DECREE OF June 5, 2008.

Disposes on the creation of the National Park Mapinguari, in the Municipalities of Canutama and Lábrea, in the State of Amazonas, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, inciso IV, of the Constitution, and in view of the provisions of art. 11 of Law No 9,985 of July 18, 2000, and what is stated in the Process at 02001.003552 /2006-99,

DECRETA:

Art. 1st It is created the Mapinguari National Park in the State of the Amazonas, in the Municipalities of Canutama and Lábrea, with the goal of preserving natural ecosystems of great ecological relevance and scenic beauty, with prominent to important savannah encrymes of the Purus-Matar interflurus, enabling the realization of scientific research and the development of environmental education activities, from recreation in contact with nature and ecological tourism.

Art. 2nd Mapinguari National Park has its limits described from the Carts Sheet SB.20-Y-C, Leaf SB.20-Y-D, Leaf SC.20-V-A, Sheet SC.20-V-B and Folha SC.20-V-C, at scale 1:250.000, all edited by the Directorate of the Geographical Service of the Exération-DSG, with the following descriptive memorial: initiates the description of this memorial as of point 0, of approxic flat coordinates (c.p.a.) 206594 E and 9005410 N, located in the confluence of two undenominational tributaries of the Igarapé Coari, and follows downstream by the left margin of the receiver tax up to point 1, located confluence of this tributary with the Igarapé Coari ; from the point 1, of c.p.a. 216114 E and 9014563 N, follows upstream by the left bank of the Igarapé Coari to section 2, located at the confluence of the Igarapé Coari with no denomination tax ; from point 2, of c.p.a. 226935 E and 9014985 N, follows upstream by the right margin of the tax mentioned up to point 3, located in the nascent of this tax ; § 1st Ficam excluded from the limits of the National Park Mapinguari the server tracks of the pipeline Urucu-Porto Velho and its future ramps.

§ 2nd The subsoil of the area described in the caput of this article integrates the boundaries of National Park Mapinguari.

Art. 3rd Stay established as a limit of the damping zone of the National Park of the Mapinguari the banner of ten kilometers in horizontal projection, from its perimeter.

Art. 4th allows the displacement of vessels along the bed of the Sugar Rios and Mucuim, in the interior of Mapinguari National Park, as per the provisions of the conservation unit's Manejo Plan.

Art. 5th It is up to the Chico Mendes Institute for Conservation of Biodiversity-Chico Institute Mendes administer the Mapinguari National Park, adopting the necessary measures to its effective implantation.

Art. 6th The Union lands contained within the limits of Mapinguari National Park, of which it treats the art. 2nd of this Decree, will be ceded to the Chico Mendes Institute by the Union Office of the Union of the Ministry of Planning, Budget and Management, in the form of the law.

Art. 7th Ficam declared of utility public, for the purposes of misappropriation, by the Chico Mendes Institute, the private rural real estate existing in Mapinguari National Park, in the terms of the arts. 5th, point?k?, and 6th of Decree-Law No 3,365 of June 21, 1941.

Single Paragraph. The Federal Prosecutor-General's Office, the Union Advocate General's Office, through its legal unit of execution with the Chico Mendes Institute, is authorized to promote the relevant administrative and judicial measures, targeting the declaration of nullity of eventual property securities and respective real estate records deemed irregular, incidents in Mapinguari National Park.

Art. 8th Stay open to the National Indian Foundation-FUNAI the continuity of withdrawals from the occupation area of the isolated indigenous groups within the boundaries of Mapinguari National Park.

Art. 9th Participation of the analysis and elaboration of the Park's Manejo Plan, the Board of National Defense, through its Executive Officer, and the Ministry of Defense.

Art. 10. In the exercise of the constitutional and legal assignments of the Armed Forces and the Federal Police in Mapinguari National Park, they are understood:

I-the freedom of transit and access, by water, air or land, from military and police for the realization of displacement, parking, patrolling and other operations or activities, indispensable to the security and integrity of the national territory ;

II-the installation and maintenance of military and police units, of equipment for surveillance and support for air and maritime navigation, as well as access routes and other necessary infrastructure and logistics measures, compatibilized with the Unit's Manejo Plan, when outside the border strip ; and

III-the deployment of programs and projects of control and occupation of the border.

Art. 11. This Decree shall enter into force on the date of its publication.
