PROVISIONAL MEASURE # 2.011-7, OF April 27, 2000.

Changes devices from Law No. 9,615, March 24, 1998, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution that confers you the art. 62 of the Constitution, adopts the following Interim Measure, with force of law:

Art. 1º Law No. 9,615 of March 24, 1998 passes vigorously with the following changes:

?Art. 11. The Development Council of the Brazilian Sport-CDDB is collegiate body of normatization, deliberation and advice, directly linked to the Cabinet of the Minister of State for Sport and Tourism, and it is up to you:

IV-expedition guidelines for the control of subtances and prohibited methods in sports practice ;

V-approve the Desportive Justice Codes and their changes ;

VI-exercise other assignments provided for in the legislation in force relating to issues of a sporting nature.

Single Paragraph. The INDESP will give technical and administrative support to the Brazilian Sport Development Board-CDDB.?(NR)

Single Paragraph. Verification of compliance with the requirements contained in the incisos I to IV of this article shall be the responsibility of the INDESP.?(NR)

?Art. 30. The employment contract of the professional athlete shall have a specified period of time, with never less than three months nor more than six years.

Single Paragraph. It does not apply to the employment contract of the professional athlete the provisions of art. 445 of the Consolidation of Labor Laws-CLT.?(NR)

?Art. 60. Administration and sports practice entities, as well as leagues, will be able to accredit to the Union for obtaining permission, with views on the exploitation of the permanent or eventual bingo game, for the purpose of raising resources for the promotion of sport.

§ 4º Bingo eventual is one that, without operating in rooms of its own, performs sporadic draw, utilizing human contact-free extraction process, and may offer prizes in goods and services.

§ 5º The authorisation that it treats this article will be valid for the period of twelve consecutive months, in the cases of permanent bingo, and per event, in the event of eventual bingo.

§ 6º Compete to INDESP accreditation of the entities referred to in the caput of this article and, to the Federal Economic Box, authorize and scrutinize the realization of bingo games as well as decide on the regularity of accounts benefits.?(NR)

Single Paragraph. On the assumption that the administration of the bingo game is handed over to the commercial company, it is solely responsible for this payment of all tributes and charges of Social Security incidents on the respective revenues obtained with that activity.?(NR)

IV-prior approval, by INDESP, of detailed project application in the improvement of sport, with priority for the training of the athlete ;

V-presentation of certain certificates from the civil, labor and protest caries on behalf of the legal person and, as to the physical person who administrates it, including criminal certificates ;

VI-regularity voucher together with the Federal Revenue, Social Security and the Service Time Guarantee Fund-FGTS ;

§ 3º The provisions of the inciso IX of this article does not apply to national sports administration entities, who will be able to obtain authorization for up to two establishments per unit of the federation in which they have official representation.?(NR)

?Art. 81-A. Any action or omission that violates the legal rules concernable to the lawful exploitation of the bingo game is deemed to be infraction and may be punished with the penalties provided for in the term of bingo gaming authorization, without prejudice to the application of other penalties provided for in legislation.(NR)

?Art. 81-B. The infractions referred to in the previous article may be punished with the following penalties:

I-warning ;

II-simple fine ;

III-daily fine ;

IV-apprehension of the instruments, petrechos, equipment or vehicles of any nature used in the infraction, and of the products and by-products obtained in the course of the practice of the illicit ;

V-destruction or destruction of product ;

VI-suspension of sale and manufacturing of product ;

VII-embargo of activity ;

VIII-partial or total suspension of activities ;

IX-restrictive of rights ;

X-reparation for damage caused ; and

XI-cancellation of the permit.

Single Paragraph. The fines referred to in this article may be fixed between the minimum values of R$ 5,000.00 (five thousand reais) and maximum of R$ 100,000.00 (one hundred thousand reais).?(NR)

?Art. 90-A. It is forbidden that more than one sports practice entity is controlled, managed or, in any way influenced in its administration by identical civil society of economic purposes, including its controller or controlled, or by identical commercial society admitted to the legislation in force.

Single Paragraph. The inobservance of the provisions of the caput of this article will involve the inabilitation of the sports practice entity for the perception of the benefits of which it treats art. 18, as well as the planned suspension in art. 48, inciso IV, while perdurating the transgression.?(NR)

?Art. 94-A. The Executive Power shall regulate the provisions of this Act, including the distribution of resources, gradation of fines and the procedures of their application.?(NR)

Art. 2º Stay convalidated the acts practiced on the basis of the Provisional Measure No. 2.011-6 of March 28, 2000.

Art. 3º This Provisional Measure shall come into force on the date of its publication.
