DECREE OF May 29, 2014

Declara of public utility, for the purposes of misappropriation, in favor of the Autopista Sul S.A. dealership, the real estate it mentions, located in the Municipality of Joinville, State of Santa Catarina.

The CHAIRPERSON OF THE REPUBLIC, in the use of the attribution that confers it on art. 84, caput, inciso IV, of the Constitution, with a view to the provisions of the art. 3º, art. 5º, caput, points ("h" and "i", and art. 6º of the Decree-Law No. 3,365 of June 21, 1941 in the art. 29, caput, inciso VIII, and art. 31, caput, inciso VI, of Law No. 8,987, of February 13, 1995, and in accordance with that appearing in the ANTT Process No. 50500.188902 /2013-29,

DECRETA:

Art. 1º Become declared of public utility, for purposes of disappropriation, in whole or in part, in favour of the concessionary Coastal Sul S.A., the real estate delineated by the topographical coordinates described below, excluded the domain goods public, situated on the banks of the Highway Governor Mário Covas, BR-101 /SC, located in the Municipality of Joinville, State of Santa Catarina, necessary for the execution of the side street implantation works on the stretch between km 036 + 965m and km 037 + 636m, in the South Pista:

I-area 1-starts the perimeter at the vertex P1, of coordinates N = 7,091,048 ,11m and E = 710,830 ,87m, situated on the edge with Calema Participações and Real Estate Ventures Ltda. And others and with the 101/SC; domain strip of this, it follows with azimuth of 153 ° 34 ' 09 " and distance of 84 ,52m, confronting, in this stretch, with the domain strip of the 101/SC, up to the vertex P2, of coordinates N = 7,090,972 ,42m and E = 710,868 ,49m; of this, follows with azimut from 269 ° 28 ' 55 " and distance of 13 ,15m, confronting, in this stretch, with Calema Participações and Real Estate Ventures Ltda. and others, up to the vertex P3, of coordinates N = 7,090,972 ,30m and E = 710,855 ,34m; of this, follows with azimut from 308 ° 24 ' 27 " and distance of 15 ,12m, confronting, in this stretch, with Calema Participações and Real Estate Ventures Ltda. and others, up to the vertex P4, of coordinates N = 7,090,981 ,69m and E = 710,843 ,49m; of this, follows with azimut de 334 ° 28 '23 "and distance of 22 ,81m, confronting, in this stretch, with Calema Participações and Endeavors Real Estate Ltda. and others, up to the vertex P5, of coordinates N = 7,091,002 ,28m and E = 710,833 ,66m; of this, follows with azimuth of 341 ° 53' 35" and distance of 34 ,62m, confronting, in this stretch, with Calema Participações and Real Estate Ventures Ltda. and others, up to the vertex P6, of coordinates N = 7,091,035 ,18m and E = 710,822 ,90m; of this, follows with azimuth of 31 ° 39 ' 35 " and distance of 15 ,18m, confronting, in this excerpt, with Calema Participações and Real-estate Ventures Ltda. and others, up to the vertex P1, of coordinates N = 7,091,048 ,11m and E = 710,830 ,87m; closing, thus the perimeter with 185 ,41m and the area with 1,231 ,40m²; and

Art. 2º It is the concessionaire Coastal Sul S.A. authorised to promote, with own resources, the disappropriation of the land areas and benfeits of which it treats art. 1º.

Single paragraph. The expropriating shall be allowed to invoke the character of urgency in the process of dispropriation, for purposes of impropriation in the possession, pursuant to art. 15 of the Decree-Law No. 3,365 of June 21, 1941.

Art. 3º The declaration of public utility does not exonerate the dealership of the prior obtaining of the licensing and fulfilment of the obligations attached to the environmental and other public administration bodies, necessary to the effectivation of the works and activities referred to in art. 1º.

Art. 4º This Decree comes into effect on the date of its publication.
