DECREE OF 1º-OF FEBRUARY 2013

Declared from public utility, for the purposes of misappropriation, in favor of the concessionary Autopista Sul S.A., the real estate it mentions, located in the Municipality of Palhoça, in the State of Santa Catarina.

THE CHAIRWOMAN OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, caput, inciso IV, of the Constitution, with a view to the provisions of the art. 3º, art. 5º, caput, points ("h" and "i", and art. 6º of the Decree-Law No. 3,365 of June 21, 1941 on the art. 29, caput, inciso VIII, and art. 31, caput, inciso VI, of Law No. 8,987, of February 13, 1995, and in accordance with what appears in the ANTT Process No. 50500.138666 /2011-38,

D E C R E T A:

Art. 1º Become declared of public utility, for the purposes of misappropriation, in whole or in part, in favor of the Autopista Coastal Sul S.A., the real estate covered and delimited by the topographical coordinates described below, excluded the goods from public domain, adjacent to the Highway Governor Mário Covas, 101/SC, located in the Municipality of Palhoça, in the State of Santa Catarina, necessary for the execution of the pedestrian walkway implantation works at km 215 + 015m:

I-Area 01: starts at point P4A, with Plants Plants in the U.T.M. System -SIRGAS 2000, respectively E: 729,188 ,841m and N: 6,939,298 ,649m; hence, follows with AZPlano= 214 ° 01'57 "and distance of 12.54 meters, reaches the point P4D, E: 729,291 ,631m and N: 6,939,178 ,449m; hence, follows with AZPlano= 74 ° 07 ' 47" and distance of 4.48 metres, comes to point P4C, E: 729,287 ,322m and N: 6,939,177 ,224m; hence, follows with AZPlano= 33 ° 53 '37 "and distance of 12.06 metres, E: 729,294 ,048m and N: 6,939,187 ,232m; hence, follows with AZPlano= 70 ° 43' 40" and distance of 4.87 meters, arrives at point P4A, E: 729,298 ,649m and N: 6,939,188 ,841m, thus closing the perimeter with thirty-three meters and ninety five centimeters, perdoing the area of 35 ,70m²;

II-Area 02: start-up point P4D, with Planas coordinates in the U.T.M. System -SIRGAS 2000, respectively E: 729,291 ,631m and N: 6,939,178 ,449m; hence, follows with AZPlano= 214 ° 01'57 "and distance of 49.67 meters, reaches the point P1A, E: 729,263 ,833m and N: 6,939,137 ,286m; hence, follows with AZPlano= 77 ° 29 ' 15" and distance of 4.68 metres, comes to point P2A, E: 729,259 ,263m and N: 6,939,136 ,272m; hence, follows with AZPlano= 34 ° 25 '08 "and distance of 49.64 metres, E: 729,287 ,322m and N: 6,939,177 ,224m; hence, follows with AZPlano= 74 ° 07' 47" and distance of 4.48 metres, comes to point P4D, E: 729,291 ,631m and N: 6,939,178 ,449m, thus closing the perimeter with one hundred and eight meters and forty-seven centimeters, by perdoing the area of 146 ,07m²;

III-Area 03: starts at point P1A, with Planas coordinates in the U.T.M. System -SIRGAS 2000, respectively E: 729,263 ,833m and N: 6,939,137 ,286m; hence, follows with AZPlano= 214 ° 08 ' 28 "and distance of 21.82 meters, reaches point P1, E: 729,251 ,618m and N: 6,939,119 ,200m; hence, follows with AZPlano= 304 ° 01'57" and distance of 3.95 metres, comes to point P2, E: 729,248 ,348m and N: 6,939,121 ,408m; hence, follows with AZPlano= 36 ° 15 '58 "and distance of 18.44 metres, E: 729,259 ,263m and N: 6,939,136 ,272m; hence, follows with AZPlano= 77 ° 29' 15" and distance of 4.68 metres, comes to point P1A, E: 729,263 ,833m and N: 6,939,137 ,286m, thus closing the perimeter with forty-eight meters and ninety and one centimeters, perdoing the area of 71 ,47m²;

IV-Area 04: starts at point P01, with Coordinates Planes in the U.T.M. System -SIRGAS 2000, respectively E: 729,251 ,618m and N: 6,939,119 ,200m and geographical coordinates Latitude -27 ° 39 '09, 43 "and Longitude -42 ° 40' 34, 13"; hence, it follows with AZPlano= 304 ° 01'57 " and distance of 1.83 meters, comes to the point P02A; hence, follows with AZPlano= 38 ° 14 '45 "and distance of 21.62 metres, comes to point P03A; hence, it follows with AZPlano= 77 ° 29' 15" and distance of 0.36 metres, comes to point P04A; hence, it follows with AZPlano= 214 ° 01'57 " and distance of 21.82 metres, comes to point P01, thereby closing the perimeter with forty-five meters and sixty-six centimeters, pervating the area of 23 ,67m²; and

V-Area 05: starts at point P01, with Plants Plants in the U.T.M. System. -SIRGAS 2000, respectively E: 729,224 ,188m and N: 6,939,191 ,004m; hence, follows with AZPlano= 303 ° 48 '13 "and distance of 4.31 meters, reaches point P02, E: 729,220 ,609m and N: 6,939,193 ,401m; hence, follows with AZPlano= 34 ° 02' 05" and distance of 63.39 metres, comes to point P03, E: 729,256 ,086m and N: 6,939,245 ,929m; hence, follows with AZPlano= 124 ° 02 '11 "and distance of 4.23 metres, E: 729,259 ,592m and N: 6,939,243 ,561m; hence, follows with AZPlano= 213 ° 57' 57" and distance of 63.37 metres, comes to point P01, E: 729,224 ,188m and N: 6,939,191 ,004m, thus closing the perimeter with one hundred and thirty-five meters and twenty-nine centimeters, perdoing the area of 270 ,60m².

Art. 2º It is the concessionaire Coastal Sul S.A. authorised to promote, with own resources, the disappropriation of the land areas and benfeits of which it treats art. 1º, in the form of the prevailing legislation and regulations.

Single paragraph. The expropriate is allowed to invoke the character of urgency in the process of misappropriation of which it treats the caput, for purposes of immission in the possession, in the terms of the art. 15 of the Decree-Law No. 3,365 of June 21, 1941.

Art. 3º The declaration of public utility does not exonerate the dealership of the prior obtaining of the licensing and fulfilment of the obligations attached to the environmental and other public administration bodies, necessary to the effectivation of the works and activities referred to in art. 1º.

Art. 4º This Decree takes effect on the date of its publication.
