PROVISIONAL MEASURE NO. 2.051-6, OF August 28, 2000.

Institutes the Gratification of Incentive to Docency and the Other Provides.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives it the art. 62 of the Constitution, adopts the following Provisional Measure, with force of law:

Art. 1º Stay instituted, as of 1º January 2000, the Gratification of Incentive to Docency, due to the occupants of the effective posts of teacher from 1º and 2º Graus at the federal educational institutions related in Annex I.

§ 1º The gratification instituted in the caput of this article will have as a maximum limit eighty points per server, corresponding to each point to the value set out in Annex II, obeyed to the limit set in the art. 2º of Law No. 8,852 of February 4, 1994.

§ 2º The overall monthly scoring limit will correspond, in each institution, to seventy and three times the number of teachers of 1º and 2º active Graus, and the score awarded to each teacher will observe regulation by it established, which will necessarily include the weekly hourly load in classroom, the number of students under their responsibility, the qualitative evaluation of their classes and participation in programs and projects of interest of the institution.

§ 3º The observance of the provisions of the art. 57 of Law No. 9,394 of December 20, 1996 is a mandatory condition for the assignment of punctuation to the teacher that it treats this Provisional Measure.

§ 4º The Executive Power shall lay down the basic requirements for the regulation of which it treats § 2º.

§ 5º Federal educational institutions, listed in Annex I to this Interim measure, will give prior knowledge to the Ministry of Education of the regulations referred to in § 2º, and will publish them in the Official Journal of the Union, effective from thirty days of the said publication.

§ 6º The periodicity of the review of the score of the teachers, pursuant to § 2º, may not be more than one year.

§ 7º For purposes of calculating Gratification in the holiday months of the supervisor or students, it will be considered the average score achieved in the twelve months immediately prior to the competence of the effective payment.

Art. 2º The Gratification of which treats the previous article will be paid together, in a non-cumulative manner, with the Activity Gratification of which it treats the Delegated Law No. 13, of August 27, 1992.

Art. 3º Up to the duration of the regulations of which it treats § 2º of the art. 1º, Gratification will be calculated based on scoring corresponding to sixty percent of the limit set in Paragraph 1º of that article.

Single paragraph. Until it is possible the calculation provided for in art 1º, the provisions of the caput of this article will be observed for the payment of those plots.

Art. 4º The server that does not post score will only make jus à Gratification, calculated on the basis of sixty per cent of the maximum points limit set in § 1º of the art. 1º, when you find:

I-ceded for exercise of special nature or DAS 6, 5 or 4, in the equivalent post in the Federal Public Administration;

II-in exercise of Directing Cargo-CD or Role Gratified in the institution itself;

III-remoteness authorized by the institution for course of specialization, master's or doctoral degree in another institution.

Single paragraph. The teacher who finds himself in the situations foreseen in the inciso II will be able to opt for the perception of Gratification on the basis of his / her score effectively achieved, should it be posited.

Art. 5º For purposes of embedding to the tastings of retirees or pension, the Gratification:

I-will only be due if you have noticed at least two years of activity;

II-will be calculated by the arithmetic average of the last twenty-four months prior to Retirement.

Art. 6º Stay vetted, from the publication of this Provisional Measure, the redistribution of Teachers from 1º and 2º Graus with undergraduate schooling to the institutions referred to in Annex I.

Art. 7º On the values set out in Annex II, the general readjustment indices granted to civil federal civil servants from the publication of this Provisional Measure.

Art. 8º Stay. readjusted by thirty percent, as of 1º January 2000, the values set in reais in the Annex to Law No. 9,678 of July 3, 1998.

Single paragraph. The Gratification instituted by Law No. 9,678, of 1998, is due, equally, to the occupants of effective positions of Professor of the Higher Mystery of the Federal Institutions of Military Higher Education.

Art. 9º Stat convalidated the acts practiced on the basis of the Provisional Measure No. 2.051-5, of July 28, 2000.

Art. 10. This Interim Measure takes effect on the date of its publication.
