DECREE NO 4,877, DE November 13, 2003

Discipline the process of choosing leaders within the Federal Centers for Technological Education, Federal Technical Schools and Federal Agrotechnical Schools.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, inciso VI, paragraph "a", of the Constitution,


Art. 1º Federal Technological Education Centres, Federal Technical Schools and Federal Acrotechnical Schools will be directed by a Director-General, appointed by the Minister of State for Education, from the indication made by the school community, in the terms of this Decree.

Art. 2º Competes to the Director Council of each institution to plague the process of choice, by the school community, of the name to be appointed to the Minister of State for Education for the post of Director-General.

Art. 3º The conduct of the process of choice by the school community of which it treats art. 2º will be entrusted to the Electoral Commission, instituted specifically for this purpose, which will possess the following composition:

I. three representatives of the faculty ;

II. three representatives of the technical-administrational servers ; and

III. three representatives of the student body.

§ 1º The representatives of each segment will be elected by their peers.

§ 2º The names chosen will be forwarded to the Board Director for publication of portry containing the names of all members of the Electoral Commission thus constituted.

§ 3º At the installation meeting of the proceedings, the Election Commission shall appoint its Chairman.

Art. 4º May apply for the post of Director-General the lecturers belonging to the Institution's Permanent Active Personnel Board, with at least five years of effective exercise at the Education Institution.

§ 1º From the choice process to which you refer to the caput will participate in all the servers that make up the Institution's Permanent Active Personnel Framework, as well as regularly enrolled students.

§ 2º You will not be able to participate in the process of choice referred to in § 1º:

I. substitute teachers hired on the basis of Law No. 8,745 of December 9, 1993 ;

II. servers hired by service outsourcing companies ; and

III. occupants of direction positions without bond with the institution.

Art. 5º In all cases the secret and uninominal vote shall prevail, observing the weight of two thirds for the manifestation of the servers and one-third for the manifestation of the student body, in relation to the total of the consulted universe.

Single Paragraph. For the purposes of this article, the votes of lecturers and technical-administrative ones are counted in a parity and joint manner.

Art. 6º The name of the candidate chosen, upon strict and cumulative observance of the provisions of the arts. 2º, 3º, 4º and 5º, shall be forwarded by the Chairman of the Board Director to the Minister of State for Education, at least thirty and at most sixty days before the end of the current term.

Art. 7º The mandate of Director-General of Federal Center for Technological Education, Federal Technical School and Federal Agrotechnical School will be four years, being vetoed into investiture in more than two consecutive terms.

Single Paragraph. In the case of the Federal Centers for Technological Education newly deployed upon transformation of former Federal Technical Schools or Federal Technical Schools, the restriction on investiture in consecutive terms applies to current Directors-General, computer, between their mandates, those exercised under the denomination of Federal Technical School or Federal Agrotechnical School, as per the origin of each Institution.

Art. 8º This Decree shall enter into force on the date of its publication.

Art. 9º Revoke the relays concerning the Federal Centers for Technological Education constant of the arts. 4º, 5º and 6º of Decree No 1,916, of May 23, 1996, the arts. 5º and 6º of the Annex to Decree No 2,548 of April 15, 1998, and the arts. 8º and 9º of the Annex to Decree No 2,855 of December 2, 1998.
