Changes the provisions of the art. 84 of the Law No. 7,210 of July 11, 1984-Criminal Enforcement Act, to establish criteria for the separation of inmates in the penal establishments.

THE CHAIRWOMAN OF THE REPUBLIC

I do know that the National Congress decrees and I sanction the following Law:

Art. 1º The art. 84 of Law No. 7,210 of July 11, 1984-Criminal Enforcement Act, passes on the invigoration with the following amendments:

" Art. 84. ........................................................................................................

§ 1º Interim inmates will be separated in accordance with the following criteria:

I-accused by the practice of heinous or similar crimes;

II-accused by the practice of crimes committed with violence or serious threat to the person;

III-accused by the practice of other crimes or contraventions diverse of those pointed out in the incisos I and II.

§ 3º The condemned inmates will be separated from agreement with the following criteria:

I-convicted of the practice of heinous or similar crimes;

II-recidials condemned by the practice of crimes committed with violence or grave threat to the person;

III-primaries condemned by the practice of crimes committed with violence or serious threat to the person;

IV-too many convicted of the practice of other crimes or contraventions in a diverse situation of those provided for in the incisos I, II and III.

§ 4º The inmate who has his or her physical, moral or psychological integrity threatened by coexistence with the remaining inmates will be segregated in one's own location. " (NR)

Art. 2º This Law comes into effect on the date of its publication.
