DECREE NO 3,854, DE June 29, 2001

Disposes on the execution of the Second Additional Protocol to the Economic Supplementation Agreement No. 39, between the Governments of the Federative Republic of Brazil and the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community), of April 11, 2001.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution that confers you the art. 84, inciso IV, of the Constitution ;

Considering that the 1980 Treaty of Montevideo, which created the Latin American Integration Association (ALADI), firmed up by Brazil on August 12, 1980 and approved by the National Congress through Legislative Decree No. 66 of November 16, 1981, provides for the modality of Economic Supplementation Agreement ;

Whereas, on the basis of the 1980 Treaty of Montevideo, the Economic Supplementation Agreement no 39 has been firmed up by the Plenipotentiaries of the Federative Republic of Brazil and the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community), in Montevideo, on August 11, 1999, and incorporated into the Brazilian legal order by means of Decree No 3,138 of August 16, 1999 ;

Considering that the Plenipotentiaries of the Federative Republic of Brazil and the Republic of Colombia, of the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community), on the basis of the 1980 Treaty of Montevideo, signed on November 15, 2000, in Montevideo, the First Additional Protocol to the Agreement of Economic Supplementation No. 39, incorporated into the Brazilian legal order by means of Decree No 3,744 of February 5, 2001 ;

Considering that the Plenipotentiaries of the Federative Republic of Brazil and the Republic of Colombia, of the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community), on the basis of the 1980 Treaty of Montevideo, signed on April 11, 2001, in Montevideo, the Second Additional Protocol to the Agreement of Economic Supplementation No. 39 ;

DECRETA:

Art. 1º The Second Additional Protocol to the Economic Supplementation Agreement No. 39, between the Governments of the Republic Federative of Brazil and the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community) of April 11, 2001, attached by copy to this Decree, shall be executed and fulfilled as entirely as it contains.

Art. 2º This Decree goes into effect on the date of its publication.

Second Additional Protocol

The Plenipotentiaries of the Republic of Colombia, Ecuador, Peru and Venezuela, member states of the Andean Community, and of the Federative Republic of Brazil, accredited by their respective Governments under powers that have been bestowed in good and due form, deposited expeditiously in the General Secretariat of the Association (ALADI),

Considering the provisions of Resolution No. 003/2000 of the Administrator of the Economic Supplementation Agreement No. 39, at the meeting concluded from 18 a to October 20, 2000, in compliance with the provisions of Article 19 of that Agreement,

Concoming in:

Article 1º.-Modifying the Economic Supplementation Agreement No. 39 upon the incorporation of new products and the deepening of preferences given, under the conditions attached in the annex.

Article 2º.-This Protocol shall enter into force bilaterally on the date on which each of the Signator Parties, members of the Andean Community, together with the Federative Republic of Brazil, have incorporated it into their domestic law, in accordance with their respective laws.

The General Secretariat of ALADI shall be depositary of this Protocol, of which it shall send duly authenticated copies to the Signatory Parties.

In faith than, the respective Plenipotentiaries subscribe to this Protocol in the city of Montevideo, at the eleven days of the month of April two thousand and one, in an original in the Portuguese and Spanish languages, both of which are equally valid texts.
