DECREE OF November 21, 2005.

Declaration of public utility, for the purposes of misappropriation, total or partial, or institution of administrative servitude, in favor of Brazilian Petroleum S.A. -PETROBRAS, the real estate that mentions, constituted of land and benfectures, necessary for the construction of the Serra do Mel-Pecém (GASFOR II) pipeline and its complementary facilities, in the states of Rio Grande do Norte and Ceará, and gives others provider.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, inciso IV, of the Constitution, and in view of the provisions of art. 8th, inciso VIII, of Law No 9,478 of August 6, 1997, in Decree-Law No 3,365 of June 21, 1941, in Decree-Law No 1,075 of January 22, 1970, and what is stated in the ANP Process at 48610.004609 /2005-19,

DECRETA:

Art. 1º Stay declared of public utility, for the purposes of dispossession, total or partial, or of institution of administrative servitude, in favor of Brazilian Petroleum S.A. -PETROBRAS, real estate constituted of land and benfectures, of private property, excluded public domain goods, understood in the lanes of land located in the states of Rio Grande do Norte and Ceará, and whose administrative restrictions are indispensable for the construction of the Serra do Mel-Pecém (GASFOR II) pipeline and its complementary facilities.

§ 1º The strip of land to which the caput of this article refers, with approximately five millions, eight hundred and sixty thousand square meters, situated in the states of Rio Grande do Norte, in the Municipalities of Serra do Mel and Mossoró, and of the Ceará, in the Municipalities of Aracati, Icapui, Fortim, Beberibe, Cascavel, Pacajus, Horizonte, Guaiuba, Palmcia, Maranguape and Caufall, thus describes and characterizes: land strip with twenty meters wide and approximately two hundred and ninety and three thousand meters of extension, whose guideline has begun at the point of coordinate N=9.420.477, 950 and E=716.850, 706 ; from this point, it follows with a general west bearing and distance from 9,536.80 m to the point of coordinate N=9.420.500,000 and E=705.750,000 ; from this point, it follows with a general west bearing and distance of 11,450.25 m, crossing the divisa between the Municipalities of Serra do Mel-RN and Mossoro-RN, until you reach the point of coordinates N=9.421.200,000 and E=704.348, 653 ; from this point, it follows with a general northwest heading and distance from 12,277.64 m to the point of coordinates N=9.421.250,000 and E=703.357, 150 ; from this point, it follows with general north-west and distance from 13,883.82 m to the point of coordinate N=9.426.000,000 and E=694.500,000 ; § 2º The descriptions constant in § 1st of this article are in accordance with the plant DE-4450-16-6521-940-PEN-110, with the coordinate system in the Transverse Unit of Mercator-UTM, Datum Horizontal SAD-69, origin in Ecuador and Central Meridian 39º WGr, containing their respective constants worth 10,000 km "N" and 500 km "E".

§ 3º The areas of land referred to in the caput of this article, located in the States of Rio Large from the North and the Ceará, intended for the construction of the complementary facilities, thus describe and characterize:

I-Serra do Mel-RN Compression Station: area of forty-eight thousand, eight hundred and twenty five square meters, situated in the Municipality of Serra do Mel-RN, by limiting itself to the perimeter defined by the coordinates points N=9.420.437, 850 and E=716.872, 490, N=9.420.287, 850 and E=716.872, 490, N=9.420.287, 850 and E=716.611, 490 and N=9.420.437, 850 and N=9.420.437, 850 and E=716.482, 490 ;

II-Mosserole Delivery Point-RN II: area of eight thousand and twenty seven square meters and ninety square decimeters, situated in the Municipality of Mossoró-RN, by limiting itself to the perimeter defined by the coordinates points N=9.427.786, 600 and E=691.535, 720, N=9.427.826, 200 and E=691.478, 860, N=9.427.878, 900 and E=691.634,000 and N=9.427.825, 700 and E=691.652, 280 ;

III-Point of Delivery for the MPX-CE: area of thirty-four thousand, six hundred and twenty six square meters, situated in the Municipality of Cauka-CE, by limiting itself to the perimeter defined by the coordinates points N=9.591.872,000 and E-514.767,000, N=9.591.796,000 and E=514.910,000, N=9.591.608,000 and E=514.878,000 and N=9.591.712,000 and E=514.683,000 ; and

IV-Operational Support Area of the GASFOR II-CE: area of seven thousand, two hundred and eighty-three square meters and seven square meters, situated in the Municipality of Maracanaú-CE, limiting itself to the perimeter defined by the coordinates points N=9.574.837,540 and E=547.262, 100, N=9.574.802, 300 and E=547.345,010, N=9.574.724, 760 and E=547.318, 800 and N=9.574.758, 810 and E=547.237, 720.

§ 4º The constant descriptions of § 3rd of this article are in accordance with the plant DE-4450-16-6521-940-PEN-110, with the coordinate system in the Transverse Unit of Mercator-UTM, Datum Horizontal SAD-69, origin in Ecuador and Central Meridian 39º WGr, containing their respective constants worth 10,000 km "N" and 500 km "E".

Art. 2º Brazilian Oil S.A. -PETROBRAS, or the company by it controlled, directly or indirectly, is authorized to promote, with own resources, amicable or judicially, the dispropriation or institution of administrative servings of which it treats art. 1st of this Decree, and may even invoke the character of urgency for the purposes of provisional immission in possession of the goods, in the terms of art. 15 of Decree-Law No 3,365 of June 21, 1941, and of Decree-Law No 1,075 of January 22, 1970.

Art. 3º This Decree shall enter into force on the date of its publication.
