DECREE OF February 17, 2004.

Declarations of public utility, for purposes of dispropriation, total or partial, or institution of administrative servitude of passage, in favor of Brazilian Petroleum S.A. -PETROBRÁS, the real estate that mentions, situated in the states of São Paulo and Rio de Janeiro, necessary for the construction of the Campinas-Rio de Janeiro pipeline, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives it the art. 84, inciso IV, of the Constitution, and with a view to the provisions of the art. 8th, inciso VIII, of the Law no 9,478, of August 6, 1997, in the Decree-Law no 3,365 of June 21, 1941 and in the Decree-Law no 1,075 of January 22, 1970 and what is stated in the ANP Process in the 48610.010305 /2002-48,

DECRETA:

Art. 1º Ficam declared of public utility, for the purposes of dispropriation, total or partial, or institution of administrative servitude of passage, understood the non-edifying area, in favor of the Brazilian Oil S.A. -PETROBRÁS, or of company by it controlled directly or indirectly, the real estate constituted of land and benfeits, of particular property, understood in the lanes of land located in the states of São Paulo and Rio de Janeiro, in the excerpts between the Cities of Paulinina-SP and Taubaté-SP, Tauba-SP and Paracambi-RJ, Paracambi-RJ and Japeri-RJ, necessary for the construction of the Campinas-Rio de Janeiro pipeline, and of pipelines for movement and transport of natural gas, oil and derivatives.

§ 2º The strip of land referred to in the caput of this article, with approximately 15,340,000 m², relative to the stretch between Tauba-SP and Paracambi-RJ of the Campinas-Rio pipeline of January, located in the State of São Paulo, in the Municipalities of Taubtill, Pindamonhangaba, Roseira, Aparecida do Norte, Guaratinguetá, Canas, Lorraine, Cachoeira Paulista, Silveiras, Areias, São José do Barreiro, Arapeí and Bananal, and in the State of Rio de January, in the Municipalities of Resende, Barra Mansa, Volta Redonda, Pinheiral, Piraí and Paracambi, thus describes itself and characterizes: strip of land with 65 m wide and 236,000 m approximate extension, whose axis has start at the point of coordinates N=7.497.164,00 and E=629.695,00, located on the side of the NARROW / Volta Redonda duct strip, in the Municipality of Paracambi, in the State of Rio de Janeiro; of this point, with general direction southwest and distance of 4,704.51 m, comes to the point of coordinates N=7.496.942,00 and E=624.986,00; of this point, with general direction northwest and distance of 1,375.30 m, comes to the point of coordinates N=7.498.045,00 and E=624.150,00; Art. 2º The Brazilian Oil S.A. -PETROBRÁS, or company by it directly or indirectly controlled, is authorized to promote, with own resources, amicably or judicially, the partial or total misappropriation, or to institute the administrative servings of passage, understood the non-edifying area, in which case they will be compensated, when fully fit, the already indensed values in the perpetual servitude of passage instituted in favor of Brazilian Petroleum S.A. -PETROBRÁS on part of the strip of land described above.

Art. 3º Brazilian Oil S.A. -PETROBRÁS, or company by it controlled directly or indirectly, in the exercise of the prerogatives secured to it by this Decree, may claim urgency for the purpose of the prior immission of possession, pursuant to the art. 15 of the Decree-Law No. 3,365 of June 21, 1941 and of the Decree-Law No. 1,075 of January 22, 1970.

Art. 4º This Decree comes into force on the date of its publication.
