DECREE OF June 11, 2010.

Creates the National Park and the Silvestre Life Refuge of Good New, in the State of Bahia, and gives other arrangements

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives it the art. 84, inciso IV, of the Constitution, and with a view to the provisions of the arts. 11 and 13 of the Act no 9,985, of July 18, 2000, and what appears in the Process in the 02001.006918 /2005-09,

DECRETA:

Art. 1º Ficam created the National Park of Boa Nova, with approximately 12,065 ha, and the Silvestre Life Refuge of Boa Nova, with approximately 15,024 ha, located in the Municipalities of Boa Nova, Manoel Vitorino and Darius Meira, in the State of Bahia, whose goals are:

I-protect integrally and regenerate the natural ecosystems of the transition between Mata Atlantica and Caatinga, especially the Mata-de-Cipó;

II-ensure the maintenance of viable populations of species of birds and mammals threatened with extinction, especially the gravatazeiro (Rhopornis ardesiacus);

III-maintain and retrieve manancients and courses d' água;

IV-enabling the development of environmental education and interpreting activities, recreation in contact with nature and ecological tourism; and

V-enabling the development of scientific research.

Paragraph single. The Refuge of Life Silvestre de Boa Nova has also for the purpose of providing connectivity between the areas of the National Park of Boa Nova.

Art. 2º The National Park of Boa Nova has its limits described from the cartographic basis elaborated by the Oversight of the Development of the Northeast-SUDENE, Cartas Manoel Vitorino (SD-24-Y-B-I) and Potions (SD-24-Y-B-IV), on the 1:100.000 scale, published in Transverse Universal Projection of Mercator, Fuso 24, Datum Horizontal Stream Joyous, with the following descriptive memorials:

Art. 5th Ficam allowed in the damping zone of the National Park of Good New and the Life Refuge Silvestre de Boa Nova the mining activities authorized by the National Department of Mineral Production-DNPM and licensed by the competent environmental organ till the date of publication of this Decree.

Single paragraph. They may be allowed, within the limits of the buffer zone of the units, mining endeavors that obtain the authorizations of which it treats the caput of this article after the publication of this Decree, respected the provisions of the plan of manhandling of the units, when there are.

Art. 6º Ficam excluded from the Park boundary National and the Life Refuge Silvestre de Boa Nova the bed and the domain strip of the Federal Highway BR 030.

Art. 7º Stay authorized the administration and maintenance of the Brumado II/ Funnel C-1 BA Transmission Line on the stretch situated within the limits of the conservation units.

Art. 8º It's up to the Chico Mendes Institute of Conservation of Biodiversity-Institute Chico Mendes administer the Boa Nova National Park and the Silvestre Life Refuge of Boa Nova, adopting the necessary measures to its effective protection, deployment and control.

Art. 9º The Chico Mendes Institute is expected to conduct detailed diagnosis of uses and vegetable cover of the lands in the particular properties of the Silvestre Life Refuge of Boa Nova within a maximum period of one year from the publication of this Decree, in order to characterize and map the anthropized areas to subsidize the zoning of the unit and the definition of the uses in the private properties.

Art. 10. In The Refuge of Life Silvestre de Boa Nova will be allowed the activities of raising domestic animals, the cultivation of plants and other forms of land use and natural resources compatible with the objectives of the unit, in the form of which dispens the Plan of Manejo and too much regulations.

Art. 11. They become declared of public utility, for the purposes of dispropriation, by the Chico Mendes Institute, the existing private rural real estate in the limits described in art. 2nd of this Decree, in the terms of the arts. 5th, paragraph? k?, and 6th of the Decree-Law no 3,365, of June 21, 1941.

Single paragraph. The Advocate General of the Union, through its legal unit of implementation with the Chico Mendes Institute, shall be authorized to promote the relevant administrative and judicial measures, aiming at the declaration of nullity of possible securities of property and respective real estate records considered irregular, incidents in the conservation unit of which it treats this article.

Art. 12. This Decree comes into effect on the date of its publication.
