DECREE NO. 5,217 OF September 29, 2004.

Disposes on the execution of the Thirteenth Additional Protocol to the Economic Supplementation Agreement no 39, between the Governments of the Federative Republic of Brazil and the Republic of Ecuador of June 30, 2004.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, inciso IV, of the Constitution, and

Considering that the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), firmed by the Government of the Federative Republic of Brazil, in 12 of August 1980, and approved by the National Congress, through the Legislative Decree no 66, of November 16, 1981, provides for the modality of Economic Supplementation Agreement;

Whereas the Plenipotentiaries of the Federative Republic of Brazil, the Republic of Colombia, the Bolivarian Republic of Venezuela, the Republic of Ecuador and the Republic of Peru, on the basis of the Treaty of Montevideo of 1980, signed, on August 12, 1999, in Montevideo, the Agreement of Economic Complementation in the 39, between the Governments of the Federative Republic of Brazil and the Republic of Colombia, of the Bolivarian Republic of Venezuela, the Republic of Ecuador and the Republic of Peru (member states of the Andean Community), incorporated into the national legal planning by the Decree no 3,138 of August 16, 1999;

Whereas the Plenipotentiaries of the Federative Republic of Brazil and of the Republic of Ecuador, on the basis of the Treaty of Montevideo of 1980, signed on June 30, 2004, in Montevideo, the Thirteenth Additional Protocol to the Economic Supplementation Agreement no 39, between the Governments of the Federative Republic of Brazil and the Republic of Ecuador;

DECRETA:

Art. 1st The Thirteenth Additional Protocol to the Economic Supplementation Agreement no 39, between the Governments of the Federative Republic of Brazil and the Republic of Ecuador, apensed by copy to the present Decree, will be executed and fulfilled as entirely as it contains.

Art. 2nd This Decree comes into effect on the date of its publication.

ECONOMIC SUPPLEMENTATION AGREEMENT NO. 39 SIGNED BETWEEN THE REPUBLICS OF COLOMBIA, ECUADOR, PERU AND THE VENEZUELA, THE MEMBER STATES OF THE ANDINA COMMUNITY, AND THE FEDERATIVE REPUBLIC OF BRAZIL

Thirteenth Additional Protocol

The Plenipotentiaries of the Federative Republic of Brazil and the Republic of Ecuador, duly authorized by their respective Governments, in accordance with the powers presented in good and due form, opportunely deposited in the General Secretariat of the Latin American Integration Association (ALADI),

HAVING IN VIEW the Economic Supplementation Agreement N ° 59, signed on December 16, 2003, between Argentina, Brazil, Paraguay and Uruguay, States Parties to MERCOSUR, and Colombia, Ecuador and Venezuela, Paisks-Members of the Community Andina, by which a Free Trade Zone is established;

CONSIDERING that it is necessary to preserve existing trade currents up to the effective entry into force of the mentioned Agreements;

CONVEX IN:

Article 1 °-Extend the term of the Economic Supplementation Agreement N ° 39 and the paced preferences between the Federative Republic of Brazil and the Republic of Ecuador, of 01 of July 2004 to September 30, 2004 or, should it occur first, until the effective entry into force of the Economic Supplementation Agreement No 59, signed on December 16, 2003 between Argentina, Brazil, Paraguay and Uruguay, States Parties to the MERCOSUR, and Colombia, Ecuador and Venezuela, Paises-Members of the Andean Community.

Article 2-This Protocol shall enter into force on the date on which the Federative Republic of Brazil and the Republic of Ecuador have incorporated it into their domestic law, pursuant to their respective legislations. For so much, the Signatary Parties will be able to determine the provisional application of this Protocol in accordance with their legislations, until they meet the tramites for their entry into force.

The General Secretariat of the ALADI shall be a depositary of this Protocol, of which it shall send duly certified copies to the Signatary Parties.

IN FÉ OF WHAT, THE RESPECTIVE PLENIPOTENTIARIES SIGN the present Protocol in the city of Montevideo, at the thirty days of the month of June of year two thousand and four, in an original in the Portuguese and Spanish languages, being both texts being equally valid.
