DECREE OF May 14, 2014

Declara of public utility, for the purposes of misappropriation, in favor of the concessionary Autopista Sul S.A., the real estate it mentions, located in the Municipality of São José dos Pinhais, State of Paraná.

THE CHAIRPERSON OF THE REPUBLIC, in the use of the attribution that confers it on art. 84, caput, inciso IV, of the Constitution, and with a view to the provisions of the art. 3º, art. 5º, caput, points ("h" and "i", and art. 6º of the Decree-Law No. 3,365 of June 21, 1941 on the art. 29, caput, inciso VIII, and art. 31, caput, inciso VI, of Law No. 8,987 of February 13, 1995, and in accordance with what appears in the ANTT Process No. 50500.187449 /2013-33,

DECRETA:

Art. 1º Become declared of public utility, for purposes of disappropriation, in whole or in part, in favour of the concessionary Coastal Sul S.A., the real estate delineated by the topographical coordinates described below, excluded the domain goods public, situated on the banks of the 116/PR Rodovia, located in the Municipality of São José dos Pinhais, State of Paraná, necessary for the execution of the side street implantation works on the stretch between km 093 + 600m and km 094 + 150m, in the East Pista:

I-area 1-starts the perimeter at the vertex P1, of coordinates N:7.176.302, 84m and E: 687,651, 49m, situated on the boundary with the domain strip of the 116/PR and Diogo Marconi Lucchesi and others; of this, it follows with azimut from 189 ° 18 ' 35 " and distance of 08 ,42m, confronting on this stretch with Diogo Marconi Lucchesi and others, up to the vertex P2, from coordinates N:7.176.195, 85m and: 687,633 ,95m; of this, follows with azimuth of 216 ° 33 ' 28 " and distance and 65 ,85m, confronting in this stretch with Diogo Marconi Lucchesi and others, up to the vertex P3, of coordinates N:7.176.142, 95m and: 687,594 ,72m; of this, follows with azimut from 252 ° 33 '45 "and distance and 89 ,05m, confronting on this stretch with Diogo Marconi Lucchesi and others, up to the vertex P4, of coordinates N:7.176.116, 26m and: 687,509 ,76m; of this, follows with azimut from 37 ° 13' 14" and distance from, 64m, confronting in this stretch with the domain strip of the Highway R-116/PR, up to the vertex P5, of coordinates N:7.176.123, 15m and: 687,514 ,99m; of this, follows with azimuth of 37 ° 13 ' 14 " and distance of 25 ,65m, confronting in this stretch with the domain strip of the Highway R-116/PR, up to the vertex P1, of coordinates N:7.176.302, 84m E: 687,651, 49m, initial point of the description of this serimeter; thus closing the perimeter with 497 ,62m and area with 7,669 ,03m²; and

II-area 2-starts the perimeter at the vertex P1, of coordinates N:7.176.414, 17m and E: 687,731, 94m, situated at the limit with the domain strip of the 116/PR Rodovia and Francisco Munhoz Madrid street; of this, it follows with azimut from 150 ° 55 ' 12 " and distance of 21 ,64m, confronting on this stretch with Rua Francisco Munhoz Madrid, up to the vertex P2, of coordinates N:7.176.395, 26m and E: 687,742, 46m; of this, follows with azimuth from 153 ° 15 '09 "and distance of 12 ,56m, confronting on this stretch with Rua Francisco Munhoz Madrid, up to the vertex P3, of coordinates N:7.176.384 ,04m and E: 687,748, 11m; of this, follows with azimuth from 312 ° 30' 06" and distance of 20 ,40m, confronting on this stretch with Ney Pompeo Machado's estate, up to the vertex P4, of coordinates N:7.176.397, 82m and E: 687,733 ,07m; of this, follows with azimuth of 281 ° 39 ' 29 " and distance of 11 ,48m, confronting in this stretch with Ney Pompeo's estate Machado, up to the vertex P5, of coordinates N:7.176.400, 14m and E: 687,721, 83m; of this, follows with azimuth of 35 ° 46 ' 31 " and distance of 17 ,29m, confronting in this stretch with the domain strip of the 116/PR Highway, up to the vertex P1, of coordinates N:7.176.414, 17m and E: 687,731, 94m, initial point of the description of this perimeter; thus closing the perimeter with 83 ,38m and area with 211 ,26m².

Art. 2º It is the concessionaire Coastal Sul S.A. authorised to promote, with own resources, the disappropriation of the land areas and benfeits of which it treats art. 1º.

Single paragraph. The expropriating shall be allowed to invoke the character of urgency in the process of dispropriation, for purposes of impropriation in the possession, pursuant to art. 15 of the Decree-Law No. 3,365 of June 21, 1941.

Art. 3º The declaration of public utility does not exonerate the dealership of the prior obtaining of the licensing and fulfilment of the obligations attached to the environmental and other public administration bodies, necessary to the effectivation of the works and activities referred to in art. 1º.

Art. 4º This Decree comes into force on the date of its publication.
