DECREE OF September 14, 2010

Outorga to the Transmission Company of Energy of Rio Grande do Sul S.A. -RS Energy concession for operation of public electric power transmission service, relative to Substation Caxias 6, 230/69 kV, Substation Ijuí 2, 230/69 kV, Substation New Petrópolis 2, 230/69 kV, and Lajated Large Substation, 230/138 kV, no State of Rio Grande do Sul.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution that confers you the art. 84, inciso IV, of the Constitution, in view of the provisions of the Laws n^the 8,987, February 13, 1995, 9,074, July 7, 1995, 9,491, September 9, 1997, and 9,648, of May 27, 1998, and what is stated in the Process n^o 48500.000889 /2010-09,

DECRETA:

Art. 1^o It gets outored to the Power Transmission Company of Rio Grande do Sul S.A. -RS Energy concession for operation of public electric power transmission service by construction, operation, maintenance and other associated facilities required of the functions of measurement, supervision, protec telecommunication, administration and support of the ventures Substation Caxias 6, 230/69 kV, Substation Ijuí 2, 230/69 kV, Substation Nova Petrópolis 2, 230/69 kV, and Lajated Large Substation, 230/138 kV, in the State of Rio Grande do Sul.

Art. 2^the The concession that it treats this Decree will be in force for the thirty-year period, counted from the date of signing of the respective Electrical Power Transmission Public Service Concession Contract.

§ 1^o The Contract is to be signed within thirty days, counted from the convocation made by the National Electric Power Agency-ANEEL, under penalty of ineffectiveness of the concession ora outored.

§ 2^the Mediant application of RS Energia to ANEEL, presented up to thirty-six months prior to the termination of the constant deadline of the caput of this article, the concession may be extended under the conditions that are stipulated.

Art. 3^o The existing goods and facilities in function of the electric power transmission service shall be linked to the public services granted, upon disposal, assignment, transfer or dation in warranty, without prior and express permission of ANEEL.

Single Paragraph. Upon expiry of the concession period, the goods and facilities bound for the provision of the service granted will revere to the Union, in the manner provided for in law and in the Grant Agreement.

Art. 4^o This Decree goes into effect on the date of its publication.
