Cria the Marine Extraction Reservation Mocapajuba, located in the Municipality of St. Caetano de Odivelas, State of Pará.

THE REPUBLIC OF THE REPUBLIC, in the use of the attribution that confers you the art. 84, caput, inciso IV, of the Constitution, in view of the provisions of art. 18 and art. 22 of Law No. 9,985 of July 18, 2000 and in Decree No 4,340 of August 22, 2002, and in accordance with the case in Case No 02018.002151 /2006-32 of the Chico Mendes Institute for Conservation of Biodiversity-Chico Mendes Institute,

DECRETA:

Art. 1º It is created the Marine Extraction Reserve Mocapajuba, located in the Municipality of St. Caetano de Odivelas, State of Para, with the goals of:

I-ensure the conservation of the biodiversity of mangrove ecosystems, restinges, dunes, várzeas, alaged fields, rivers, estuaries and islands ; and

II-ensuring the sustainable use of natural resources and protecting the livelihoods and culture of the traditional extraction communities in

Art. 2º The Marine Extraction Reserve Mocapajuba, with approximately 21.029ha area and 173,267m perimeter, has its limits described in approxiate geographical coordinates-c.g.a. in the Datum SIRGAS 2000 a from the MIR- 67 and MIR-68 topographical letters, all in scale 1:250.000, published by the Directorate of the Geographical Service-DSG of the Brazilian Army, and of the LANDSAT TM5 223/060 and 223/61 satellite images, both of 13 of July 2008, in composition 5R4G3B, as per the following description: starts the perimeter in point 1, of c.g.a. 0 ° 38'32.87 "S and 47 ° 58' 50.41" W, coincident with section 20 of the descriptive memorial of the December 13, 2002 Decree that created the Extractive Reserve Mother Grande of Curuçá ; of this one, it follows in the southern sense, accompanying the limits of the Reservation Extractivist Mother Great from Curuçá, by the berth of the Mocupajuba River to the point 2, of c.g.a. 0 ° 46'36.17 "S and 47 ° 57' 19.19" W, located on the point of intersection between the boundaries of the Municipalities of St. John da Ponta, São Caetano de Odivelas and Curuçá ; of this, follows downstream by the left bank of the referred to river, on the shoreline that marches the urban area of the Municipality of St. Caetano from Odivelas to point 2, from c.g.a. 0 ° 44'12.21 "S and 48 ° 0' 41.33" W, located on the left margin of the watercourse locally known as the Mojuim River ; Art. 4º The buffer zone of the Marine Extraction Reserve Mocapajuba will be defined by means of specific act of the President of the Chico Mendes Institute of Conservation of Biodiversity-Chico Mendes Institute.

§ 1º The willing in caput will not be subject of subdelegation.

§ 2º Within the buffer zone will be permitted the mineral activities authorized by the National Department of Mineral Production-DNPM and licensed by the competent environmental organ, respected the provisions of the unit's handling plan involved, when there is.

Art. 5º The Marine Extraction Reserve Mocapajuba will be administered by the Chico Mendes Institute, which will adopt the necessary measures to its effective control, protection and implementation.

Art. 6º The Chico Mendes Institute and the Deliberative Council of the unit should observe the standards, criteria, standards and measures for the sustainable use of fishery and aquaculture resources, set out in joint act of the Ministers of State of the Fishing and Aquaculture and Environment, as laid out in § 6º of the art. 27 of Law No. 10,683 of May 28, 2003.

Art. 7º Stay declared of public utility, for the purposes of misappropriation, by the Chico Mendes Institute, the existing rural real estate within the limits described in art. 2º, in the terms of art. 5º, caput, point "k", and art. 6º of Decree-Law No. 3,365 of June 21, 1941.

Art. 8º This Decree shall enter into force on the date of its publication.
