit;

f) the general norms and criteria for the execution of plans, programs, projects, works and services to be held by the entity, in particular:

1. the convenians, agreements and contracts; and

2. the credit and financing operations, including for the costing of studies, services and works; and

II-suggest the formation of technical teams for analysis of specific content matter.

Single paragraph. The composition of the Board of Directors of SUFRAMA is set out in the Supplementary Act No 68 of June 13, 1991.

Section II

From the Direct Assistance Organs and Immediate to the Superintendent

Art. 5th To The Cabinet competes:

I-watch the Superintendent of SUFRAMA in its representation political and social;

II-incumbent upon the preparer of the personal expedient of the Superintendent;

III-distribute and follow up the progress of documentation and processes of interest of the Superintendent, in tramway at SUFRAMA; and

IV-exercise other skills that are committed by the Superintendent of SUFRAMA.

Art. 6th To the Coordinating Social Communication competes, to coordinate, coordinate and supervise the activities of media, publication, institutional disclosure, public relations, events and follow-up of matters of interest of SUFRAMA.

Art. 7th To the Coordinating Board of the Board of Directors competes and provide administrative support to the meetings of that Council, Setorian Chambers, Committees, Working Groups and other meetings, which are assigned to him by the Superintendent.

Art. 8th To the Coordinating-General for Economic and Business Studies compete to advise the Superintendent as to the elaboration of studies in the economic and tax incentives areas.

Art. 9th To the Coordinating-Institutional Representation competes:

I-represent SUFRAMA in Brasilia and provide support to the Superintendent and too many servers when the service in that locality;

II-promote and follow up on the progress of subjects of interest of SUFRAMA; and

III-perform other competencies that the interest of SUFRAMA demeans.

Art. 10. To the Coordinating Foreign Trade-General compete:

I-formulate proposals for programs of foreign trade, aimed at the SUFRAMA's acting area;

II-watch SUFRAMA in matters of cooperation, technical assistance, arrangements and international agreements, business rounds, trade missions, seminars, export platforms, product distribution centres, promotion of fairs and exhibitions;

III-represent the SUFRAMA in the forums of Federal Government discussions, pertinent to the negotiations of agreements, treaties and international cooperations; and

IV-guide and accompany the exporter in issues pertinent to the activities of foreign trade.

Section III

From the Sectional Organs

Art. 11. To the Federal Prosecutor's Office, as the executor organ of the Federal Attorney General, it competes:

I-exercise the judicial and extrajudicial representation of SUFRAMA, acting on the processes in which the municipality is authored, ré, opponent or assistant;

II-render advice and legal advice to the Superintendent and the units of SUFRAMA, applying, in what couber, the provisions of the Supplemental Act no 73, of February 10, 1993;

III-watch the Superintendent in the internal control of the administrative legality of the acts to be by him practiced or already effectuated;

IV-fix, for the units of SUFRAMA, the interpretation of legal planning, when there is no normative orientation of the Advocate-General of the Union and the Legal Consultancy of the Ministry of Development, Industry and Foreign Trade; and

V-ascertaining liquidity and certainty of the credits of any nature, inherent in the activities of SUFRAMA, enrolling them in active debt, for the purposes of administrative or judicial collection.

Art. 12. To Internal Audit competes:

I-check the compliance with accounting standards, financial and administrative in the framework of SUFRAMA;

II-follow up the works of the organs of internal and external control;

III-follow up the elaboration and issue prior opinion on the provision of annual SUFRAMA accounts, as well as special account outlets;

IV-propose actions in such a way as to ensure the legality of the acts and the scope of the results, contributing to the improvement of the management;

V-orienting secondarily the leaders of SUFRAMA as to the principles and norms of internal control, including on how to account;

VI-check the consistency and fideworthies of the data and information that will behave the accounts of the President of the Republic in the General Balance Sheet of the Union; and

VII-give prior and periodic guidance to the sectors of SUFRAMA relatively the execution of their activities.

Single paragraph. In the exercise of its powers, the Internal Audit shall administratively link to the Board of Directors, in the terms of the art. 15 of the Decree no 3,591, of September 6, 2000.

Art. 13. The Internal Affairs competes:

I-manage and execute the investigative activities discipline and too much brokerage activities;

II-check, in the interest of the activity correctional, data and constant information in the information systems of SUFRAMA;

III- check the disciplinary aspects of tax deeds and other administrative procedures;

IV-examining and instructing disciplinary and other expedient administrative processes on functional ethics and discipline that should be submitted to the authorities' appreciation competent;

V-appreciate consultations and express on matters relating to duties, prohibitions and too many themes that versem on functional ethics and discipline;

VI-examine denunciations, representations and too many expedients dealing with functional irregularities and promoting their ascertaining, met the legal requirements;

VII-follow-up, evaluate, execute and define criteria, methods and procedures for the correctional and disciplinary research activities;

VIII-requesting or carrying out representations, including fiscal, requisitioned information, processes and documents necessary for the examination of matter in the area of its competence;

IX-follow up on the progress of legal actions concerning the correctional activities;

X-adopt preventive actions and repressive on the functional and disciplinary ethics of the servers; and

XI-administer the information regarding the administratio-disciplinary achievements.

Art. 14. The Adjoint Superintendence of Administration competes:

I-plan, coordinate and to supervise the implementation of activities concerning the federal systems of organization and administrative modernization, accounting, budgetary and financial implementation, administration of information and informatics resources, human resources and of general services; and

II-conduct take-out of expense payers and too much responsible for public goods and values and of all the one that gives cause for loss, extravies or other wrongdoing that results in damage to the erarium.

Section IV

Of the Singular Specific Organs

Art. 15. The Adjoint Superintendence of Regional Planning and Development competes to plan, coordinate and supervise the execution of activities concerning:

I-management system planning and budget programming of the entity;

II-formulation, implementation and evaluation of plans and programs aimed at regional development, in line with national policies;

III-celebration and follow-up of the convennials firmed up by SUFRAMA, as well as analysis of the accountability of the resources transferred; and

IV-formulation, implementation and evaluation of programs and projects aimed at the development of science, technology and innovation, in the area of actuation of SUFRAMA, in articulation with the Ministry of Science and Technology and other public and private entities.

Art. 16. The Adjoint Superintendence of Projects competes to plan, coordinate and supervise the execution of activities concerning:

I-analysis of industrial, agrolivestock and service delivery projects with views the granting of tax incentives administered by SUFRAMA;

II-analysis and approval of the listing of imported inputs destined for the industrialization of products in the French Zone of Manaus;

III-monitoring, surveillance and evaluation of industrial projects, agri-livestock and service delivery;

IV-administration of the occupation of areas of the Industrial and Agrolivestock districts; and

V-analysis and surveillance of engineering projects and architecture concerning works in areas of the Marshal Industrial District White Castle.

Art. 17. The Adjoint Superintendence of Operations competes to plan, coordinate and supervise the execution of activities concerning:

I-control of the physical and documentary input of domestic and documentary goods of foreign goods, encouraged, in the area of actuation of SUFRAMA;

II-enrollment and habilitation of companies that come to plethine the tax incentives administered by the SUFRAMA;

III-administration of the finalistic operations of the decentralized units, in articulation with the remaining units of SUFRAMA;

IV-monitoring of the operationalization of the goods warehousing activities in the performance area of SUFRAMA; and

V-analysis, control, monitoring and evaluation of the operationalization of the processes concerning special export programs.

Section V

Of the Descentralized Units

Art. 18. To the General Coordinator of the Western Amazon Portal, to the Areas of Free Trade and the Regional Coordinations compete:

I-administer the instruments of pertinent tax incentives;

II-operationalize the mechanisms of import and internment of domestic and foreign goods; and

III-represent the SUFRAMA in your area of jurisdiction.

CHAPTER V

DAS ATTRIBUTIONS OF LEADERS

Section I

Do Superintendent

Art. 19. The Superintendent is incumbent:

I-set the acting guidelines and exercise the general direction of the units of SUFRAMA;

II-propose the annual plan and the budget and, after its approval, give notice to the Board of Directors of SUFRAMA, as well as of the partial and annual reports of the developed activities;

III-submit to the approval of the Ministry of Development, Industry and Foreign Trade the internal regiment of SUFRAMA;

IV-dispose of the operation of the units, as well as on the performance of special activities;

V-propose changes in the operational structure depending on the regional development plans or the new programs of the Federal Government for the Western Amazon and too many areas of comprehensiveness, observed the prevailing norms;

VI-firming agreements, contracts and arrangements with national and international entities, observed the current legislation;

VII-practice the acts of provement of effective positions of the SUFRAMA Personnel Framework, due to habilitation in public tender, as well as exercising the disciplinary power, under the legislation in force;

VIII-represent SUFRAMA in judgment or out of it;

IX-present, in the deadlines set, the provision of accounts corresponding to the management of the previous financial year;

X-authorize the provement of financial and material resources necessary to the execution of programs, projects and activities;

XI-hiring the provision of technical services with physical people or legal, in the form of the relevant legislation, for the performance of specialized functions;

XII-practice all acts pertinent to the financial, accounting, material and general services administration in the form of the current legislation, as well as to determine audits and periodic checks in these areas;

XIII-determine the introduction of inquiries as the relevant standards and legislation;

XIV-submit to the Board of Directors of SUFRAMA subjects that depend on the appreciation or approval of that collegiate;

XV-propose to the Council of SUFRAMA's Administration to divest of movable and immovable property to it belonging;

XVI- comply with and enforce the decisions of the Board of Directors of SUFRAMA; and

XVII- promote, dispense and homologate tenders, as well as firm up contracts for procurement of material, execution of works and services and leasing of real estate, in the form of the current legislation.

Section II

From the Adjoined Superintendents

Art. 20. Adjoining Superintendents is incumbent on planning, directing, coordinating and directing the evaluation and execution of the activities of their respective units and to exercise other assignments that are committed to them by the Superintendent of SUFRAMA.

Section III

From the rest Leaders

Art. 21. To the Chief of Staff, the Chief Prosecutor, the Auditor-in-Chief, the Corregedor, the Coordinators-General and the remaining leaders is to plan, direct and coordinate the execution of the activities affected to the respective units and to exercise other assignments that they are committed to them.

CHAPTER VI

OF THE GENERAL PROVISIONS

Art. 22. The internal regiment shall define the detailing of the integral bodies of the Regimental Structure, the competences of the respective units, the assignments of their leaders and the areas of jurisdiction of the Regional Coordinations.

Art. 23. The Free Trade Areas administered by SUFRAMA are in number of three and are located in Tabating-AM, Macapá / Santana-AP and Guajará-Mirim-RO.

Art. 24. The missing cases and the doubts raised in the application of this Regimental Structure will be addressed by the Superintendent of SUFRAMA, ad referendum of the Minister of State for Development, Industry and Foreign Trade.
