DECREE OF July 7, 2005

Declara of public utility, for purposes of disappropriation, total or partial, or of administrative servitude institution, in favor of Brazilian Petroleum S. A-PETROBRÁS, or of society by it controlled, directly or indirectly, the real estate constituted of land and benefiters, necessary for the construction of the GASCAB III pipeline and its complementary facilities, in the Municipalities of Quissamã, Carapebus and Macaé, in the State of Rio de Janeiro, and gives other arrangements.

THE VICE PRESIDENT OF THE REPUBLIC, in the exercise of the post of PRESIDENT OF THE REPUBLIC, using the assignment that gives him the art. 84, inciso IV, of the Constitution, and with a view to the provisions of the art. 8 o, inciso VIII, of Law n o 9,478, of August 6, 1997, in the Decree-Law n o 3,365 of June 21, 1941, in the Decree-Law n o 1,075 of January 22, 1970, and what appears in the ANP Process n o 48610.003603 /2004-43,

DECRETA:

Art. 1 the Ficam declared of public utility, for purposes of dispropriation, total or partial, or of administrative servitude institution, in favor of Brasileiro Petroleum S.A. -PETROBRÁS, or of society by it controlled, directly or indirectly, the real estate constituted of land and benefiters, of particular property, excluded from the public domain goods, understood in the sixty-five metre strip of land wide, situated in the Municipalities of Quissamã, Carapebus and Macaé, in the State of Rio de Janeiro, in the stretch of Barra do Furado to Cabiúnas, where in twenty metres wide of the same track there are already perpetual passages of passage definitively instituted in favor of PETROBRÁS, necessary for the construction of the Barra da Furado-Cabiúnas pipeline (GASCAB III), an integral part of the Director Plan of Gas Flow of the Fields-PDEG Basin, and of its complementary facilities.

§ 1 o The strip of land referred to in the caput of this article, with approximately four million, four hundred and four thousand five hundred and thirty square metres of area, sixty five metres wide and sixty-seven thousand, seven hundred and sixty-two metres of extension, thus describes and characterize: having as a origin of coordinates Ecuador and Central Meridian-39 the WGR (Zone 24), constants of the coordinates 10,000 km N and 500 km E, its axis has started at the Furado Bar Station, with coordinates N=7.553.087,05 and E=275.428, 35 and follows the following profiled: from this point, with NW bearing and distance of 1,154.31 m, crossing the RJ State Highway-196, arrive at the coordinates point N=7.553.527,51 and E=274.361, 38; Art. 2 the A PETROBRÁS, or society by it controlled, directly or directly, is allowed to promote, with own resources, friendly or judicially, the misappropriation, total or partial, or the institution of administrative servitude of which it treats art. 1 o, and may, including, invoke the character of urgency for purposes of provisional immission in the possession of the goods, pursuant to the art. 15 of the Decree-Law n o 3,365, of June 21, 1941, and of the Decree-Law n o 1,075, of January 22, 1970.

Art. 3 the This Decree comes into effect on the date of its publication.

Art. 4 the Stay revoked the Decree of January 8, 2004, which declares of public utility, for the purposes of dismispropriation, total or partial, or institution of servitude of passage, in favor of Brazilian Petroleum S.A. -PETROBRÁS, the real estate that mentions, in the State of Rio de Janeiro, and gives other arrangements.
