Altera the Act no 10,188, of February 12, 2001, which creates the Residential Tenancy Program, institutes the residential rental with purchase option, and the Law no 11,265 of January 3, 2006 regulating the marketing of infants and early childhood children and also that of correlated puericulture products, and gives other providencies.

THE PRESIDENT OF THE REPUBLIC I know that the National Congress decrees and I sanction the following

Lei:

Art. 1st The arts. 1st, 2nd, 4th, 5th and 8th of the Law no 10,188, of February 12, 2001, go on to invigorate with the following essay:

?Art. 1st is instituted the Residential Tenancy Program for the fulfillment of the housing need of the low-income population, in the form of residential tenancy with purchase option.

§ 3º It becomes optional the alienation of the imovels acquired in the scope of the Program without prior tenancy.? (NR)

§ 7º The alienation of real estate belonging to the fund's equity to which refers to the caput of this article will be effective directly by the CEF, constituting the instrument of disposal document skilful for cancellation, in the face of the Estate Registration Office, of the aversions pertinent to the restrictions and the highlight of which they treat the § § 3rd and 4th of this article, observing:

I-the course of the term contractual of the Residential Tenancy; or

II-at the discretion of the Fund manager, the process of disimmobilization of the financial fund from which it treats the caput of this article.

III-incorporate the revenues belonging to the financial fund specific to the Programme, coming from the process of deimmobilization provided for in the inciso II of the 7th of the art. 2nd of this Act; and

IV-receive others features to be intended for the Program.

IV-define the technical criteria to be observed in the acquisition, divestment and on lease with option of purchase of the real estate intended for the Program;

VIII-observe the restrictions on legal and physical persons, in the that refers to impediments to acting in housing programs, by subsidizing the updating of existing cadasters, including those of the Housing Financial System-SFH.

II-fix rules and conditions for implementation of the Program, such as acting areas, target audience, maximum acquisition value of the housing unit, among others judging necessary;

IV-establish guidelines for the alienation predicted in § 7th of the art. 2nd of this Act;

V-forwarding at 2 (two) Casas of the National Congress semiannual report on the actions of the Program.? (NR)

§ 1º The purchase and sale contract regarding the real estate rental object that comes to be disposed of in the form of the inciso II of § 7th of the art. 2nd of this Act, even if full payment is made in sight, will contemplate the impediment clause of the acquirer, within 24 (twenty-four) months, sell, promise to sell or cede their rights over the alienated real estate.

§ 2nd The deadline referred to in this article's § exceptionally, be reduced as a criterion to be defined by the Ministry of Cities, in the cases of renting with a period of more than half of the regulated deadline.

§ 3rd in the immovable property in the form of the inciso II of the § 7th of the art. 2nd of this Act, will be admitted to the use of the resources deposited into the linked account of the FGTS, under conditions to be defined by the FGTS Curator Council.? (NR)

Art. 2nd The Law no 10,188, of February 12, 2001, passes the increased invigoration of the following art. 10-A:

?Art. 10-A. The values ascertained with the disposal of the real estate will be used to amortize the debtor balances of the loans taken before the FGTS in the form of the inciso II of the art caput. 3rd of this Act, under the conditions to be established by the FGTS Curator Board.?

Art. 3rd O § 1st art. 10, the § 1st of art. 11 and the incisos I, II and III of the § 1st Art. 13 of the Law no 11,265, of January 3, 2006, go on to invigorate with the following essay:

I-milk skunted and semidesnae, with or without addition of essential nutrients: IMPORTANT WARNING: This product should not be used to feed children, other than by express indication of doctor or nutritionist. Maternal lettering prevents infections and allergies and is recommended up to 2 (two) years of age or more;

II-whole-milk and similar of vegetable or mixed-origin, enriched or not: IMPORTANT WARNING: This product should not be used to feed children under the age of 1 (one) year old, other than by express indication of doctor or nutritionist. Maternal lettering prevents infections and allergies and should be kept up until the child completes 2 (two) years of age or more;

III-modified milk of animal or plant origin: IMPORTANT WARNING: This product should not be used to feed children minors of 1 (one) year of age. Maternal lettering prevents infections and allergies and is recommended up to 2 (two) years of age or older.

Art. 4th The Executive Power regulates the provisions of this Act.

Art. 5th This Law comes into effect on the date of its publication.
