DECREE OF February 2, 2005

Outorga à Porto Primavera Transmitter de Energia Ltda. concession for exploration of the public service of electric power transmission, from the transmission line at 230 kV interconnecting the Substation Porto Primavera, located in the State of São Paulo, to the Golden Substation, located in the State of Mato Grosso from the South, as well as from the transmission line at 230 kV interconnecting the Substation Porto Primavera, located in the State of São Paulo, to the Imbirussu Substation, located in the State of Mato Grosso do Sul.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution that confers it on art. 84, incisions IV, of the Constitution, and with a view to the provisions of the Laws 8,987, of February 13, 1995, 9,074, of July 7, 1995, 9,491, of September 9, 1997, and 9,648, of May 27, 1998, and what is stated in the Case No. 48500.001318 /04-73,

DECRETA:

Art. 1º Stay outward to the Port Spring Transmitter Power Lt. grant for exploration of the public service of electric power transmission, upon construction, operation and maintenance and too much facilities necessary to the functions of measurement, supervision, protection, command, control, telecommunication, administration and support of the following endeavors:

I-LT Porto Spring-Golden-230 kV, simple circuit, with approximate extension of 190 km, with origin in the Substation Porto Primavera, located in the State of São Paulo, and termination at the Golden Substation, located in the State of Mato Grosso do Sul;

II-LT Porto Spring-Imbirussu-230 kV, simple circuit, with approximate extension of 300 km, with origin at the Porto Primavera Substation, located in the State of São Paulo, and terminus at the Imbirussu Substation, located in the State of Mato Grosso do Sul;

III-Substation Imbirussu, with two transformative units of 230/138 kV, 150 MVA each, located in the Municipality of Campo Grande, in the State of Mato Grosso do Sul; and

IV-LT UHE Port Spring-Substation Port Spring-440 kV, double circuit, with approximate extension of 1 km, with origin in UHE Port Spring Substation and end at the Port Spring Substation, both located in the State of São Paulo.

Art. 2º The granting of which treats this Decree will be invigorated by the thirty-year term, counted from the date of signing of the respective Grant Contract of Electrical Power Transmission Service.

§ 1º The Contract should be signed within thirty days, counted from the convocation made by the National Electrical Power Agency-ANEEL, under penalty of ineffectiveness of the concession ora outorgada.

§ 2º The application of the Port Spring Transmitter de Energia Ltda. à ANEEL, presented up to thirty six months before the end of the caput's constant deadline of this article, the concession may be extended under the conditions that are stipulated.

Art. 3º The existing goods and facilities in function of the electric power transmission service are linked to the public services granted, vetoed their alienation, assignment, transfer or dation in warranty, without prior and express authorization from ANEEL.

Paragraph single. Fining the term of the concession, the goods and facilities linked to the provision of the service granted will revert to the Union, in the manner provided for in law and in the Grant Agreement.

Art. 4º This Decree goes into effect on the date of its publication.
