DECREE NO 4,223, DE May 9, 2002

Promulga the Agreement for Educational Cooperation between the Government of the Federative Republic of Brazil and the Government of the Republic of Bolivia, celebrated in La Paz, on July 26, 1999.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, inciso VIII, of the Constitution,

Considering that the Government of the Federative Republic of Brazil and the Government of the Republic of Bolivia concluded, in La Paz on July 26, 1999, an Educational Cooperation Agreement ;

Considering that the Agreement entered into force on August 13, 2001, pursuant to paragraph 1º of its Article XVII ;

D E C R E T A:

Art. 1º The Agreement for Educational Cooperation between the Government of the Federative Republic of Brazil and the Government of the Republic of Bolivia, concluded in La Paz, on July 26, 1999, attached by copy to this Decree, shall be implemented and served as entirely as it does in it.

Art. 2º They are subject to the approval of the National Congress any acts that may result in revision of the said Agreement, as well as any further adjustments that, in the terms of the art. 49, inciso I, of the Federal Constitution, carries charges or engraved commitments to national heritage.

Art. 3º This Decree goes into effect on the date of its publication.

EDUCATIONAL COOPERATION AGREEMENT BETWEEN THE GOVERNMENT OF THE FEDERAL REPUBLIC OF BRAZIL AND THE GOVERNMENT OF THE REPUBLIC OF BOLIVIA

The Government of the Federative Republic of Brazil

and

The Government of the Republic of Bolivia

(henceforth referred to as "Contracting Parties"),

Recognizing the importance of cooperation between both countries in the educational field,

Aware that the accelerated global scientific and technological development requires a new vision to seek the excellence of its human resources, and

In the aim of incrementing educational and interuniversity cooperation between both countries, making the traditional friendship that unites Brazil and Bolivia increasingly solid,

Wake up the following:

ARTICLE I

ARTICLE II

This Agreement, without prejudice to the arrangements made directly between educational institutions and other related entities of both countries, observed the laws of the Contracting Parties, shall be aimed at:

a) the strengthening of educational and inter-university cooperation ;

b) the training and enhancement of lecturers and researchers ;

c) the exchange of information and experiences ;

and) the increment of scientific production.

ARTICLE III

The Contracting Parties shall seek to achieve the objectives set out in Article II, by promoting the development of cooperative activities at the different levels and modalities of teaching, by means of:

b) exchange of teaching and research missions, short or long duration, for development of previously established activities between institutions of higher education ;

c) joint drafting and execution of projects and research, as well as exchange of documentation and publication of the results of such research ;

d) exchange of technicians, specialists and leaders with the purpose of improving the reciprocal knowledge of their respective fundamental, medium and professional education systems, as well as of the didactic programmes and methods ;

e) exchange of students and teachers established between middle and professional education institutions ; and

f) exchange of superior level discents in the different areas of knowledge.

ARTICLE IV

1.Cada Contracting Party shall seek to encourage the creation and operation, in the territory of the other Contracting Party, of institutions for the teaching and dissemination of their languages and cultures.

2.As Contracting Parties will seek to grant facilities for the admission and permanence of teachers hired by the institutions referred to in this Article.

ARTICLE V

Each Contracting Party will look for:

a) stimulate, as a foreign language option, in the middle and upper level curricula, the language teaching of the other Contracting Party, respecting the priorities established in each country on the subject ;

b) to promote, in postgraduate or university extension courses, the teaching of the literature, history and culture of the other Contracting Party ; and

c) create disciplines, optional and non-curricular, Portuguese language, Brazilian literature and culture at Bolivian universities, as well as Bolivian national literature, culture and national languages at Brazilian universities.

ARTICLE VII

1.Cada Contracting Party will allow the admission of national students from the other Contracting Party to their educational establishments, exempting them from tuition fees and tuition fees during the course, within the framework of specific programmes of exchange.

2.A students' selection of this Article shall be carried out by the relevant national authorities, in accordance with the procedures in force, and coordinated by the foreign ministries of each country, observing:

a) the fulfilment of the objectives proposed in this Agreement ; and

b) the current regulation of each country for the selection of candidates, as well as the standards of conduct to be fulfilled by the students.

3.Cada Contracting Party will give notice to the other of the regulation of each country for the selection of students that it treats this Article.

ARTICLE VIII

1.Os students from the Contracting Parties who are on the margins of specific academic exchange programmes shall comply with the administrative and academic provisions in force in the country in which the studies will be carried out.

2.A effectivation of the transfer, from one country to the other, of the university students of which it treats this Article, will comply with the specific norms and rules of the country that will host it.

ARTICLE IX

b) are employees accredited as members of Diplomatic Mission or Consular Repartition in the territory of one of the Contracting Parties.

ARTICLE X

1.O Recognition and / or re-validation of diplomas and academic titles awarded by the higher education institutions of each of the Contracting Parties shall be subject to the legislation of the country in which it is requested.

2.Para exclusive admission purposes in graduate courses, will be accepted, with no need for revalidation, the higher level diplomas exited by officially registered and recognized higher education institutions in their respective countries, provided that they are duly registered by the competent offices and the local consular authority.

XI ARTICLE

1.As Contracting Parties, through their competent governmental bodies, shall ensure the immediate recognition and exploitation of the fundamental and medium level studies or their equivalents in the area of formal education, in accordance with the equivalence table appended to this Agreement. They will also ensure the dispensation of examinations in the subjects of History, Geography, Civic Statement, Portuguese and Spanish.

2.Os certificates of completion of studies corresponding to the fundamental and medium levels should be legalised by the competent consular allocation. It will be accepted the "School History", in the Brazilian case, and the "Bachiller Title" or the "Studios Certificate", in the Bolivian case.

ARTICLE XII

1.Os completed studies in the adult education modality will be revalidated in the same manner as provided for in Article XI of this Agreement.

2.Os studies not completed in this same modality of teaching will be revalidated in function of the disciplines previously completed with approval, adjusting the remaining to the curriculum structure and the current modality in each country.

ARTICLE XIII

The Contracting Parties shall stimulate the permanent exchange of experience in the educational area, as well as to communicate possible modifications to the series and levels classifications and their respective legislations.

ARTICLE XIV

The competent authorities of the Contracting Parties shall study the means most appropriate to the perfect implementation of the Agreement and shall propose any necessary modifications, making efforts to create conditions conducive to the full realization of the high objectives of this Agreement.

XV ARTICLE

To ensure the implementation of this Agreement, the Contracting Parties shall meet periodically by mutual interest, on a date to be established by diplomatic means.

ARTICLE XVI

The present instrument will replace, on the date of its entry into force, the parties regarding the educational themes of the Cultural Exchange Convenium, concluded between the Federative Republic of Brazil and the Republic of Bolivia, in 29 of March 1958.

ARTICLE XVII

1.Cada Contracting Party shall notify the other on the fulfilment of the respective internal legal formalities for the duration of this Agreement, which shall enter into force 30 (thirty) days after the date of the last of these notifications.

2.O this Agreement may be modified in accordance with paragraph 1 of this Article.

3.O this Agreement shall have validity for an indefinite time, unless one of the Contracting Parties shall communicate to the other, by diplomatic note, its decision to denounce it. The complaint shall take effect 6 (six) months after the date of the said note.

Done in the city of La Paz on July 26, 1999, in two original copies, in the Portuguese and Spanish languages, both of which are equally authentic texts.

INTERPRETATION OF THE EQUIVALENCE TABLE

1.A Fundamental Education in Brazil amounts to the Primary level in Bolivia.

2.A Reading Table of Equivalence is horizontal up to the 2º Year Secondary in the Bolivian structure and the 2º Middle Year in the Brazilian structure.

3.A completion of the 2º Middle Year in Brazil gives you the right to join the 3º Year Secondary in Bolivia, and must be completed with the 4º Year Secondary for obtaining the "Bacheller Title".

4.A completion of the 2º Year Secondary in Bolivia gives right to admission to the 3º Middle Year in Brazil, where the Brazilian Average Education studies are completed.

5.A completion of the 3º Year Secondary in Bolivia requires curing the 3º Middle Year in Brazil, for the recognition of the conclusion of Brazilian
