DECREE NO. 3,870, OF July 17, 2001

Disposes on the execution of the Quadragumth Third Additional Protocol to the Economic Supplementation Agreement No. 2 (automotive vehicles), between the Governments of the Federative Republic of Brazil and the Eastern Republic of Uruguay, of April 30, 2001.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives it the art. 84, inciso IV, of the Constitution, and

Considering that the Treaty of Montevideo of 1980, which created the Latin Association?American of Integration (ALADI), firmed by Brazil on August 12, 1980 and approved by the National Congress, through the Legislative Decree No. 66 of November 16, 1981, provides for the modality of Economic Supplementation Agreement;

Whereas the Plenipotentiaries of the Federative Republic of Brazil and the Eastern Republic of Uruguay, on the basis of the Treaty of Montevideo of 1980, signed, on December 20, 1982, in Montevideo, the Complementation Agreement Economic No. 2, between the Governments of the Federative Republic of Brazil and the Eastern Republic of Uruguay, which was incorporated into the Brazilian legal planning by means of the Decree No. 88,419 of June 20, 1983;

Whereas the Plenipotentiaries of the Federative Republic of Brazil and the Eastern Republic of Uruguay, on the basis of the Treaty of Montevideo of 1980, signed on April 30, 2001, in Montevideo, the Quadragumth Third Protocol Additional to the Economic Supplementation Agreement No. 2 (automotive vehicles), between the Governments of the Federative Republic of Brazil and the Eastern Republic of Uruguay;

D E C R E T A:

Art. 1º Stay promulgated, for all intents and purposes, the Quadragtieth Third Additional Protocol to the Economic Supplementation Agreement No. 2 (Automotive vehicles), between the Governments of the Federative Republic of Brazil and the Eastern Republic of Uruguay, apenso by copy to the present Decree.

Art. 2º This Decree enters into force on the date of its publication.

Economic Supplementation Agreement No 2 celebrated between

Federative Republic of Brazil and the Eastern Republic of Uruguay

Quadragumth Third Additional Protocol

The Plenipotentiaries of the Federative Republic of Brazil and the Eastern Republic of Uruguay, accredited by their respective Governments second powers that have been bestowed in good and due form, deposited timely in the Secretary?General of the Latino Association?American Integration (ALADI),

Concome in:

Article 1º-The Federative Republic of Brazil outorts to the Eastern Republic of Uruguay, for the period of 1º May 2001 by May 31, 2001, a quota of one thousand and eighty four units of automotive vehicles, ranked in the NALADI/SH 87.02, 87.03 and 87.04 positions, for any category.

Article 2º? The Eastern Republic of Uruguay bestows to the Federative Republic of Brazil, for the period 1º from May 2001 to May 31, 2001, a quota of three hundred and thirty-four units of automotive vehicles, ranked in the NALADI/SH positions 87.03 and 87.04, for units of up to 4,000 kg of total gross weight.

Article 3º? The units of automotive vehicles set out in the quotas bestowed by the Federative Republic of Brazil and the Eastern Republic of Uruguay on the Twenty-First, Twentieth, Twentieth, Thirteenth, Thirteenth, Thirteenth-Second, Thirtieth Third, Thirtieth Fifth, Thirtieth Seventh, Thirtieth Ninth and Quadragtieth First Additional Protocols, which were not used in the period 1º from January 2000 to April 30, 2001, may be availed in the period of 1º of may 2001 until May 31, 2001, without prejudice to the quotas set out in Articles 1º and 2º of this Protocol.

Article 4º? Set as a source standard 60/40% for models in production and 55/45% for the new models.

Article 5º? The percentage of regional origin pieces applicable to the models in production, according to Article 4º of the Seventeenth Additional Protocol to ACE No. 2, will be 25%.

Article 6º? The present Protocol vigour since 1º from May 2001 to May 31, 2001.

The Registry?General of ALADI shall be a depositary of this Protocol, of which it will send duly certified copies to the signatory Governments.

In faith of what, the respective Plenipotentiaries sign the present Protocol in the city of Montevideo, at the thirty days of the month of April two thousand and one, in an original in the Portuguese and Spanish languages, being both texts being equally valid.
