DECREE NO 7,254, DE August 2, 2010.

Institut the Committee of the Hydrographic Basin of the Rio Grande, with an acting area located in the states of Minas Gerais and São Paulo, and gives other providences.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, inciso IV, of the Constitution, and in view of the willing in the arts. 37 a to 40 of the Act No 9,433 of January 8, 1997,

DECRETA:

Art. 1º It is instituted the Rio Grande Hydrographic Basin Committee with the following competencies within the scope of its acting area:

I-promote the discussion of issues related to water resources and articulate the performance of the intervening entities ;

II-arbitration, in first administrative instance, the conflicts related to resources water ;

III-approve the Water Resources Plan of the Basin ;

IV-monitor the execution of the Basin Water Resources Plan and suggest the arrangements required to fulfill their goals ;

V-propose to the National Council and the State Boards of Water Resources the accumulations, derivations, captions and low-expression releases, for exemption from the obligation to obtain the rights of water resources in accordance with the domains of these ;

VI-establish the collection mechanisms by the use of water resources and suggest the values to be charged ; and

VII-establish criteria and promote the cost proration of multiple-use works, of interest common or collective.

Single Paragraph. The acting area of the Rio Grande River Basin Committee, whose main river is from the Union domain, located in the states of Minas Gerais and São Paulo, is defined by the geographical boundaries of the Rio Grande river basin, bounded by the drainage area with its location foz, at scale 1:50.000, at coordinates 50º59' 35.025? West and 20º05' 19.515? South.

Art. 2º The Committee of the River Large River Basin will be composed of representatives:

I-of the Union ;

II-of the states of Minas Gerais and São Paulo ;

III-of the Municipalities situated, in whole or in part, in their area of acting ;

IV-of the users of the waters of their acting area ; and

V-from civilian water resources entities with proven acting in the basin.

§ 1º The number of representatives, holders and supplier, of each sector mentioned in this article, well as the criteria for your choice and referral, will be set out in the Rules of Procedure of the Committee.

§ 2º The process of choosing the Committee members will be public, with broad and prior disclosure.

§ 3º The Rules of Procedure will have on the composition of the River Large River Basin Committee, limited the representation of the executive powers of the Union, States and Municipalities to the half of its members.

Art. 3º The organization and operation of the River Large River Basin Committee will be defined by its Rules of Procedure, in accordance with the precepts of the Act no 9,433, 1997.

Art. 4º This Decree shall enter into force on the date of its publication.
