I do know that the NATIONAL CONGRESS has approved, and I, ANTÔNIO CARLOS MAGALHÃES, PRESIDENT OF THE FEDERAL SENATE, pursuant to the art. 48, item 28, of the Rules of Procedure, promulgated the following:

LEGISLATIVE DECREE NO. 125, OF 2000.

Protest the text (*) of the Convention on the Combat of Corruption of Foreign Public Officials in International Commercial Transactions, concluded in Paris, on December 17, 1997.

THE NATIONAL CONGRESS,

Decrees:

Art. 1º It is approved the text of the Convention on Combat Corruption of Foreign Public Officials in International Commercial Transactions, concluded in Paris, on December 17, 1997.

Single paragraph. They are subject to the approval of the National Congress any acts involving revision of the said Convention, as well as any acts which, in the terms of art. 49, I, of the Federal Constitution, entail burdensome charges or commitments to the national heritage.

Art. 2º The prohibition of refusal to provide legal mutual assistance, provided for in Article 9-Legal Aid Reciprocal, Paragraph 3, of the Convention on the Combat of Corruption of Foreign Public Officials in International Commercial Transactions, concluded in Paris, on December 17, 1997, is to be understood as a prohibition on refusal based solely on the institute of banking secrecy, in thesis, and not the refusal to proceed from obedience to the legal norms pertinent to the matter, members of the Brazilian legal planning, and the interpretation concerning its application, made by the competent Court, to the concrete case.

Art. 3º This Legislative Decree goes into effect on the date of its publication.
