DECREE OF April 20, 2005

Declaration of public utility, for the purposes of misappropriation, total or partial, or institution of administrative servitude, in favor of Brazilian Petroleum S.A. -PETROBRÁS, the real estate that mentions, constituted of land and benefits, necessary for the construction of the Manati Gaspipeline and its complementary facilities, between the Cities of Valencia and San Francisco of the Count, State of Bahia, and gives others provider.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, inciso IV, of the Constitution, and in view of the provisions of art. 8th, inciso VIII, of Law No 9,478 of August 6, 1997, in Decree-Law No 3,365 of June 21, 1941, in Decree-Law No 1,075 of January 22, 1970, and what is stated in the ANP Process at 48610.001148 /2005-22,

DECRETA:

Art. 1º Stay declared of public utility, for the purposes of dispossession, total or partial, or of institution of administrative servitude, in favor of Brazilian Petroleum S.A. -PETROBRÁS, or of company by it controlled, directly or indirectly, real estate constituted of land and benfection, of private property, excluded public domain goods, understood in the lanes of land located in the State of Bahia, in the excerpt between the Cities of Valencia and San Francisco of the Count, necessary for the construction of the Manati Gaspipeline and its complementary facilities.

§ 1º The strip of land to which the caput of this article refers, with approximately seishundred and five thousand, two hundred and fifty square meters, relative to the Manati Strip, situated in the State of Bahia, in the Municipalities of Valencia and Jaguaripe, thus describes and characterizes: strip of land with 15 m wide, whose axis has been beginning in the Praia de Guaibim, in the Municipality of Valencia, with coordinates S=13º14'8, 34 "and W=38º56' 32.58" ; from this point, with northwest bearing and distance of 2,144.15 m, arrives at the point of coordinates S=13º13'20, 76 "and W=38º57' 24, 70" ; from this point, with northwest bearing and distance of 811.9 m, traversing the Jiregçá River, which is the Divisa of Municipalities between Valencia and Jaguaripe, arrives at the point of coordinates S=13º12'56, 88 "and W=38º57' 37, 79" ; from this point, with heading northeast and distance of 2,721.64 m, arrives at the point of coordinates S=13º11'51, 16 "and W=38º56'44, 77" ; from this point, with heading northeast and distance of 4,798.67 m, comes to the point of coordinates S=13º010' 0, 39 "and W=38º54' 52, 36" ; from this point, with heading northeast and distance of 3,993.09 m, arrives at the point of coordinates S=13º09'17, 92 "and W=38º52' 48, 89" ; from this point, with heading northeast and distance of 6,559.51 m, traversing the Jaguaripe River, arrives at the point of coordinates S=13º06' 16, 22 "and W=38º51'10, 34" ; from this point, with north bearing and distance of 4,477.53 m, crossing the Mangue of the Mucujó River, arrives at the point of coordinate S=13º03' 54, 26 "and W=38º51'27, 36" ; from this point, heading north and distance of 4,671.92 m, arrives at the point of coordinates S=13º01'35, 40 "and W=38º51'57,55" ; from this point, with bearing northeast and distance of 3,025.24 m, traversing the Mata Ciliar and the BA-001, comes to the point of coordinates S=13º00'7, 72 "and W=38º51'38, 41" ; from this point, with northwest bearing and distance of 3,483.24 m, arrives at the point of coordinates S=12º58' 50, 49 " and W=38º52'54, 81 "; from this point, heading north and distance of 3,720.54 m, comes to the point of coordinate S=12º56' 56, 27" and W=38º53' 14.06 ", where there is the encounter with the existing range of the ORSUB, where the present description is closed. The descriptions are in accordance with the DE-3103.65-6521-942-PIG-010/B macro location plant, with geographical coordinate system, Datum Horizontal SAD-69, origin in Ecuador and Central Meridian 39º WGr, having their respective constants in the value of 10,000 km N and 500 km E.

§ 3º The strip of land to which the caput of this article refers, with approximately one hundred and forty-four thousand, nine hundred and thirty-six square meters, relative to the Manati strip, situated in the State of Bahia, in the Municipality of San Francisco do Conde, thus describes and characterizes: strip of land with fifteen meters wide, whose guideline has begun near the Ferrolho Compressors Station, in the Municipality of San Francisco of the Conde-BA, located on the first dormant departing from the beach, with values of geographical coordinates: S=12º41'41, 42 "and W=38º38' 18.00" ; hence, follows with general direction northeast and distance of 282.55 m, passing through access to Compressor Station, reaching the range of the existing pipeline (6 "), at the point of coordinate S=12º41'35, 73" and W=38º38' 11, 83 " ; from this point, following the existing track on the course northeast at a distance of 1,787.45 m, crossing again the road of access to the Ferrolho Compressors Station, land access to St. Paul Street, arrives at the point of coordinates S=12º41'8, 91 "and W=38º37' 19, 63" ; from this point, at a distance from 427.75 m, on the northeast course, parallel to the Ferrolho Road, arrives at the point of coordinates S=12º41'13, 43 "and W=38º37' 6, 24" ; hence, with heading northeast and distance of 3,053.35 m, crossing the remarkable points: Ferrolho Road, tide stretch, Street Tip of the Coco, transmission line (69kv), comes to the point of coordinates S=12º40'44.56 "and W=38º35' 30, 63" ; hence, continuing with general north-east bearing and distance 2,373.35 m, arrives at the point of coordinate S=12º40'5, 99 "and W=38º34' 22, 97", found in BA-522 ; hence, following with general south-east and distance of 226.98 m, arrives at the point of coordinates S=12º40'7.57 "and W=38º34' 15, 85" ; from this point, leaving the range of the existing duct and following in the south-east bearing with distance of 459.72 m, crossing the access to UPGN and Dutovia Aratú, comes to the point of coordinates S=12º40'12, 73 "and W=38º34' 2, 46" ; hence, it follows with northeast bearing and distance of 1,036.22 m, parallel to the existing street, up to the point of coordinates S=12º39'44, 84 "and W=38º33' 52, 64", located in the courtyard where the San Francisco Station will be built, ending this description The descriptions are in accordance with the DE-3103.65-6521-942-PIG-010/B macro location plant, with geographical coordinate system, Datum Horizontal SAD-69, origin in Ecuador and Central Meridian 39º WGr, having their respective constants in the value of 10,000 km N and 500 km E.

Art. 2º Brazilian Oil S.A. -PETROBRÁS, or the company by it controlled, directly or indirectly, is authorized to promote, with own resources, amicable or judicially, the dispropriation or institution of administrative servings of which it treats art. 1º, and may even invoke the character of urgency for the purposes of provisional immission in possession of the goods, in the terms of art. 15 of Decree-Law No. 3,365 of June 21, 1941 and of Decree-Law No. 1,075 of January 22, 1970.

Art. 3º Administrative servings instituted in the form of this Decree will be able to have their entitlement transferred to the company or consortium of companies that come to be the holder of the respective construction permit or operation of the duct.

Art. 4º This Decree shall enter into force on the date of its publication.
