DECREE N ° 3,809, OF April 30, 2001

Disposes on the execution of the Twenty-XX_ENCODE_CASE_CAPS_LOCK_On eighth protocol additional to the Economic Supplementation Agreement No. 18, among the Governments of the Republic Federative of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, of December 29, 2000.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution that confers it on art. 84, inciso IV, of the Constitution,

Considering that the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), signed by Brazil on August 12, 1980 and approved by the National Congress, by Legislative Decree No. 66 of November 16, 1981, provides for the modality of Partial Reach Agreement of Economic Supplementation;

Whereas the Partial Scope Agreement of Economic Supplementation n ° 18, of November 29, 1991, between the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, it was promulgated by Decree No. 550 of May 27, 1992;

Whereas the Plenipotentiaries of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, on the basis of the Treaty of Montevideo of 1980, signed; on December 29 of 2000, in Montevideo, the Twenty-XX_ENCODE_CASE_CAPS_LOCK_On eighth additional protocol to the Economic Supplementation Agreement No. 18, between the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay;

DECRETA:

Art. 1º The Twenty-eighth Additional Protocol to the Economic Supplementation Agreement No. 18, between the Governments of the Federative Republic of Brazil, of the Argentine Republic, of the Republic of Paraguay and of the Eastern Republic of Uruguay, apensed by copy to the present Decree, will be executed and fulfilled as entirely as it contains.

Art. 2º This Decree comes into effect on the date of its publication.

Economic Supplementation Agreement n. 18, celebrated between Argentina, Brazil, Paraguay and Uruguay

Twenty-Oitavo Additional Protocol

The Plenipotentiaries of the Argentine Republic, of the Federative Republic of Brazil, the Republic of Paraguay and the Eastern Republic of Uruguay, accredited by their respective Governments second powers that were bestowed in good and due form, deposited, opportunely at the General Secretariat of the Latin American Integration Association (ALADI),

In view of the Common Market Council Decision No 58/00.

Considering that free trade in MERCOSUR requires the security that technical standards, technical regulations and conformity assessment procedures adopted by the signatory Countries will not constitute an unnecessary barrier to trade;

Which the Signatory Countries signed, on April 15, 1994, the Final Act of the Round Uruguay of Multilateral Trade Negotiations, approving the agreements for the Constitution of the World Trade Organization (WTO), which were subsequently ratified and incorporated by the four Signatory Countries;

Which among the approved and ratified agreements is found to be the Agreement on Technical Barriers To Trade;

That the Agreement on Technical Barriers to Trade, of the World Trade Organization, contains the principles that should guide the Countries Signatories in the establishment of technical standards, technical regulations and evaluation procedures of compliance; and

That it is appropriate to incorporate the set of MERCOSUR standards into international standards that regulate the application of technical standards, technical regulations and conformity assessment procedures,

It is required in:

Single Article. Adopt the Agreement on Technical Barriers to Trade, of the World Trade Organization, as a regulatory framework for the application of technical standards, technical regulations and conformity assessment procedures in domestic, reciprocal trade, and with the remaining members of the WTO.

The General Secretariat of ALADI shall be a depositary of this Protocol, of which it will send duly authenticated copies to the signatory governments.

In faith of what, the the respective Plenipotentiaries sign the present Protocol in the city of Montevideo, .to the twenty-nine days of the month of December two thousand, in an original in the Portuguese and Spanish languages, being both texts being equally valid.
