DECREE NO 4,373, DE September 12, 2002

Promulga the Agreement between the Government of Federative Republic of Brazil and the Government of the French Republic on the Construction Project of a Bridge over the Oiapoque River, celebrated in Brasilia, on April 5, 2001.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, inciso VIII, of the Constitution, and

Considering that the Government of the Federative Republic of Brazil and the Government of the French Republic celebrated, in Brasilia, on April 5, 2001, an Agreement on the Construction Project of a Bridge over the Oiapoque River ;

Considering that the National Congress has approved this Agreement by means of Legislative Decree No. 140, of June 19, 2002 ;

Considering that the Agreement entered into force in 1º September 2002 ;

D E C R E T A:

Art. 1º The Agreement between the Government of the Federative Republic of Brazil and the Government of the French Republic on the Construction Project of a Bridge on the Oiapoque River, concluded in Brasilia on April 5, 2001, attached by copy to this Decree, shall be executed and fulfilled as entirely as it contains.

Art. 2º They shall be subject to the approval of the National Congress any acts that may result in revision of the said Agreement, as well as any further adjustments which, pursuant to the inciso I of the art. 49 of the Federal Constitution, carries charges or written commitments to national heritage.

Art. 3º This Decree shall enter into force on the date of its publication.

Agreement between the Government of the Federative Republic of Brazil and the Government of the French Republic on the Construction project of a Bridge over the Oiapoque River

The Government of the Federative Republic of Brazil

and

The Government of the French Republic

(henceforth named?Parts?),

Considering the Framework Agreement for Cooperation between the two countries signed on May 28, 1996 ;

Animated by the desire to foster cross-border bilateral relations in all its strands ; and

Wishing favoring the conditions for sustainable development on both sides of the border common, strengthening the bilateral partnership,

Wake up the following:

Article 1

With the purpose of building an international bridge over the Oiapoque River, uniting the state of the Amapá and French Guiana, the Parties decide to begin examination of questions regarding the construction and operation of the said bridge, through their respective local authorities.

Article 2

1.Para the purposes mentioned in Article 1 of this Agreement, the Parties create a Bilateral Commission, composed of a representative of each of the competent ministries of the two Governments and of representatives of the State of Amapá and French Guiana.

2.Cada Party shall designate a Head of Delegation and notify it to the other Party.

3.Os two Heads of Delegation shall establish, by common accord, the Commission Regulation Bilateral.

Article 3

The Bilateral Commission will be aiming to coordinate the decisions of both Governments regarding the project. For this purpose, it will be within your competence:

to) gather the available data and provide the necessary additional studies concerning the technical, environmental, economic and financial aspects of

b) on the basis of such studies, propose the location and technical, administrative and financial modalities for the achievement and operation of the work ;

c) propose, at the request of the Parties, the terms of international contract of public works containing the definition of the work, the form of management and the modalities of funding and operation of the work ;

d) propose, at the request of the Parties, the terms of an edition of international public works bidding containing the definition of the works to be performed and the process of choosing the performers.

Article 4

Within the limit of available budget resources:

a) Each Party shall be responsible for the spending arising from its representation in the Commission Bilateral ;

(b) The cost of the studies mentioned in Article 3 of this Agreement shall be divided equally between the Parts. These studies can be the subject of funding by international credit agencies.

Article 5

1.As Parties shall notify each other about compliance with their respective internal legal formalities necessary for the entry into force of this Agreement.

2.O this Agreement shall enter into force on the first day of the second month following the date of receipt of the second notification

3.Qualquer one of the Parties may, at any time, denounce the present Agreement, by diplomatic means and in writing, at minimum notice of 6 (six) months.

Done in Brasília, on April 5, 2001, in two original copies, in the Portuguese languages and french, being both equally authentic texts.
