DECREE NO 5,428 OF April 19, 2005

Disposes on the execution of the Twenty-Third Protocol Additional to the Economic Supplementation Agreement No. 39, between the Governments of the Federative Republic of Brazil and the Republic of Ecuador, of December 16, 2004.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, inciso IV, of the Constitution, and

Considering that the 1980 Treaty of Montevideo, which created the Latin American Integration Association (ALADI), struck by the Government of the Federative Republic of Brazil on August 12, 1980 and approved by the National Congress by means of Legislative Decree no 66 of November 16, 1981, provides for the modality of Economic Supplementation Agreement ;

Considering that the Plenipotentiaries of the Governments of the Federative Republic of Brazil, and of the Republic of Colombia, of the Bolivarian Republic of Venezuela, the Republic of Ecuador and the Republic of Peru (member states of the Andean Community), on the basis of the Treaty of Montevideo of 1980, signed, on August 12, 1999, in Montevideo, the Supplementation Agreement Economic in the 39, between the Governments of the Federative Republic of Brazil, and of the Republic of Colombia, the Bolivarian Republic of Venezuela, the Republic of Ecuador and the Republic of Peru, member states of the Andean Community, incorporated into the law Brazilian internal by the Decree No 3,138 of August 16, 1999 ;

Considering that the Plenipotentiaries of the Federative Republic of Brazil and the Republic of Ecuador, based on the Treaty of Montevideo of 1980, signed on December 16, 2004, in Montevideo, the Twenty-Third Additional Protocol to the Agreement on Economic Supplementation No. 39, between the Governments of the Federative Republic of Brazil and the Republic of Ecuador ;

DECRETA:

Art. 1º It shall be promulgated, for all purposes, the Twenty-Third Additional Protocol to the Economic Supplementation Agreement No. 39, between the Governments of the Federative Republic of Brazil and the Republic of Ecuador, attached by copy to the present Decree.

Art. 2º This Decree shall enter into force on the date of its publication.

ECONOMIC SUPPLEMENTATION AGREEMENT NO 39

SIGNED BETWEEN THE REPUBLICS OF COLOMBIA,

DO EQUADOR, DO PERU AND VENEZUELA,

COUNTRIES-MEMBERS OF THE ANDINA COMMUNITY,

AND THE FEDERATIVE REPUBLIC OF BRAZIL

Twentieth Third Additional Protocol

The Plenipotentiaries of the Federative Republic of Brazil and the Republic of Ecuador, duly authorized by their respective Governments, in accordance with the powers presented in good and due form, expeditiously deposited at the General Secretariat of the Latin American Integration Association (ALADI),

VISTA the Economic Supplementation Agreement N ° 59, signed between Argentina, Brazil, Paraguay and the Uruguay, States Parties to the MERCOSUR, and Colombia, Ecuador and Venezuela, Paison-Members of the Andean Community, for which a Free Trade Zone is established ;

CONSIDERING that it is necessary to preserve existing trade currents up to the effective entry into force of the mentioned Agreement ;

CONVEEM IN:

Article 1-Extend the duration of the Economic Supplementation Agreement N ° 39 and the paced preferences between the Federative Republic of Brazil and the Republic of Ecuador, from January 1, 2005 until March 31, 2005 or, should it occur first, until the effective entry into force of the Agreement on Economic Supplementation Paragraph 59, signed between Argentina, Brazil, the Paraguay and Uruguay, States Parties to the MERCOSUR, and Colombia, Ecuador and Venezuela, Paises-Members of the Andean Community.

Article 2-This Protocol shall enter into force on the date on which the Federative Republic of Brazil and the Republic of Equator have incorporated it into their domestic law, in accordance with their respective legislations. For so much, the Signatary Parties will be able to determine the provisional application of this Protocol, in accordance with their laws, until the procedures for their entry into force are complied with.

The General Secretariat of ALADI will be depositary of this Protocol, of which it will send duly authenticated copies to the Signatory Parties.

IN FÉ DO, the respective Plenipotentiaries sign this Protocol in the city of Montevideo, the sixteen days of the month of December of the year two thousand and four, in an original in the Portuguese and Spanish languages, both of which are equally valid texts.
